Loi sur la prescription His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative du Nouveau-Brunswick, édicte : 1

Section 14.1 of the Limitation of Actions Act, chap ‐ ter L-8.5 of the Acts of New Brunswick, 2009, is amended L’article 14.1 de la

Loi sur la prescription, chapi ‐ tre L-8.5 des Lois du Nouveau-Brunswick de 2009, est modifié (

a) by renumbering the

section as subsection 14.1(1);

a) par la renumérotation de l’article, lequel de ‐ vient le paragraphe 14.1(1); (

b) by repealing subsection (1) and substituting the following:

b) par l’abrogation du paragraphe (1) et son rem ‐ placement par ce qui suit : 14.1(1) There is no limitation period in respect of a claim for damages for trespass to the person, assault or battery if 14.1(1) Aucun délai de prescription n’est prévu dans le cas d’une réclamation en dommages-intérêts pour at ‐ teinte directe, voie de fait ou batterie si, selon le cas : (

a) the act complained of is of a sexual nature, or

a) l’acte reproché est de nature sexuelle; (

b) at the time of the act complained of, the claim ‐ ant was in an intimate personal relationship, as de ‐ fined in the Intimate Partner Violence Intervention Act, with the defendant or was financially, emotion ‐ ally or physically dependent on the defendant.

c) par l’adjonction de ce qui suit après le paragra ‐ phe (1) : 1 14.1(2) Subsection (1) applies to a claim for trespass to the person, assault or battery that occurred before or after the commencement of this

section and regardless of the expiry of any previously applicable limitation period under this Act or a former version of this Act. 14.1(2) Le paragraphe (1) s’applique aux réclamations qui concernent les atteintes directes, les voies de fait ou les batteries ayant eu lieu avant ou après l’entrée en vi ‐ gueur du présent article, sans égard à l’expiration de tout délai de prescription antérieurement applicable imparti par la présente loi ou une version antérieure de celle-ci. 14.1(3) Subsection (1) revives the right to file a claim of a claimant who prior to the commencement of this

section had a proceeding dismissed solely on the grounds that a previously applicable limitation period under this Act or a former version of this Act had ex ‐ pired. 14.1(3) Le paragraphe (1) fait renaître le droit de pré ‐ senter une réclamation de tout réclamant dont l’instance introduite avant l’entrée en vigueur de la présente loi avait été rejetée pour le seul motif qu’était expiré un dé ‐ lai de prescription antérieurement applicable imparti par la présente loi ou une version antérieure de celle-ci. 14.1(4) This

section does not apply in the case of a claim 14.1(4) Le présent

article ne s’applique pas dans le cas d’une réclamation qui, selon le cas : (

a) that has been settled and for which the settle ‐ ment is legally binding, including a claim that formed part of a class action that has been settled, regardless of whether the claim was submitted as part of the class action, or

a) a été réglée et dont le règlement à l’amiable est juridiquement contraignant, notamment celle faisant

partie d’un recours collectif qui a été réglé, que la ré ‐ clamation ait été soumise ou non dans le cadre du re ‐ cours collectif; (

b) that has been dismissed by a court and with re ‐ spect to which no further appeal is possible, subject to subsection (3).
