Statute: Off-highway Vehicles Act Public Service Act

OIC Text: The Governor in Council on the report and recommendation of the President of the Executive Council dated May 10, 2006, and pursuant to

Section 4 of

Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act, and clause 2(

b) of

Chapter 323 of the Revised Statutes of Nova Scotia, 1989, the Off-highway Vehicles Act, is pleased to assign responsibility for the following aspects of the Off-highway Vehicles Act to the following members of the Executive Council and, for administrative purposes, the following departments, effective on and after April 1, 2006: (

a) matters relating to the registration and permitting of off-highway vehicles, off-highway vehicle dealers and off-highway vehicle liability insurance, to the Minister of Service Nova Scotia and Municipal Relations and the Department of Service Nova Scotia and Municipal Relations; (

b) matters relating to safety equipment, clothing and training, age restrictions, closed courses and safe vehicle operation, to the Minister of Health Promotion and Protection and the Department of Health Promotion and Protection; (

c) matters relating to the operation of off-highway vehicles on or near highways, emergency operations, vehicle lamps and vehicle noise levels, to the Minister of Transportation and Public Works and the Department of Transportation and Public Works; (

d) matters relating to drinking-water supply areas, the designation and definition of sensitive areas and the issuance of licences for sensitive areas, to the Minister of Environment and Labour and the Department of Environment and Labour; (

e) all other matters relating to off-highway vehicles which have previously been assigned to any member of the Executive Council by or under the Public Service Act or any other Act of the Legislature, to the Minister of Natural Resources and the Department of Natural Resources.
