Local Authorities Election Act

LOCAL AUTHORITIES ELECTION FORMS REGULATION

Filed: November 16, 2000

Made by the Minister of Municipal Affairs (M.O. L:247/00) on November 2,

2000 pursuant to

section 160(2)(

a) of the Local Authorities Election Act.

Forms

the Local Authorities Election Act.

(2) The forms set out in

Schedule 2 are the French forms for use under the

Local Authorities Election Act.

(3) The forms set out in Schedules 2 and 3 are the forms for use under

the Local Authorities Election Act for the election of members of a

Regional authority as defined in the School Act.

Section 155 of MGA - bylaw

2 If a council has passed a bylaw under

section 155 of the Municipal

Government Act, the title directed by council for "councillor" or "chief

elected official" is the title that may, in the local jurisdiction, replace

councillor or chief elected official on the forms in the Schedules.

Repeal

3 The Forms Regulation (AR 272/91) is repealed.

Expiry

4 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be repassed in

its present or an amended form following a review, this Regulation expires

on October 31, 2003.

BALLOT FOR A VOTE ON A BYLAW OR QUESTION

The wording on a ballot for a vote on a bylaw or question must be

determined by a resolution of the elected authority. The form of the

ballot may be determined by a resolution of the elected authority, however

if no resolution is passed, the returning officer must determine the form.

ARRANGING THE NAMES ON THE BALLOTS

The names of the candidates on each ballot must be arranged

alphabetically in order of the surnames and, if 2 or more candidates have

the same surname, the names of those candidates must be arranged

alphabetically in order of their given names.

If an elected authority passes a bylaw 2 months before an election

that provides that ballots be printed in as many lots as there are

candidates for the office,

section 43(3) of the Local Authorities Election

Act applies.

INDICATING THE NUMBER OF CANDIDATES THAT CAN BE VOTED FOR

Every ballot used in an election for a member of an elected authority

must contain a brief explanatory note stating the maximum number of

candidates that can be voted for in order not to make the ballot void, and

every ballot used in an election for chief elected official must contain a

brief explanatory note stating that the ballot shall not be marked for more

than one (1) candidate.

FORM 7 INSTRUCTIONS FOR ELECTORS

Mark each ballot by placing an "X" in the space provided on the

right hand side opposite the name of the candidate(

s) of your choice. The

ballot indicates the maximum number of candidates that can be voted for.

You may vote for less than the maximum number, but not for more.

1(1) In this Regulation,

(a) "Act" means the Municipal Government Act;

(b) "appeal" means an appeal under

section 488(1)(

c) of the Act;

(c) "complaint" means a complaint made under

Part 11 of the Act;

(d) "issue statement" means the document referred to in

section

3(2);

(e) "statement of issues heard" means the list referred to in

section 6(2)(g).

(2) A word that is defined in Parts 9 to 12 of the Act has the same

meaning when used in this Regulation.

PART 1

PROCEDURE AND EVIDENCE

Application

2(1) Subject to subsections (2) and (3) and

section 9, this Part does not

apply to

(

a) a complaint or appeal concerning

(

i) a farm land assessment class of property,

(ii) a single family residential property in the

residential assessment class of property, if the complaint or appeal

(

A) relates to not more than 4 tax roll

numbers of single family residential properties filed collectively by one

assessed person or one agent of an assessed person, and

(

B) will be heard as one hearing by an

assessment review board or the Municipal Government Board,

(iii) a local improvement tax,

(iv) a special tax,

(

v) a well drilling equipment tax, or

(vi) an issue that is solely procedural in nature,

including, without limitation, an issue concerning jurisdiction or

abridgement or enlargement of time,

and

(

b) a complaint where the only issue is the assessment value

(

i) in respect of a total property assessment of $250

000 or less, or

(ii) in respect of a total business assessment of $50

000 or less.

(2) Notwithstanding subsection (1), the requirements of

section 3(2) apply

to a complaint in respect of any non-residential property that has an

assessment value of $250 000 or less, and the complainant must file the

issue statement with the clerk of the assessment review board and the

assessor of the municipality at least 7 days before the hearing of the

complaint.

(3) Notwithstanding subsection (1), the complainant and respondent must,

within a reasonable time before the hearing date of the complaint, disclose

to each other and the assessment review board the nature of the evidence

that the person intends to present, in sufficient detail to allow the other

person to respond to the evidence at the hearing.

Documents to be filed by complainant

3(1) If a complaint is to be heard by an assessment review board, the

complainant must

(

a) file the complaint in accordance with the Act,

(

b) pay the appropriate complaint fee at the time the complaint is

filed, if, in accordance with

section 481 of the Act, a fee is required by

the council, and

(

c) file an issue statement with the clerk of the assessment review

board and with the assessor of the municipality at least 21 days before the

hearing date of the complaint.

(2) An issue statement must be in the form set by the municipality and

must

(

a) be in writing,

(

b) set out in detail the grounds of complaint, the particular

facts supporting each ground of complaint and the change to the assessment

roll or tax roll that is requested by the complainant,

(

c) include a statement that the complainant and the respondent

have discussed the complaint, specifying the date and outcome of that

discussion, including the details of any facts or issues agreed to by the

parties,

(

d) include a statement, if the complainant and the respondent have

not discussed the complaint, specifying why no discussion was held, and

(

e) estimate the amount of time the complainant needs to present

evidence in support of the complaint to the assessment review board.

(3) If the clerk of the assessment review board sends a notice of hearing

to a complainant on a date that is less than 45 days before the hearing

date, the complainant is not required to comply with subsection (1)(c).

(4) Subject to subsection (3), if a complainant does not comply with

subsection (1), the complaint is invalid and the assessment review board

must not hear the matter and the clerk of the assessment review board must

so notify the complainant.

(5) If a complainant who files an issue statement does not comply with

subsection (2), the clerk of the assessment review board may refuse to file

the issue statement.

(6) A complainant may appeal a refusal under subsection (5) to an

assessment review board within 14 days of being notified of the refusal.

Disclosure of evidence

4(1) The complainant must at least 21 days before the hearing date of the

complaint disclose to the respondent and the assessment review board the

documentary evidence, a

summary of the testimonial evidence and any written

argument that the complainant intends to present at the hearing.

(2) The respondent must at least 7 days before the hearing date of the

complaint disclose to the complainant and the assessment review board the

documentary evidence, a

summary of the testimonial evidence and any written

argument that the respondent intends to present at the hearing.

(3) The complainant must at least 3 days before the hearing date of the

complaint disclose to the respondent and the assessment review board the

documentary evidence, a

summary of the testimonial evidence and any written

argument that the complainant intends to present at the hearing in rebuttal

to the disclosure made under subsection (2).

(4) If the clerk of the assessment review board sends a notice of hearing

to a complainant on a date that is less than 45 days before the hearing

date, the complainant and the respondent are not required to comply with

subsections (1) to (3) but must instead, within a reasonable time before

the hearing date, disclose to each other and the assessment review board

the nature of the evidence that the person intends to present, in

sufficient detail to allow the other person to respond to the evidence at

the hearing.

Failure to disclose

5 The assessment review board shall not hear any evidence that has not

been disclosed in accordance with

section 4.

Record

6(1) An assessment review board must make and keep a record of each

hearing in accordance with subsection (2).

(2) A record of a hearing must include

(

a) the complaint,

(

b) the issue statement,

(

c) all documentary evidence filed in the matter,

(

d) a list of witnesses who give evidence at the hearing,

(

e) a

summary of all testimonial evidence given at the hearing,

(

f) all written arguments presented at the hearing,

(

g) a written list that is prepared at the end of the hearing that

identifies those issues from the issue statement about which evidence was

given or argument was made at the hearing, and

(

h) any written reasons for the decisions of the assessment review

board.

(3) The assessment review board must provide to the Municipal Government

Board the record of a hearing within 14 days of being notified by the

Municipal Government Board that an appeal has been filed in the matter.

(4) If the evidence given at a hearing is recorded by means of a

sound-recording machine, a party to the hearing may request a copy of the

sound-recording or the transcript of the sound-recording, if the party

pays for the cost of preparing the copy or transcript.

Personal attendance not required

7(1) Parties to a hearing before an assessment review board may attend the

hearing in person or may, instead of attending in person, file a written

presentation with the clerk of the assessment review board.

(2) A party who files a written presentation under subsection (1) must,

subject to the disclosure of information required under

section 4, provide

a copy of it before the hearing to the other parties.

New issues on appeal

8(1) Unless all parties to an appeal consent, the Municipal Government

Board shall not, in an appeal, hear and decide an issue that is not

disclosed in that matter's statement of issues heard.

(2) Notwithstanding subsection (1), the Municipal Government Board may on

its own initiative hear and decide an issue that is not disclosed in that

matter's statement of issues heard if, in the opinion of the Municipal

Government Board, it is necessary for determining a question of law or a

question of jurisdiction.

(3) The Municipal Government Board must allow a reasonable amount of time

for the parties to prepare to address any new issues to be heard in an

appeal under this section.

New evidence on appeal

9(1) Unless all parties to an appeal consent, the Municipal Government

Board shall not, in an appeal, hear any evidence that was not heard by the

assessment review board.

(2) Notwithstanding subsection (1), the Municipal Government Board

(

a) must, in an appeal, hear evidence that was not heard by the

assessment review board if

(

i) the evidence is disclosed by the party raising it

to the other party and the Municipal Government Board at least 30 days

before the appeal is heard,

(ii) any related evidence is disclosed by the other

party to the party that made the disclosure under subclause (

i) and to the

Municipal Government Board at least 14 days before the appeal is heard, and

(iii) any evidence in rebuttal to the disclosure made

under subclause (ii) is disclosed by the party that made the disclosure

under subclause (

i) to the other party and to the Municipal Government

Board at least 7 days before the appeal is heard,

and

(

b) may on appeal hear any evidence necessary to decide an issue

before it.

Abridgement or expansion of time

10(1) An assessment review board may at any time, by written order,

abridge or expand the time specified in sections 3(1)(

c) and 4(1), (2) and

(3) for the doing of anything described in those sections in respect of a

complaint.

(2) The Municipal Government Board may, by written order, abridge or

expand the time specified in

section 9(2) for the doing of anything

described by that

section in respect of an appeal.

PART 2

HEARING BY CONSENT BY

MUNICIPAL GOVERNMENT BOARD

MGB hearing by consent

11 In any matter to which

Part 1 applies, the Municipal Government Board,

instead of an assessment review board, may hear and decide at first

instance any complaint or supplementary complaint if

(

a) the parties to the complaint or supplementary complaint consent

to a hearing by the Municipal Government Board, and

(

b) the assessment review board, on application by the parties to

the complaint or supplementary complaint,

(

i) is satisfied that the complaint or supplementary

complaint should be heard by the Municipal Government Board due to time

considerations, the complexity of the issues or other compelling reasons,

and

(ii) directs that the complaint or supplementary

complaint be heard by the Municipal Government Board.

PART 3

ONE-MEMBER ASSESSMENT REVIEW BOARD

AND MUNICIPAL GOVERNMENT

BOARD PANEL

One-member ARB

12(1) Pursuant to

section 454(2.1) of the Act, a council may appoint an

assessment review board consisting of only one member.

(2) A one member assessment review board may hear a complaint on and

decide one or more of the following matters:

(

a) a procedural matter, including, without limitation, the

scheduling of a hearing, the granting or refusal of an adjournment and an

issue involving disclosure of evidence;

(

b) a decision under

section 467(1)(

a) of the Act;

(

c) a decision concerning the filing of an issue statement, where

the clerk of the assessment review board has refused filing under

Part 1;

(

d) a hearing related to a class or subclass of a property that has

an assessed value of $250 000 or less;

(

e) a hearing related to a business tax where the business

assessment is $50 000 or less;

(

f) a hearing related to a farm land property assessment;

(

g) any matter where all parties have consented to a hearing before

a one-member assessment review board.

One-member MGB panel

13 Pursuant to

section 527.1(1) of the Act, one member of the Municipal

Government Board may sit as a panel of the Board to hear an appeal on and

decide one or more of the following matters:

(

a) a procedural matter, including, without limitation, the

scheduling of a hearing or an appeal, an application to abridge or expand

time, the granting or refusal of an adjournment, the awarding of costs and

an issue involving disclosure of evidence;

(

b) a decision under

section 499(1)(

a) of the Act;

(

c) an assessment complaint or appeal related to a property that

has an assessed value of $250 000 or less;

(

d) an appeal related to a farm land property assessment;

(

e) an appeal related to a business tax where the business

assessment is $50 000 or less;

(

f) any matter where all parties have consented to a hearing or

appeal before a one-member panel.

PART 4

TRANSITIONAL PROVISIONS, REPEALS,

EXPIRY AND COMING INTO FORCE

Transitional matters

14(1) Despite the repeal of the Assessment Complaints and Appeals

Regulation (AR 55/99) and the One-Member Assessment Review Board and

Municipal Government Board Panel Regulation (AR 56/99), those Regulations

continue to apply to all appeals and complaints filed in the year 2000.

(2) This Regulation applies to appeals and complaints filed on or after

January 1, 2001.

Repeals

15 The following regulations are repealed:

(

a) Assessment Complaints and Appeals Regulation (AR 55/99);

(

b) One-Member Assessment Review Board and Municipal Government

Board Panel Regulation (AR 56/99).

Expiry

16 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be repassed in

its present or an amended form following a review, this Regulation expires

on January 31, 2006.

Coming into force

17 This Regulation comes into force on January 1, 2001.

Alberta Regulation 239/2000

Electric Utilities Act

DIRECT SALES AMENDMENT REGULATION

Made by the Lieutenant Governor in Council (O.C. 457/2000) on November 28,

2000 pursuant to

section 72 of the Electric Utilities Act.

1 The Direct Sales Regulation (AR 180/99) is amended by this Regulation.

Section 1 is amended

(

a) by repealing clause (b);

(

b) by repealing clause (

c) and substituting the following:

(c) "direct sales agreement" means an agreement

relating to the sale or provision of electric energy in accordance with the

terms agreed to by the parties to the agreement, but does not include a

forward contract;

(

c) by repealing clause (

e) and substituting the following:

(e) "eligible direct seller" means a person that sells

or provides electric energy under a direct sales agreement and is approved

by the Power Pool Council pursuant to

section 6 as an eligible direct

seller;

(e.1) "forward contract" means an agreement relating to

the sale or provision of electric energy

(

i) that is capable of being traded on a

forward exchange, and

(ii) that provides for the future delivery

of electric energy;

(e.2) "forward exchange" means an organization that is in

the business of buying and selling forward contracts;

(

d) by repealing clause (f);

(

e) by repealing clause (g).

Section 2 is repealed and the following is substituted:

Conditions precedent to entering into a direct sales agreement

2 An eligible direct seller and an eligible direct buyer may enter

into a direct sales agreement if

(

a) the eligible direct seller and the eligible direct

buyer are power pool participants in accordance with the rules of the power

pool,

(

b) the scheduling and dispatch of electric energy sold

or provided under the direct sales agreement is controlled by the system

controller, and

(

c) the direct sales agreement is, by its terms,

expressly subject to the rules of the power pool including the rules

established under

section 9(a).

Section 4 is repealed.

5 The following is added after

section 5:

Notice to system controller re forward contract

5.1(1) When the electric energy referred to in a forward contract is

to be dispatched by the system controller, the system controller must be

provided with the following information:

(

a) the amount of electric energy to be sold or

provided under the agreement;

(

b) the dates and times at which electric energy is to

be sold or provided under the agreement;

(

c) any other information that is required by the rules

of the power pool to be provided to the system controller in order to

ensure safe, reliable and economic operation of, and dispatch of electric

energy on, the interconnected system.

(2) The information referred to in subsection (1) must be provided

in accordance with the rules established under

section 9(c).

Section 6 is amended

(

a) by renumbering it as

section 6(1);

(

b) by adding the following after subsection (1):

(2) The Power Pool Council may approve a person as an eligible

direct seller if the person is capable of responding to a dispatch from the

system controller in a manner satisfactory to the Power Pool Council.

Section 7 is repealed and the following is substituted:

7(1) Notwithstanding

section 13(1)(

b) of the Act, financial

settlement for electric energy sold or provided under a direct sales

agreement or forward contract

(

a) may be carried out by the parties to the agreement

or contract or the persons authorized by the parties to do so, and

(

b) is to be carried out at the price or for the

consideration agreed to by the parties to the agreement or contract,

unless subsection (2) applies.

(2) Where the amount of electric energy actually sold or provided

under a direct sales agreement or forward contract varies from the amount

of electric energy agreed to be sold or provided under the agreement or

contract, financial settlement for the excess or shortfall of electric

energy is to be carried out in accordance with the rules established under

section 9(d).

Section 9(

c) is amended by striking out "section 5" and substituting

"section 5 or 5.1".

9 The following is added after

section 9:

Operation of s45.96(2) of Act suspended

9.1(1) Where the balancing pool administrator holds a power purchase

arrangement pursuant to

section 8(1) of the Power Purchase Arrangements

Regulation (AR 170/99), the balancing pool administrator may sell or

provide the electric energy to which the power purchase arrangement applies

(

a) under a direct sales agreement, or

(

b) under a forward contract.

(2) Where the balancing pool administrator sells or provides

electric energy in accordance with subsection (1), the operation of

section

45.96(2) of the Act is suspended in respect of determining the price of

that electric energy.

1 In this Regulation,

(a) "deferral account" includes a rate rider;

(b) "distribution tariff" means a tariff prepared pursuant to the

Distribution Tariff Regulation (AR 84/2000);

(c) "regulated rate tariff" means a tariff prepared pursuant to the

Regulated Rate Option Regulation (AR 45/2000).

Prohibition on collection

2 In 2001, the owner of an electric distribution system must not collect

under its distribution tariff or regulated rate tariff any amount in

respect of its deferral accounts.

Board review

3(1) In 2002, the owner of an electric distribution system must apply to

the Board for a review by the Board of its deferral accounts.

(2) The Board must carry out a review of the deferral accounts.

Interest for 2001

4(1) The Board must determine an amount that is payable in 2001 to the

owner of an electric distribution system from the balancing pool in respect

of interest accrued in 2001 on the amounts in the owner's deferral

accounts.

(2) The balancing pool administrator must pay the amount determined under

subsection (1) to the owner.

Approval of collection

5(1) After the completion of the review referred to in

section 3, a

regulatory authority may approve the collection by the owner of an electric

distribution system of any amount in respect of its deferral accounts

during the period from January 1, 2002 to December 31, 2004.

(2) In this section, "regulatory authority" means

(

a) in respect of a municipality or a subsidiary of a municipality

that owns an electric distribution system, the council of the municipality,

(

b) in respect of a rural electrification association, the board of

directors of the rural electrification association, or

(

c) in respect of any other owner of an electric distribution

system, the Board.

Expiry

6 This Regulation is made under

section 72(1) of the Electric Utilities

Act and is repealed in accordance with

section 72(2) of that Act.

Definitions

1 In this Regulation,

(a) "Act" means the Electric Utilities Act;

(b) "power pool administrator" means the person appointed under

section 9(1)(

b) of the Act.

Pool price

2 In determining and reporting the pool price under

section 11(

b) of the

Act, the power pool administrator must exclude the price of electric energy

entering or leaving the interconnected electric system.

Rules

3 The power pool administrator must establish

(

a) rules respecting the difference between

(

i) the pool price that results from the power pool

administrator carrying out the obligation under

section 2, and

(ii) the pool price that would result if

section 2 had

not come into force,

and

(

b) any other rules the power pool administrator considers

necessary to carry out the intent of this Regulation.

Suspension of sections of Act

4 The operation of sections 9(1)(

a) and (

d) and 13(1)(

b) of the Act is

suspended to the extent necessary to allow the power pool administrator to

carry out the obligations described in this Regulation.

Expiry

5 This Regulation is made under

section 72(1) of the Act and is repealed

on December 31, 2001.

Coming into force

6 This Regulation comes into force on December 15, 2000.

Alberta Regulation 242/2000

Forests Act

TIMBER MANAGEMENT AMENDMENT REGULATION

Made by the Lieutenant Governor in Council (O.C. 467/2000) on November 29,

2000 pursuant to sections 4 and 30 of the Forests Act.

1 The Timber Management Regulation (AR 60/73) is amended by this

Regulation.

Section 81(2)(

b) is amended by striking out "A03 to A13" and

substituting "A04 to A14".

3 The following is added after

section 89:

89.1 The general rate of timber dues for coniferous timber that is

used or will be used to make laminated veneer lumber is calculated in

accordance with

Schedule 7.

89.2(1) This

section sets out exceptions to the general rate of

timber dues for coniferous timber that is used or will be used to make

laminated veneer lumber.

(2) The timber dues are $0.70 per cubic metre of roundwood for

(

a) balsam fir, white bark pine, alpine fir and larch,

and

(

b) jack pine, hybrids of jack pine and hybrids of

lodgepole pine in forest management units A04 to A14, L01 to L09, L51 and

S07.

(3) The timber dues for a small stem log that has, after being

scaled in accordance with the Scaling Regulation (AR 403/92), an average

gross volume per metre of length that is less than or equal to 0.024 cubic

metres are the base rate.

(4) The timber dues for

(

a) a tree that is not merchantable as defined by the

harvesting ground rules that apply to the disposition, or

(

b) the portion of a log that is above the top diameter

of the utilization standard for the log

are $0.27 per cubic metre of roundwood.

(5) The exceptions to the general rates of timber dues set out in

subsections (2) to (4) apply only if the timber is scaled or measured to

the satisfaction of the Minister and is recorded and identified separately

to the satisfaction of the Minister.

(6) If the Minister is satisfied that a percentage of the timber in

an area has suffered significant damage due to fire, wind, insects or

disease, the timber dues for that percentage of timber harvested from the

area are $0.70 per cubic metre of roundwood.

(7) If the Minister is satisfied that in an area of 4 hectares or

more, 15% or more of the coniferous timber is dead or is damaged by

interior rot or other defects, the timber dues for that percentage of

timber harvested from the area are $0.70 per cubic metre of roundwood.

(8) If the Minster is satisfied that pine or spruce has been cut

from overstocked pine or spruce stands for the purpose of improving the

stand's yield at final harvest, the timber dues for the pine or spruce that

has been cut are $0.70 per cubic metre of roundwood.

(9) If the Minister is satisfied that timber has been cut to

perpetuate an unevenly aged stand of coniferous timber and reforestation is

required to return the stand to a fully stocked state at rotation age, the

timber dues for the timber cut are $1.40 per cubic metre of roundwood.

(10) If the Minister is satisfied that a percentage of coniferous

timber in an area is endangered by acts of nature or by development that is

not authorized under the Act, the timber dues for that percentage of timber

harvested from the area are $1.40 per cubic metre.

4 The following is added after

section 115:

115.1(1) A person who is or was required or permitted by this

Regulation to submit to the Minister any report, survey, statement or

information shall

(

a) keep all records that come into that person's

possession or the possession of any of that person's agents and that are,

were or could be used for preparing the report, survey, statement or

information for a period of 5 years, and

(

b) make any of the records referred to in clause (

a) available on request for the purpose of an audit or examination by

(

i) a forest officer,

(ii) the Minister, or

(iii) any other person authorized by the

Minister.

(2) If information submitted to the Minister by one or more persons

for the purposes of this Regulation is inconsistent with information

submitted to the Minister by any other person or persons for the purposes

of this Regulation, the Minister may disclose the information to any or all

of those persons to the extent the Minister considers necessary to resolve

the inconsistency.

Schedule 2 is amended by adding "115.1," after "114,".

6 The following is added after

SCHEDULE 7

General Rate of Timber Dues for

Coniferous Timber Used to Make

Laminated Veneer Lumber

1(1) The general rate of timber dues for coniferous timber that is used or

will be used to make laminated veneer lumber in a month in which the dues

determination activity occurs (in this

Schedule referred to as the "payment

month") is calculated as follows:

(

a) the producer of laminated veneer lumber (in this

Schedule

referred to as "the producer") shall report to the Minister by the 10th day

of the month following the payment month the average mill net selling

price, free-on-board at the mill, received by the producer in the payment

month for its sales of laminated veneer lumber, green veneer and dry

veneer;

(

b) the producer shall calculate the average mill net selling price

referred to in clause (

a) by

(

i) determining the producer's total revenue for the

payment month for laminated veneer lumber, green veneer and dry veneer,

adjusted to bring the revenues to a free-on-board basis by deducting any

shipping costs beyond the mill yard, but not deducting any discounts for

brokerage fees or early payments,

(ii) converting any laminated veneer lumber sales in the

payment month measured in cubic feet to thousands of square feet on a 3/8

inch basis by multiplying the cubic feet volume by .032 and determining a

total volume of laminated veneer lumber sales in thousands of square feet

on a 3/8 inch basis for the payment month,

(iii) determining the volume of green and dry veneer

sales in the payment month in thousands of square feet on a 3/8 inch basis,

(iv) dividing the total mill net revenues determined in

subclause (

i) by the sum of the laminated veneer lumber sales volumes

determined in subclause (ii) and green and dry veneer sales volume

determined in subclause (iii), and

(

v) where intra-corporate transfers or sales to

affiliates, associates and subsidiaries exceed 10% of the total value of

sales in the payment month, subtracting any intra-corporate transfers or

sales to affiliates from the calculation of the average mill net selling

price;

(

c) the producer shall report by the 10th day of the month

following the payment month the mill capacity utilization level;

(

d) the producer shall calculate the monthly mill capacity

utilization level referred to in clause (

c) by dividing the total number of

days, to the nearest whole day, the laminated veneer lumber mill operated

in the payment month, and dividing that number by the potential operating

days in the corresponding month in Table 1, and multiplying that result by

100;

(

e) subject to clause (f), the general rate of timber dues is the

amount shown in Table 2 at the intersection of the column corresponding to

the reported mill capacity utilization level and the row corresponding to

the monthly average mill net selling price for laminated veneer lumber and

veneers;

(

f) where the producer reports mill capacity levels greater than

80% in 3 consecutive months, the general rate of dues payable per cubic

metre of roundwood is the amount shown in the right-hand column (80+% mill

capacity level) for all subsequent months.

(2) For the purposes of subsection (1)(b)(v), "affiliate", "associate" and

"subsidiary" have the meanings given to them in the Business Corporations

Act.
