EXPLANATORY

NOTE

The

Bill enacts the Responsible Flyer Delivery Act, 2026

to prohibit a person from leaving promotional materials in a visible location

at a private dwelling with some exceptions.

Act to regulate the distribution of promotional materials at private dwellings

His

Majesty, by and with the advice and consent of the Legislative Assembly of the

Province of Ontario, enacts as follows:

Definitions

this Act,

“election

period” means,

(

a) in

relation to a federal or provincial election, the period starting on the day

that a writ is issued for the election and ending on the polling day for the

election,

(

b) in

relation to a municipal election, the period starting 60 days before the

polling day for the election and ending on the polling day for the election; (“ période

électorale ”)

“promotional

materials” means flyers, brochures, prospectuses, leaflets, catalogues or any

material used to promote a product, a service, an event or a private or

political organization. (“ matériel promotionnel ”)

Prohibition

No person

shall leave any promotional materials in a visible location at a private

dwelling, except for promotional materials prepared by,

(

a) the

constituency office of a member of council of a municipality or a member of the

Assembly or the Parliament of Canada;

(

b) a

candidate within the meaning of the Municipal Elections

Act, 1996 or a registered party within the meaning of the Election Finances Act or the Canada

Elections Act , but only during an election period and if no mailbox is

present at the private dwelling; or

(

c) the

Non-application

Section

2 does not apply to an employee or agent of Canada Post while they are engaged

in mail delivery.

Commencement

This Act comes into force on the day it receives Royal Assent.

Short

title

The

short title of this Act is the Responsible Flyer

Delivery Act, 2026 .
