Statute: Public Highways Act Surplus Crown Property Disposal Act

OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated February 6, 2006, pursuant to

Section 18 of

Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, and

Section 11 of

Chapter 452 of the Revised Statutes of Nova Scotia, 1989, the Surplus Crown Property Disposal Act, is pleased to: (

a) extinguish the right of the public to use those portions of land in Halifax Regional Municipality which are part of the public highway system within the meaning of the Public Highways Act which are listed in Appendix æA', Appendix æB' and Appendix æD' which are attached to and form part of the report and recommendation; (

b) convey the lands in Appendix æA' and Appendix æD' for the price of $1.00 and the lands in Appendix æB' in exchange for other public highways described in Appendix æC', to Halifax Regional Municipality; (

c) convey those public highways and other lands, easements, rights of way and road reserves contiguous with or adjacent to the public highways in Appendix æA', Appendix æB' and Appendix æD', situate at or near Area "A" and Area "B" which Areas are shown on

Schedule "A", in Halifax Regional Municipality and which appendices and

schedule are attached to and form part of the report and recommendation; and (

d) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.
