Loi sur les valeurs mobilières Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1 Subsection 1(1) of the Securities Act,

chapter S- 5.5 of the Acts of New Brunswick, 2004, is amended in the definition “market participant” by repealing paragraph (

h) and substituting the following: 1 Le paragraphe 1 (1) de la

Loi sur les valeurs mobi- lières,

chapitre S-5.5 des Lois du Nouveau-Brunswick de 2004, est modifié à la définition « participant au mar- ché », par l’abrogation de l’alinéa h ) et son remplace- ment par ce qui suit : (

h) the compensation or contingency fund of a self- regulatory organization,

h) le fonds d’indemnisation ou de prévoyance d’un organisme d’autoréglementation; 2

Section 161.9 of the Act is amended L’article 161.9 de la Loi est modifié (

a) by renumbering the

section as subsection 161.9(1);

a) par la renumérotation de l’article qui devient le paragraphe 161.9(1); (

b) by adding after subsection (1) the following:

b) par l’adjonction de ce qui suit après le paragra- phe (1) : 161.9(2) A limitation period established by subsection (1) in respect of an action is suspended when an application for leave under

section 161.41 is filed with the court, and resumes running when 161.9(2) Tout délai de prescription qu’impartit le para- graphe (1) à l’égard d'une action est suspendu dès le jour où est déposée la demande de permission d’intenter l’ac- tion en vertu de l'article 161.41 et recommence à courir dès que survient l’un ou l’autre des cas suivants : (

a) the court grants leave or dismisses the application, and

i) all appeals have been exhausted, or (

b) the application is abandoned or discontinued.

b) by adding after paragraph (ss.1) the following:

b) of the Act is amended by striking out “the Canadian Investor Protection Fund” and sub- stituting “the compensation or contingency fund of a self- regulatory organization”. 5 L’alinéa 204b) de la Loi est modifié par la suppres- sion de « le Fonds canadien de protection des épar- gnants » et son remplacement par « le fonds d’indemni- sation ou de prévoyance d’un organisme d’autoréglementation ».
