An Act Respecting the Right to Work Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1 The Procurement Act,

chapter of the Acts of New Brunswick, 2012, is amended by adding after

section the following: 9.1 Where the conditions of a contract to purchase a ser- vice are altered after the fact by the application by the Minister of new requirements having to do with the provi- sion of the service in both or either of the official lan- guages of New Brunswick, the Minister shall be required to accommodate the supplier to ensure (

a) the provision of the service, and (

b) that any employees affected by the altered service level maintain their employment standing. 2 The Civil Service Act,

chapter C-5.1 of the Acts of New Brunswick, 1984, is amended by adding after sub- section 26(4) the following: 26(5) When the services of an employee are reduced or no longer required because of application by the Minister of new requirements having to do with the provision of the service in both or either of the official languages of New Brunswick, the deputy head shall maintain the employ- ment status, including pay band, pay scale, and regular working hours of the employee, but may reassign the em- ployee to perform other appropriate duties.

Loi sur la passation des marchés publics,

chapitre des Lois du Nouveau-Brunswick de 2012, est modifiée par l’adjonction de ce qui suit après l’article 9 : 9.1 Lorsque l’application par le ministre de nouvelles exigences relatives à la prestation d’un service dans l’une ou l’autre des langues officielles du Nouveau-Brunswick ou les deux vient changer après coup les conditions d’un contrat d’achat de service, le ministre est tenu d’accom- moder le fournisseur afin :

a) que la prestation du service soit assurée;

b) que les employés touchés par le changement conservent leur situation d’emploi. 2 La

Loi sur la Fonction publique,

chapitre C-5.1 des Lois du Nouveau-Brunswick de 1984, est modifiée par l’adjonction de ce qui suit après le paragraphe 26(4) : 26(5) Lorsque l’application par le ministre de nouvelles exigences relatives à la prestation d’un service dans l’une ou l’autre des langues officielles du Nouveau-Brunswick ou les deux vient réduire les services d’un employé ou les rend inutiles, l’administrateur général maintient la situa- tion d’emploi, y compris la catégorie salariale, l’échelle salariale et les heures de travail normales de l’employé, mais peut réaffecter l’employé et le charger à d’autres fonctions appropriées.
