16.1(3) A ticket reviewer shall act in accordance with any general or specific directives issued by the Minister of Justice and Public Safety, or a delegate of that Minis- ter, in carrying out his or her functions and duties. 16.1(3) Dans l’exercice de ses attributions, l’examina- teur de billets se conforme aux directives générales et particulières du ministre de la Justice et de la Sécurité publique ou de son délégué. 16.2 A police officer or authorized person who be- lieves, on reasonable and probable grounds, that a person has committed a prescribed offence may serve that per- son with a violation ticket in prescribed form. 16.2 L’agent de police ou la personne autorisée qui a des motifs raisonnables et probables de croire qu’une personne a commis une infraction prescrite peut lui si- gnifier un billet de violation selon la formule prescrite. 16.3(1) A violation ticket shall 16.3(1) Le billet de violation : (

a) be directed to the defendant,

b) set out the offence with which the defendant is charged,

c) state that the defendant may dispute the charge set out in the violation ticket by filing a notice of dis- pute within the period prescribed under

section 16.7, in which case a time and place will be fixed at which the defendant will appear in court in order to be dealt with according to law,

section 16.7, in which case the defendant is deemed to have been convicted of the offence,

16.3(2) For the purposes of paragraph (1)(b), the of- fence to which the defendant is charged shall be set out in the violation ticket 16.3(2) Aux fins d’application de l’alinéa (1)b), l’in- fraction dont le défendeur est accusé est indiquée au bil- let de violation à l’aide de mots qui : (

section 16.8 or a notice of dispute is filed in accordance with

section 16.9 within the period pre- scribed under

section 16.7, a copy of the violation ticket shall be filed with the ticket reviewer within 15 days fol- lowing the period prescribed under

16.6(4) For the purposes of

a) paying the fixed penalty in accordance with sec- tion 16.8 if the defendant does not wish to dispute the charge set out in the violation ticket, or

a) the minimum fine set for the offence charged,

b) any other additional fine or money penalty re- quired to be imposed under

an Act,

c) the surcharge under the Victims Services Act , if any is payable, and

16.9(7) When the defendant does not appear in court at the time and place fixed for trial, the judge shall examine the copy of the violation ticket and, if the copy contains the certificate referred to in paragraph 16.3(1)(j), the judge shall, subject to subsection (9), convict the defend- ant and impose a fine in the amount of the fixed penalty set out in the violation ticket. 16.9(7) Le défendeur n’ayant pas comparu en cour aux date, heure et lieu fixés pour son procès, le juge examine la copie du billet de violation et, si elle contient le certi- ficat visé à l’alinéa 16.3(1)j), sous réserve du paragra- phe (9), il le déclare coupable et lui inflige une amende au montant égal à la pénalité prévue indiquée au billet de violation. 16.9(8) When the defendant appears in court at the time and place for trial, the proceedings shall be dis- posed of as though an information has been laid and a summons has been issued and served. 16.9(8) Le défendeur ayant comparu en cour aux date, heure et lieu fixés pour son procès, l’instance est jugée comme si une dénonciation avait été déposée et une sommation avait été délivrée et signifiée. 16.9(9) The judge shall not convict the defendant if 16.9(9) Le juge ne peut déclarer le défendeur coupa- ble dans ni l’un ni l’autre des cas suivants : (

a) the judge has reason to believe that the certifi- cate on the violation ticket is inaccurate, or

section 16.92, when the defendant has not paid the fixed penalty and does not file a notice of dispute within the period prescribed under

16.92(2) If a ticket reviewer determines that the condi- tions referred to in subsection (1) have been fulfilled, the ticket reviewer shall endorse in the record of disposition in prescribed form the fact that the conditions are fulfil- led, and forward the record of disposition to the defend- ant. 16.92(2) S’il détermine que l’ensemble des conditions énumérées au paragraphe (1) ont été remplies, l’exami- nateur de billets en porte mention sur le procès-verbal établi au moyen de la formule prescrite, lequel est trans- mis au défendeur. 16.92(3) If a ticket reviewer determines that one or more of the conditions referred to in subsection (1) have not been fulfilled, the ticket reviewer shall cancel the vi- olation ticket and, when cancelled, the conviction to which the offence relates is deemed not to have taken place. 16.92(3) S’il détermine que l’une quelconque des con- ditions énumérées au paragraphe (1) n’a pas été remplie, l’examinateur de billets annule le billet de violation, au- quel cas la condamnation est réputée n’avoir jamais été prononcée. 3

Section 19 of the Act is amended 3 L’article 19 de la Loi est modifié (

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 19(1) When the official language in which the pro- ceedings are to be conducted is not the official language in which the information has been sworn or the notice of prosecution or violation ticket completed, the judge shall inform the defendant that if the defendant so chooses a translation of the information, notice of prosecution or violation ticket by an Official Translator under the Offi- cial Languages Act will be provided. 19(1) Lorsque la langue officielle dans laquelle l’ins- tance se déroulera n’est pas celle dans laquelle la dénon- ciation a été assermentée ou l’avis de poursuite ou le billet de violation rempli, le juge doit informer le défen- deur que si tel est son choix, une traduction de la dénon- ciation, de l’avis de poursuite ou du billet de violation préparée par un traducteur officiel en vertu de la
