OIL AND GAS CONSERVATION (ORPHAN FUND LEVY)

AMENDMENT REGULATION

section 73 of the Oil and Gas Conservation Act.

1 The Oil and Gas Conservation Regulations (AR 151/71)

are amended by this Regulation.

Section 16.530 is amended

(

a) by repealing subsection (1) and substituting the

following:

16.530(1) For the 2011-2012 fiscal year of the Board, the

orphan fund levy payable by a licensee or approval holder is

calculated in accordance with the following formula:

Levy = A x $12 000 000

where

A is the licensee's or approval holder's deemed liability

on February 5, 2011 for all of its facilities, wells and

unreclaimed sites included within the LLR and OWL

programs, as calculated in accordance with Directive

006: Licensee Liability Rating (LLR) Program and

Licence Transfer Process, Directive 011: Licensee

Liability Rating (LLR) Program - Updated Industry

Parameters and Liability Costs and Directive 075:

Oilfield Waste Liability (OWL) Program, and

B is the sum of the industry's liability on February 5, 2011

for all facilities, wells and unreclaimed sites included

within the LLR and OWL programs, as calculated in

accordance with Directive 006: Licensee Liability

Rating (LLR) Program and Licence Transfer Process,

Directive 011: Licensee Liability Rating (LLR)

Program - Updated Industry Parameters and Liability

Costs and Directive 075: Oilfield Waste Liability

(OWL) Program.

b) in subsection (2) by adding "or approval holder" after

"licensee".

(AR 259/2000) is amended in

section 9 by striking out

"August 31, 2011" and substituting "August 31, 2021".

2 The Elevator Constructor Trade Regulation

(AR 276/2000) is amended in

section 9 by striking out

"August 31, 2011" and substituting "August 31, 2016".

3 The Landscape Gardener Trade Regulation

(AR 286/2000) is amended in

section 9 by striking out

"August 31, 2011" and substituting "August 31, 2018".

4 The Locksmith Trade Regulation (AR 288/2000) is

amended in

section 9 by striking out "August 31, 2011" and

substituting "August 31, 2020".

5 The Motorcycle Mechanic Trade Regulation

(AR 291/2000) is amended in

section 9 by striking out

"August 31, 2011" and substituting "August 31, 2019".
