ACTIVITIES DESIGNATION AMENDMENT REGULATION

For information only: Made by the Minister of Environment and Parks (M.O.

84/2021) on December 9, 2021 pursuant to sections 85 and 89 of the Environmental

Protection and Enhancement Act.

1 The Activities Designation Regulation (AR 276/2003) is

amended by this Regulation.

Section 3(1) is amended by adding the following after

clause (c.2):

(c.3) "hydrovac facility" means a waste management facility that

accepts and treats hydrovac waste, or accepts hydrovac waste

for the purpose of reuse;

(c.4) "hydrovac waste" means solid material, liquid material, or

any combination of solid and liquid material, that has been

generated from a hydrovac process;

3 Division 1 of

Schedule 2 is amended by adding the

following after clause (f):

(

g) the construction, operation or reclamation of a hydrovac

facility that

(

i) accepts and treats not more than 50 000 tonnes of

hydrovac waste per year, or

(ii) accepts not more than 50 000 tonnes of hydrovac waste

per year for reuse.

AMENDMENT REGULATION

36/2021) on December 15, 2021 pursuant to

section 29 of the Peace Officer Act.

1 The Peace Officer (Ministerial) Regulation (AR 312/2006)

is amended by this Regulation.

Section 1 is amended by adding the following after (a):

(a.1) "law enforcement agency" means a police service, wildlife

officer or conservation service or other agency with

enforcement authority under an enactment of Alberta or

Canada;

Section 10(3) is amended by striking out "30 days" and

substituting "10 days".

Section 12(

b) is repealed.

Section 15(

f) is amended by striking out "police services"

and substituting "law enforcement agencies".

Section 17(1) and (2)(c), (

d) and (

e) are amended by

striking out "police service" wherever it occurs and

substituting "law enforcement agency".

Section 23 is amended by striking out "March 31, 2022"

and substituting "March 31, 2027".

Definition

1 In this Regulation,

(a) "Act" means the Labour Relations Code;

(b) "relevant fiscal year" means the fiscal year in respect of

which a trade union is required to provide a financial

statement under

section 24.1(1) of the Act.

Providing financial statements

2 A financial statement must be provided to each member

(

a) free of charge, and

(

b) in writing in a form that is

(

i) accessible by the member so as to be usable for

subsequent reference, and

(ii) capable of being retained by the member.

Requirements for financial statements

3(1) A financial statement must be

(

a) verified by a person with sufficient knowledge of the

financial affairs of the trade union as accurately disclosing

the financial condition and operation of the trade union for

the relevant fiscal year, and

(

b) signed by the person referred to in clause (a).

(2) The financial statement must include information with respect to

the assets, liabilities, income and expenditures of the trade union for

the relevant fiscal year.

Expiry

4 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be

repassed in its present or an amended form following a review, this

Regulation expires on February 28, 2026.

Coming into force

5 This Regulation comes into force on the coming into force of

section 11(7) of the Restoring Balance in Alberta's Workplaces Act,

Definition

1 In this Regulation,

(a) "Act" means the Police Officers Collective Bargaining Act;

(b) "relevant fiscal year" means the fiscal year in respect of

which a police association is required to provide a financial

statement under

section 40.1(1) of the Act.

Providing financial statements

2 A financial statement must be provided to each member

(

a) free of charge, and

(

b) in writing in a form that is

(

i) accessible by the member so as to be usable for

subsequent reference, and

(ii) capable of being retained by the member.

3(1) A financial statement must

(
