chapter P-5.1 of the Acts of New Brunswick, 1987, is amended by adding after

section the following: 1 La

Loi sur les prestations de pension, chapi- tre P-5.1 des Lois du Nouveau-Brunswick de 1987, est modifiée par l’adjonction de ce qui suit après l’article 93 : 93.01(1) With the approval of the Lieutenant- Governor in Council, the Minister may enter into an agreement with an authorized representative of a desig- nated jurisdiction in relation to a pension plan that is re- quired to be registered in the designated jurisdiction. 93.01(1) Avec l’approbation du lieutenant-gouverneur en conseil, le Ministre peut conclure avec le représentant autorisé d’une autorité législative désignée une entente relative à un régime de pension devant y être enregistré. 93.01(2) An agreement entered into under subsection (1) shall provide for the administration, application and enforcement of pension benefits legislation with respect to the pension plan that is the subject of the agreement. 93.01(2) L’entente conclue en vertu du paragraphe (1) prévoit l’administration, l’application et l’exécution de la législation sur les prestations de pension relativement au régime de pension objet de l’entente. 93.01(3) Without limiting the generality of subsection (1), an agreement may 93.01(3) Sans qu’il soit porté atteinte à la généralité du paragraphe (1), l’entente peut : (

a) make the pension benefits legislation of the des- ignated jurisdiction or any provision of that legislation inapplicable to the pension plan,

b) authorize the application of this Act and the reg- ulations or a provision of either of them to the pension plan, and

b) autoriser l’application, au régime de pension, de la présente loi et de ses règlements ou de l’une quel- conque de leurs dispositions; 1 (

c) delegate to the Minister the functions and pow- ers of the pension supervisory authority under the pension benefits legislation of the designated jurisdic- tion.

c) déléguer au Ministre les pouvoirs et les fonctions dont jouit l’organisme de surveillance en vertu de la législation sur les prestations de pension de cette auto- rité législative désignée. 93.01(4) The Minister may sub-delegate in writing any functions and powers delegated to the Minister in an agreement under subsection (1) to the Financial and Consumer Services Commission or the Superintendent, subject to any limitation or condition set out in the sub- delegation. 93.01(4) Le Ministre peut sous-déléguer par écrit à la Commission des services financiers et des services aux consommateurs ou au surintendant toutes fonctions ou tous pouvoirs que lui délègue l’entente visée au paragra- phe (1), sous réserve de toute restriction ou condition in- diquée dans la sous-délégation.
