B.C. Reg. 318/2009 , deposited December 17, 2009, pursuant to the PUBLIC SECTOR PENSION PLANS ACT [Schedule A,

Section 13]. Regulation of the College Pension Board of Trustees, dated December 9, 2009.

The College Pension Board of Trustees orders that, effective December 9, 2009, the College Pension Plan Regulation, B.C. Reg. 95/2000, is amended as set out in the attached Schedule.

Schedule

Section 9 of the College Pension Plan Regulation, B.C. Reg. 95/2000, is amended

(

a) by adding the following subsection:

(2.1) If an active member applies to purchase enrollment arrears under subsection (2) but does not pay the amount required under subsection (4) at the time and in the manner specified by the plan administrative agent, the active member is ineligible to purchase those enrollment arrears unless he or she makes a further application under subsection (2) on or before the earlier of the dates referred to in subsection (2) (

a) and (b). ,

(

b) by repealing subsection (3), and

(

c) in subsection (4) by striking out " subsections (2) and (3) " and substituting " subsection (2) ".

Section 19 is amended

(

a) in subsection (2) by adding " who employed the member during the leave of absence " after " the employer ",

(

b) in subsection (5) (

b) by adding " with the employer with which the leave of absence occurred " after " employment ",

(

c) by adding the following subsection:

(5.1) If an active member applies to purchase a leave of absence under

section 16 or 18 but does not pay the amount required under subsection (1) or (3) of this

section at the time and in the manner specified by the plan administrative agent, the active member is ineligible to purchase the leave of absence unless he or she makes a further application under

section 16 or 18 on or before the earlier of the dates referred to in subsection (5) (

a) and (

b) of this section. , and

(

d) by repealing subsection (6).

3 Sections 26, 27 and 28 are repealed.

Section 96 (1) is amended by repealing the definition of "Interplan Pension Transfer Agreement" .
