section 16.1 of the Historic Resources Act , I am pleased to announce that the Lieutenant-Governor in Council has declared the parcel of land containing the archae ological remains of the 1610 John Guy Plantation to be a provincial historic site. The land was acquired by the Government of Newfoundland and Labrador on the au thority of

section 16.2 of the Historic Resources Act , the surveys of which are on file with the Departme nt of Tourism, Culture and Recreation and the site shall be known as the Cupids Cove Plantation Provincial Historic Site. Note: This Practice Note also applies to th e Supreme Court of Newfoundland and Labrador – Court of Appeal Criminal Appeal Rules (2002). Setting Dates for Hearing of Appeals Background and Purpose 1. Under the existing rules of court, a party wishing to obtai n a date for the hearing of an appeal must file an application under Rule 57.18(1) of the ci vil appeal rules in respect of a civil appeal and under Rule 18(1) of the criminal appeal rules in respect of a criminal appeal, and then appear in court to obtain a date. 2.

With a view to reducing costs to litigants by eliminating unnecessary court appearances on routine matters, it has been decided that it is appropriate to permit the deputy registrar, in certain circumstances, to set a date without a court appearance by the parties. While this procedural change may be able to be accomplished within the existing rules of court, it has been decided nevertheless to ame nd both the civil and criminal rules to clarify the matter. Accordingly, Rule 57.18 has been am ended effective March 1, 2010 to rec ognize the change.

The text of the amendment can be found in NL Reg 10/10 or online at http://assembly.nl.ca/Legislation/sr/regulations/RulesSC/Rc86ru57.htm#57.18. The Court is also in the process of amending Rule 18(1) of the criminal rules in similar fashion. 3. Pending completion of the ame ndments, it has been considered appropriate to issue this Practice Note, Part (a), which will be effective immediately. 4. In some cases following perfection of an appeal, the

partie s will delay making a request to set a date for a hearing. While parties may have legitimate reas ons for so doing, the Court is concer ned that there may be other cases,

Even though there are mechanisms within the civi l rules for dealing with inactive cases through deemed abandonment after 12 months of inactivit y, and allowing the deputy registrar to set a matter down after 6 months of inactivity to consider whether an ap peal should be struck out, it has neve rtheless been decided that there should be additional procedures made available within a shorter time frame to ensure that cases that are perfected and awaiting a hearing can be advanced, if that is appropriate to do so. Those procedures are outlined in this Practice Note, Part (b). Practice Note (

a) Facilitating the Se tting of Hearing Dates 6. The deputy registrar will entertain te lephone, fax or email request s from counsel or a party to an appeal to set a date for the hearing of an appeal within the two months following the month in which a request is received where: (

a) the appeal has been perfected by the filing of an appeal book and all factums; (

b) the specific direction of the Court is not required on any matter prior to the setting of a date; and (

c) there is no other special circumstance requiring a court appearance. 7. Parties and their counsel are encouraged to determine, by reference to the Court’s published calendar of sitting dates, mutually acceptable dates during the following two m onths when the parties will be available to appear on the appeal. 8. At the time of making the re quest, the requesting party must: (

a) confirm to the deputy registra r that conditions (a), (

b) and (

c) in paragraph 6 are satisfied; (

b) provide a list of the dates during the next tw o months of the court’s published sitting calendar: (

i) when both parties are available to appear on the appeal, as determined in accordance with paragraph 7; or (ii) if no mutually acceptable dates are offered, when the requesting party will not be available to appear on the appeal. For requests made by fax or email, th e form annexed to this Practice Note as

Schedule “A” should be used and copied to the other parties. Where a request is made by telephone, the requesting party should notify the other parties that the request has been made. 9. The deputy registrar will, if necessary, attempt to c ontact the other parties or th eir counsel to confirm an acceptable date for the hearing of the appeal. If the deput y registrar does not receive a reply from such parties or their counsel within 3 days of having attempted to contac t them, the deputy registrar may proceed to set a date for the hearing in accordance with the requesting party’s proposal. 10.

The deputy registrar may convene a conference call wi th all parties or their counsel, with or without the participation of the Chief Justice or his or her designate, to resolve scheduling arrangements. 11. The deputy registrar may decline to se t a date in accordance with this pr ocedure and require an application be made to the Court where: (

a) it appears that any of the conditions in paragraph 6 is not satisfied; (

b) one of the parties objects to setting a date without an application being made; (

c) the deputy registrar concludes that for an y other reason an application should be made. 12. If the deputy registrar sets a date pursu ant to this procedure, the parties or their counsel will be notified in writing that the appeal will be heard on that date. 13. No date set pursuant to this procedure will be changed unless: (

a) the deputy registrar, after consultation with all

partie s or their counsel and with the Chief Justice, consents; (

b) unless an application is made for that purpose; or (

c) the Court otherwise directs. 14. Parties and their counsel are encouraged to adopt this pr ocedure for setting dates, in appropriate cases, instead of using the application procedure. 15. Where a party unnecessarily or unreasonably requests that a date be set by means of the application procedure, the presiding judge may take that fact in to consideration in deciding to awards costs of the application in a civil proceeding against that party. 16. Taxing masters may also take into consideration wh ether an application to set a date was unnecessarily or unreasonably made in deciding to deny costs of such application to a party who is otherwise entitled to costs following a civil appeal. (

b) Delays in Setting Dates 17. Barring good reasons to the contrary, an appellant or his or her counsel will be expected to apply for or request a date for the hearing of the appeal within 60 days of the filing of the respondent’s factum.

Where the deputy registrar is of the opinion that ther e are no, or inadequate, reasons given for not requesting a hearing date, she may give notice to the parties that the matter will be called at a subsequent applications date for a judge to determine whether a hearing date should nevertheless be set. 20. Schedule 1. These regulations may be cited as the Rail Service Regulations.

PART I FITNESS CRITERIA 2. In this Part (a) "deductible" means the amount of risk for which the insured takes financial responsibility under an insurance contract; (b) "liability insurance" means financial compensation provided for in a contract entered in to between a railway company and an insurer in respect of the following matters arising with respect to a railway owned, constructed or operated by the railway company and out of the operations of the railway company as they relate to the ra ilway or as a result of

an act or omission of the railway company, or one of its officers, directors, employees or agents (

i) third party bodily injury or death, including passengers, (ii) third party damage to property, and (iii) named perils pollution; (c) "minister" means the minister appointed under the Executive Council Act to administer the Act; and (d) "named perils pollution" means risks that are set out in an insurance contract that are associated with seepage, pollution or contamination resulting from but not limited to collision, overturning, derailment, upset, hostile fire, lightning or ex- plosion or other railway related accidents. 3. For the purpose of subsection 15(1) of the Act, this Part pre- scribes the criteria relating to fitness to hold a licence to operate a rail- way.

(1) A railway company shall hold a minimum amount of $10,000,000 of liability insurance contracted with an insurer authorized to carry on business in the province.

(2) The insurance required under subsection (1) shall name the Crown in right of the province as represented by the minister, her offi- cers, employees and agents as additional insureds.

(3) The railway company shall notify the minister in writing, without delay, of the cancellation of or an alteration to, or a proposed cancellation of or alteration to, its liability insurance coverage or change in operation of the railway or in the operations of the railway company in relation to the railway which may cause its insurance to no longer be adequate.

(4) A liability insurance policy obtained by a railway company in compliance with this regulation shall include a term that cancellation of the policy or alteration to the coverage shall not be effective unless the minister is given at least 30 days notice of cancellation or alteration.

(5) Before the commencement of the construction or operation of a railway, the railway company shall file with the minister a certified copy of the insurance policy required under subsection (1), or a certifi- cate acceptable to the minister setting out the particular s of the insur- ance policy, including details of coverage and of deductible.

(6) Where (

a) there is an alteration in the coverage under an insurance pol- icy required under subsection (1); or (

b) an insurance policy obtaine d by a railway company in com- pliance with this regulation is replaced by another policy the railway company shall file with the minister a certified copy of the altered or replacement policy, or a certificate acceptable to the minister setting out the particulars of the a ltered or replacement policy, includ- ing details of coverage and of deductible. 5. The minister may reduce the minimum required amount of in- surance set out in subsection 4(1) with respect to a railway company or class of railway companies. The applicant shall demonstrate that its management, manage- rial staff and other employees have or will have sufficient knowledge of all applicable regulations and rules relating to railway safety and opera- tions, relative to their respective positions, to satisfy the minister that the railway can be operated safely and responsibly.

PART II RAILWAY SAFETY REQUIREMENTS 7. In this Part (a) "collision" means an impact, other than an impact associated with normal operating circumstances, between rolling stock or between rolling stock and another object; (b) "dangerous goods" means a product, substance or organism (

i) included by its nature or by the Transportation of Dan- gerous Goods Regulations in a class listed in the Sched- ule to the Transportation of Dangerous Goods Act , 1992 (Canada), or (ii) that is a dangerous good as defined in the Dangerous Goods Handling and Transportation Act; (c) "derailment" means an acci dent in which one or more wheels of rolling stock leave the rails, other than by reason of an explosion or a collision; (d) "grade-crossing collision" m eans a collision that occurs at a railway crossing between rolling stock and another crossing user; (e) "reportable railway accident" means an accident resulting directly from the operation of rolling stock, in which (

i) a person sustains a serious injury or is killed as a result of (

A) being on board or getting on or off the rolling stock, or Demonstration of fitness

B) coming into contact with a part of the rolling stock or its contents, or (ii) the rolling stock (

A) is involved in a grade-crossing collision, (

B) is involved in a collision or derailment and is carry- ing passengers, (

C) is involved in a collision or derailment and is carry- ing dangerous goods, or is known to have last con- tained dangerous goods the residue of which has not been purged from the rolling stock, (

D) sustains damage that af fects its safe operation, or (

E) causes or sustains a fi re or explosion, or causes damage to the railway, that poses a threat to the safety of a person, property or the environment; (f) "reportable railway incident" means an incident resulting directly from the operation of rolling stock, in which (

i) a risk of collision occurs, (ii) an unprotected main track switch is left in an abnormal position, (iii) a railway signal displays a less restrictive indication than that required for the intended movement of rolling stock, (iv) an unprotected overlap of operating authorities occurs, (

v) a movement of rolling stock exceeds the limits of its authority, (vi) there is runaway rolling stock, (vii) a crew member whose dutie s are directly related to the safe operation of the rolling stock is unable to perform the crew member’s duties as a result of a physical inca-

Rail Service Regulations 49/10 The Newfoundland and Labrador Gazette July 16, 2010 342 pacitation that poses a threat to a person, property or the environment, or (viii) dangerous goods are released on board or from the roll- ing stock; (g) "risk of collision" means a situation where rolling stock comes so close to being involved in a collision that a threat to the safety of a person, property or the environment exists; (h) "safety standard" means a regulation, circular, order, rule, standard, or similar thing set out in the Schedule; (i) "serious injury" means an injury that is likely to require ad- mission to a hospital; and (j) "traffic authority" means a peace officer as defined in sub-

section 2(1) of the Highway Traffic Act. 8.

(1) A railway to which the Act applies shall conform to, and shall be constructed and operated in compliance with, the safety stan- dards set out in the

Schedule to these regulations.

(2) A railway company shall ensure that a railway owned, con- structed or operated by it meets the requirements of subsection (1). 9. A reference to a safety standard in the

Schedule is a reference to the safety standard as it may be amended, revised or replaced, notwith- standing that the amendment, revision or replacement may be set out in or take the form of (

a) a document of a different character; or (

b) a different type of statutory instrument. 10.

(1) Where a reportable railway acci dent or incident takes place, the railway company or a crew member aboard the rolling stock in- volved in the accident or incident sha ll report to the minister or a per- son designated by the minister the following information: (

a) the name of the railway company; (

c) whether deaths or serious injuries resulted from the accident or incident and, if so, the number of persons killed or in- jured; and (

d) whether the rolling stoc k carries dangerous goods.

(2) A report under subsection (1) shall be made as soon as pos- sible after the accident or incident but in any event, the report shall be made within 24 hours after the accident or incident.

(3) In addition to the reporting requirements set out in subsec- tions (1) and (2), the railway company shall, in a form approved by the minister, submit to the minister or a person designated by the minister within 30 days after the accident or incident all the following informa- tion: (

a) the train number and direction; (

b) the name of the railway company; (

c) the names of the crew members; (

d) the date and time of the accident or incident; (

e) the location of the accident or incident by reference to a mileage and subdivision location and, if applicable, the track designation in a yard; (

f) the number of crew members, passengers and other persons who were killed or sustained a serious injury; (

g) a description of the accident or incident and the extent of resulting damage to the rolling stock, the railway, the envi- ronment and other property; (

h) a description of dangerous goods contained in or released from the rolling stock; (

i) in the case of a reportable accident, the time of arrival or anticipated time of arrival of wreck-clearing equipment; and (

j) the name, title and location of the person making the report.

(1) A railway company may apply to the minister for an exemp- tion from complying with the Highway Crossings Protective Devices Regulations, C.R.C., c. 1183, during a period of reduced train activity on a railway line.

(2) An application for an exemption shall be made in the form the minister requires and shall cont ain or be accompanied by the infor- mation.

(3) The railway company shall se nd a copy of the application and any supporting information to the traffic authority of every high- way crossed by the railway line that will be affected by the proposed exemption.

(4) Where the minister consider s the exemption appropriate, he or she may issue an exemption permit, with or without conditions, but in any other case, the minister may refuse to issue an exemption permit.

(5) Where the minister refuses to issue an exemption permit, he or she is not required to give reasons for the refusal.

(6) The minister shall advise the railway company about his or her decision within 60 days after he or she receives all the required information about the application.

(7) The railway company shall, without delay after being ad- vised about the minister’s decision, advise every affected traffic author- ity about the decision.

(8) Where an exemption permit is issued, the railway company shall also advise the traffic authorities about the expiry date stated in the permit.

(9) An exemption permit expires on the earlier of (

a) the expiry date stated in the permit; and (

b) the day the railway compan y resumes regular operations on the railway line covered by the permit.

(10) An exemption permit is not renewable and may not be ex- tended beyond the expiry date stated in the permit and shall Exemptions respect- ing Highway Cross- ings Protective Devices Regulations

a) comply with a condition the minister imposes on the permit; (

b) not more than 7 days before operating a train on the railway line covered by the permit, insp ect every highway crossing protective device on the line the train will operate over and perform any maintenance of a device the inspection indi- cates should be done; (

c) whenever it intends to operate a train on the railway line during the term of the permit, advise the minister before op- erating the train and provide th e minister with the informa- tion the minister requires; and (

d) whenever it intends to operate a train on the railway line during the term of the permit, advise an affected traffic au- thority before operating the train and provide the traffic au- thority with information provided to the minister under paragraph (c).

(11) A railway company that is issued an exemption permit shall not be entitled to receive a signal inspection and maintenance compen- sation from the Crown in right of the province in respect of the railway line covered by the permit and the period covered by it.

PART III POWERS OF INSPECTORS 12. An Inspector appointed under

section 6 of the Act for the pur- pose of enforcing the Act and the Regulations and Rules adopted under this regulation shall have the same powers as those set out in the Rail- way Safety Act (Canada). Inspectors ap- pointed under the Act

section 4.1 of the Wild Life Regulations and the Wild Life Act, I make the following Order. Dated at St. John’s, July 14, 2010. Charlene Johnson Minister of Environment and Conservation ORDER Analysis 1.

Short title 2. Tags - class III rivers 3. Tags - class II rivers 4. Tags - class I rivers 5. Tags - unclassified rivers in Labrador 6. Tags - large salmon in Lab- rador 7. Tags - non-scheduled rivers 8. Condition on tag use 1. This Order may be cited as the Salmon Angling and Tag Use Order.

Short title

Salmon Angling and Tag Use Order 50/10 The Newfoundland and Labrador Gazette July 16, 2010 354 2. Salmon retained by angling on rivers with a yearly quota of 2 salmon (Class III) under

section 13.1 and

Schedule I of the Newfound- land and Labrador Fishery Regulations (Canada) shall be tagged with red tags only. 3. Salmon retained by angling on rivers with a yearly quota of 4 salmon (Class II) under

section 13.1 and

Schedule I of the Newfound- land and Labrador Fishery Regulations (Canada) shall be tagged with red or green tags only. 4.

(1) Salmon retained by angling on rivers with a yearly quota of 6 salmon (Class

I) under

section 13.1 and

Schedule I of the Newfound- land and Labrador Fishery Regulations (Canada) shall be tagged with red, green or blue tags.

(2) A blue tag referred to in subsection (1) may be affixed to a salmon from the first day of August to the end of the period when salmon angling and retention are permitted.

(3) A red or green tag referred to in subsection (1) may be af- fixed to a salmon during the period when salmon angling and retention are permitted.

(4) Notwithstanding subsection (3), a red or green tag may not be affixed to a salmon retained on the Gander River from September 8 to the end of the period when salmon angling and retention are permit- ted on that river. 5. Salmon retained by angling on rivers that are unclassified in Zone 1 and 2 (Labrador) with a yearly quota of 4 salmon under

section 13.1 and

Schedule I of the Newfoundland and Labrador Fishery Regu- lations (Canada) shall be tagged with red or green tags only. 6. Notwithstanding

section 5, where a large salmon that is greater than 63 centimetres is permitted to be retained by angling on a river that is unclassified in Zone 1 and 2 (Labrador) under

section 13.1 and

Schedule I of the Newfoundland and Labrador Fishery Regulations (Canada), the large salmon shall be tagged with a green tag that has "No. 4" imprinted on that tag. 7. Salmon retained by angling on a river or other inland waters with a yearly quota of 2 salmon (Class III) under

section 13.1 of the Newfoundland and Labrador Fishery Regulations (Canada) that is not Tags - class III rivers Tags - class II rivers Tags - class I rivers Tags - unclassified rivers in Labrador Tags - large salmon in Labrador Tags - non- scheduled rivers
