B.C. Reg. 132/2006, deposited May 18, 2006, pursuant to the ENVIRONMENTAL MANAGEMENT ACT [Sections 138 and 139]. Order in Council 356/2006, approved and ordered May 17, 2006.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Municipal Sewage Regulation, B.C. Reg. 129/99, is amended as set out in sections 1 to 4 of the attached Schedule, and

(

b) the Waste Discharge Regulation, B.C. Reg. 320/2004, is amended as set out in

section 5 of the attached Schedule.

Schedule

Municipal Sewage Regulation

Section 19 of the Municipal Sewage Regulation, B.C. Reg. 129/99, is repealed and the following substituted:

Municipal sewage connection to industrial sewer system

19 This regulation does not apply to the release of municipal sewage to an industrial sewer system if

(

a) discharge from the industrial sewer system to the receiving environment is otherwise authorized by a permit or approval issued, or a regulation made, under the Act, and

(

b) the ratio of industrial discharge flow to municipal sewage flow is greater than 10:1.

Schedule 4 is amended

(

a) in

section 1 (1) by striking out "In this note," and substituting "In this section," ,

(

b) in

section 3 by striking out "note 2 (

b) of this Schedule," and substituting "section 2 (

b) of this Schedule,", and

(

c) by repealing the heading of Table 4 and substituting the following:

Table 4 — Minimum Drainage Pipe Length for Each Field (11) .

3 Appendix 1 to

Schedule 4 is amended

(

a) by repealing note 2 and substituting the following:

2 Flow calculations must be made by a qualified professional acting within the qualified professional's area of expertise. ,

(

b) in note 6 by striking out everything after "volume monitoring is required." , and

(

c) by adding the following note:

Section 5 (3) (

b) of

Schedule 7 is repealed and the following substituted:

(

b) percolation rates must be determined by a qualified professional acting within the qualified professional's area of expertise; .

Waste Discharge Regulation

Section 3 (1) to (3) of the Waste Discharge Regulation, B.C. Reg. 320/2004, is repealed and the following substituted:

(1) In this section, "domestic sewage" and "sewerage system" have the same meanings as in the Sewerage System Regulation, B.C. Reg. 326/2004.

(2) The discharge of domestic sewage to a sewerage system is exempt from the Act and regulations if the Sewerage System Regulation applies to that discharge and sewerage system.
