Definitions

1 The following

definitions apply in this regulation.

"authority" means the Portage la Prairie Regional Landfill Authority established as an authority in

section 2. (« office »)

"board" means the board of the authority. (« conseil d'administration »)

Portage la Prairie Regional Landfill Authority established

2 The "Portage la Prairie Regional Landfill Authority" is hereby established as a regional waste management authority under The Regional Waste Management Authorities Act .

2 La Portage la Prairie Regional Landfill Authority est constituée à

titre d'office régional de gestion des déchets sous le régime de la

Loi sur les offices régionaux de gestion des déchets .

Members

3 The members of the authority are

(

a) the City of Portage la Prairie; and

(

b) the Rural Municipality of Portage la Prairie.

a) la ville de Portage-la-Prairie;

b) la municipalité rurale de Portage-la-Prairie.

Appointments to board and length of term

4(1) The board is to be comprised of a total of six members, appointed as follows:

(

a) three members to be appointed by resolution of the City of Portage la Prairie, all of whom must be members of its council;

(

b) three members to be appointed by resolution of the Rural Municipality of Portage la Prairie, all of whom must be members of its council.

4(1) Le conseil d'administration est constitué de six membres nommés de la façon suivante :

a) la ville de Portage-la-Prairie nomme, par résolution, trois membres parmi ceux de son conseil;

b) la municipalité rurale de Portage-la-Prairie nomme, par résolution, trois membres parmi ceux de son conseil.

4(2) Each member of the board is to be appointed for a one-year term and a member is eligible for re-appointment.

4(2) Chaque membre du conseil d'administration est nommé pour une période d'un an et peut recevoir un nouveau mandat.

Waste site location

5 The authority is to operate a waste site on land with the legal description as follows:

SW ¼ 22-13-5 WPM.

5 L'office administre un site de déchets sur le bien-fonds dont la description officielle est la suivante :

Service area

6 The authority's service area is

(

a) the area of the City of Portage la Prairie;

(

b) the area of the Rural Municipality of Portage la Prairie; and

(

c) any other area designated by the board.

Fees for each classification of waste

7 The board may establish classifications of waste. At the end of each calendar year, the board must set a fee

schedule for the following year for each classification of waste. For the initial year, the fees are to be as set out in the scheme submitted to the minister.

Droits — catégories de déchets

7 Le conseil d'administration peut établir des catégories de déchets. À la fin de chaque année civile, il établit pour l'année suivante un tarif de droits pour chaque catégorie de déchets. Pour la première année, les droits sont établis dans le programme présenté au ministre.

Coming into force

8 This regulation comes into force on January 1, 2005.

8 Le présent règlement entre en vigueur le 1 er janvier 2005.
