An Act to Amend the Fish and Wildlife Act Loi modifiant la

Loi sur le poisson et la faune Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et du consentement de l’Assem- blée législative du Nouveau-Brunswick, décrète : 1 Subsection 3 9.1(2) of the Fish and Wildlife Act,

chapter F-14.1 of the Acts of New Brunswick, 1980, is repealed and the following is substituted: 1

Le paragraphe 39.1(2) de la

Loi sur le poisson et la faune,

chapitre F-14.1 des Lois du Nouveau- Brunswick de 1980, est abrogé et remplacé par ce qui suit : 39.1(2) Subsection (1) does not apply to 39.1(2) Le paragraphe (1) ne s’applique pas : (

a) a conservation officer acting under

section 27,

a) à un agent de conservation qui agit en vertu de l’article 27; (

b) a person acting under and in accordance with sub-

section 34(4),

c) a person acting under and in accordance with writ- ten authorization given under subsection 34(7), or

c) à une personne qui agit au

titre d’une autorisation écrite accordée en vertu du paragraphe 34(7) et en con- formité avec cette autorisation; (

d) a holder of a proper licence who hunts wildlife on a weekly day of rest during the period beginning on October 28 and ending on November 17, inclusive.

Section 42 of the Act is amended 2 L’article 42 de la Loi est modifié (

a) in subsection (1) in the portion preceding para- graph (

a) by striking out “subsection (2), (3) or (4)” and substituting “subsection (2), (3), (3.1) or (4)”;

a) au paragraphe (1), au passage qui précède l’ali- néa a), par la suppression de « paragraphe (2), (3) ou (4) » et son remplacement par « paragraphe (2), (3), (3.1) ou (4) »; 1

b) by adding after subsection (3) the following:
