Section 1 of the Public Health Act,

chapter P-22.4 of the Acts of New Brunswick, 1998, is amended in the definition “medical officer of health” by striking out “and includes the chief medical officer of health” and substituting “and includes the chief medical officer of health and the deputy chief medical officer of health”. 1 L’article 1 de la

section 58 the following: 2 La Loi est modifiée par l’adjonction de ce qui suit après l’article 58 : Chief medical officer of health Médecin-hygiéniste en chef 58.1(1) The Lieutenant-Governor in Council may ap ‐ point a chief medical officer of health for the Province from an eligibility list of duly qualified medical practi ‐ tioners provided to the Lieutenant-Governor in Council by the Minister. 58.1(1) Le lieutenant-gouverneur en conseil peut nom‐ mer, parmi les médecins dûment qualifiés figurant sur la liste d’admissibilité que lui soumet le Ministre, un médecin-hygiéniste en chef pour la province. 58.1(2) The person appointed as the chief medical of ‐ ficer of health shall perform the duties required of the chief medical officer of health under this Act and the regulations and any other duties assigned to the chief medical officer of health by the Minister. 58.1(2) La personne nommée médecin-hygiéniste en chef remplit les fonctions que la présente loi et ses règle ‐ ments lui confèrent ainsi que toute autre fonction que le Ministre lui attribue. 58.1(3) The chief medical officer of health shall be ap ‐ pointed for a term of up to seven years. 58.1(3) Le médecin-hygiéniste en chef est nommé pour un mandat maximal de sept ans. 1

58.1(4) The chief medical officer of health shall be eli‐ gible for reappointment for additional terms of up to three years each, but in no case shall the chief medical officer of health hold office for more than a total of ten years. 58.1(4) Le mandat du médecin-hygiéniste en chef est renouvelable plus d’une fois pour une période maximale de trois ans chaque fois, ce dernier ne pouvant demeurer en poste pendant plus de dix ans au total. 58.1(5) The person appointed as the chief medical of ‐ ficer of health under this

Schedule of the Public Service Labour Relations Act, as well as asso‐ ciate deputy ministers and persons holding positions of equivalent ranks, who give directions to the chief medi ‐ cal officer of health regarding the public health functions of the chief medical officer of health’s responsibilities shall give the directions in writing. 58.1(8) Les ministres, les administrateurs généraux et les directeurs généraux des organismes publics figurant à l’annexe 1 de la Loi relative aux relations de travail dans les services publics ainsi que les sous-ministres dé‐ légués et les titulaires d’une charge équivalente qui donnent au médecin-hygiéniste en chef des directives concernant les fonctions relatives à la santé publique re ‐ levant de ses responsabilités le font par écrit. 58.1(9) A direction under subsection (8) may be pub ‐ lished, at the discretion of the chief medical officer of health, in The Royal Gazette. 58.1(9) Les directives prévues au paragraphe (8) peuvent être publiées dans la Gazette royale à la discré ‐ tion du médecin-hygiéniste en chef.

Acting chief medical officer of health Médecin-hygiéniste en chef intérimaire 58.2(1) When the office of the chief medical officer of health is vacant or the chief medical officer of health is absent or is unable to act, the Lieutenant-Governor in Council may appoint a medical practitioner as an acting chief medical officer of health. 58.2(1) En cas d’absence ou d’empêchement du médecin-hygiéniste en chef ou de vacance de son poste, le lieutenant-gouverneur en conseil peut nommer un mé ‐ decin à

titre de médecin-hygiéniste en chef intérimaire. 58.2(2) An acting chief medical officer of health shall perform the duties and has the authority, responsibilities and powers of the chief medical officer of health. 58.2(2) Le médecin-hygiéniste en chef intérimaire remplit les fonctions et a l’autorité, les responsabilités et les pouvoirs du médecin-hygiéniste en chef. 3

Section 59 of the Act is repealed and the following is substituted: 3 L’article 59 de la Loi est abrogé et remplacé par ce qui suit : 59(1) The chief medical officer of health may appoint one or more medical officers of health, each of whom being a qualified medical practitioner, for each health re ‐ gion in the Province. 59(1) Le médecin-hygiéniste en chef peut nommer, pour chaque région sanitaire de la province, un ou plu ‐ sieurs médecins-hygiénistes, lesquels sont tous des mé ‐ decins dûment qualifiés. 59(2) A person appointed as a medical officer of health shall perform the duties required of a medical of ‐ ficer of health under this Act and the regulations and any other duties as may be assigned by the chief medical of ‐ ficer of health. 59(2) La personne nommée médecin-hygiéniste rem‐ plit les fonctions que la présente loi et ses règlements lui confèrent ainsi que toute autre fonction que le médecin- hygiéniste en chef peut lui attribuer. 59(3) A medical officer of health is, by virtue of their office, a commissioner of oaths for taking affidavits to be read in The Court of King’s Bench of New Bruns ‐ wick. 59(3) Tout médecin-hygiéniste est d’office commis ‐ saire à la prestation des serments pour recevoir des affi ‐ davits auprès de la Cour du Banc du Roi du Nouveau- Brunswick. 59(4) Despite subsection (1), a medical officer of health has the authority to act in any health region in the Province. 59(4) Par dérogation au paragraphe (1), chaque médecin-hygiéniste a le pouvoir d’agir dans toute région sanitaire de la province. 59(5) A person appointed as a medical officer of health under this

a) by repealing subsection (1) and substituting the following:

8 The Act is amended by adding after

section 61.1 the following: 8 La Loi est modifiée par l’adjonction de ce qui suit après l’article 61.1 : Agreements entered into by chief medical officer of health Accords conclus par le médecin-hygiéniste en chef 61.11 The chief medical officer of health may enter into and amend an agreement with a portion of the pub ‐ lic service specified in the First

Schedule of the Public Service Labour Relations Act for the purpose of the or ‐ ganization and delivery of public health programs and services, the establishment of standards, the prevention of diseases and injuries and the promotion and protection of the health of the people of New Brunswick or any group of them. 61.11 Le médecin-hygiéniste en chef peut conclure un accord avec toute subdivision des services publics figu ‐ rant à l’annexe 1 de la Loi relative aux relations de tra ‐ vail dans les services publics pour l’organisation et la fourniture de programmes et de services de la santé pu ‐ blique, l’établissement de normes, la prévention des ma ‐ ladies et des blessures et la promotion et la protection de la santé de la population du Nouveau-Brunswick ou de tout groupe de celle-ci ainsi que modifier un tel accord. 9 The Act is amended by adding after

section 64.1 the following: 9 La Loi est modifiée par l’adjonction de ce qui suit après l’article 64.1 : Annual report Rapport annuel 64.2(1) Commencing in the fiscal year 2026-2027, the chief medical officer of health shall prepare an annual report for the preceding fiscal year on the exercise of their functions under this Act containing the following information: 64.2(1) À partir de l’exercice financier 2026-2027, le médecin-hygiéniste en chef prépare un rapport annuel pour l’exercice financier précédent portant sur l’exercice des fonctions que lui confère la présente loi, lequel ren ‐ ferme ce qui suit : (

a) details concerning notifiable events and notifia ‐ ble diseases;

a) des renseignements sur les événements à déclara ‐ tion obligatoire et les maladies à déclaration obliga ‐ toire; (

b) details concerning outbreaks investigated;

b) des renseignements sur les éclosions ayant fait l’objet d’une enquête; (

c) details concerning the existence or possible exis‐ tence of a public health emergency;

c) des renseignements sur l’existence, même pos ‐ sible, d’un état d’urgence sanitaire; (

d) the number of and results of inspections;

e) the number of people vaccinated;

e) le nombre de personnes immunisées; (

f) any information prescribed by regulation; and

g) any other information the chief medical officer of health considers appropriate.

section who was appointed under the Civil Service Act before the commencement of this

section shall be deemed, on the commencement of this section, to hold office as the chief medical officer of health ap ‐ pointed under

section 58.1 of the Public Health Act and is appointed for a term of 7 years. 11(1) Est réputée occuper, à l’entrée en vigueur du présent article, le poste de médecin-hygiéniste en chef nommé en vertu de l’article 58.1 de la

section who was ap ‐ pointed under the Civil Service Act before the com ‐ mencement of this

section is revoked. 11(2) Est révoquée la nomination de la personne qui occupait le poste de médecin-hygiéniste en chef immé ‐ diatement avant l’entrée en vigueur du présent article, y ayant été nommée en application de la

Loi sur la Fonction publique. 11(3) Any person who held a position as a medical officer of health immediately before the commence ‐ ment of this

section who was appointed under para ‐ graph 59(1)(

b) of the Public Health Act as it read im ‐ mediately before the commencement of this

section shall be deemed, on the commencement of this section, to be appointed as a medical officer of health under

section 59 of the Public Health Act. 11(3) Est réputée, à l’entrée en vigueur du présent article, avoir été nommée médecin-hygiéniste en vertu de l’article 59 de la
