definitions apply in this Act. 1 Les définitions qui suivent s’appliquent à la présente loi. “best interests of the child” means the best interests of the child as determined in accordance with

section 50. (intérêt supérieur de l’enfant) “child”, except in Parts 3 and 4, means a person who has not attained the age of majority. (enfant) “child support guidelines” means the guidelines estab- lished by regulation for making child support orders. (lignes directrices sur les aliments pour enfant) “common-law partner” means a person who cohabits in a conjugal relationship with another person if the per- sons are not married to each other. (conjoint de fait) “contact order” means an order made under subsec- tion 57(1). (ordonnance de contact) “Court” means The Court of Queen’s Bench of New Brunswick and includes any judge of the Court. (Cour) “decision-making responsibility” means the responsi- bility for making significant decisions about a child’s well-being, including decisions in respect of (

a) health, (

b) education, (

c) culture, language, religion and spirituality, and (

d) significant extra-curricular activities. ( responsa- bilités décisionnelles) “dependant” means a person to whom another has an obligation to provide support under this Act. cluding negotiation, mediation and collaborative law. (processus de résolution des différends familiaux) “family member”, when used in reference to any per- son, includes (

a) a parent or grandparent of the person, (

b) a brother or sister of the person, (

c) a brother or sister of the person’s parent, (

d) a spouse or former spouse of the person, (

e) a common-law partner or former common-law partner of the person, (

f) a person with whom the person is a parent of one or more children, regardless of whether they have co- habited at any time, (

g) a person who is cohabiting with or who has co- habited with the person in a family relationship, and (

h) a spouse or common-law partner of any of the persons referred to in paragraphs (

a) to (c), while they are cohabiting. (membre de la famille) “family violence” means any conduct, whether or not the conduct constitutes a criminal offence, by a family member towards another family member, that is violent or threatening or that indicates a pattern of coercive and controlling behaviour or that causes that other family member to fear for their own safety or for that of another person, and, in the case of a child, the direct or indirect exposure to the conduct, and includes (

a) physical abuse, including forced confinement but excluding the use of reasonable force to protect themselves or another person, (

b) sexual abuse, (

c) threats to kill or cause bodily harm to any per- son, (

d) harassment, including stalking, (

e) the failure to provide the necessaries of life, (

f) psychological abuse, (

g) financial abuse,

h) threats to kill or harm an animal or damage property, and (

i) the killing or harming of an animal or the dam- aging of property. (violence familiale) “marital home” means property in which one or both spouses have an interest and that is or has been occupied as their family residence, and if property that includes a marital home is used for a purpose in addition to that of a family residence, the marital home is that portion of the property that may reasonably be regarded as neces- sary for the use and enjoyment of the family residence. (foyer matrimonial) “Minister” means the Minister of Justice and includes any person designated by the Minister to act on the Min- ister’s behalf. (ministre) “parent” includes a person who has demonstrated a settled intention to treat a child as a child of the person’s family, except when the person is a foster parent or kin- ship caregiver to that child under the Family Services Act. (parent) “parenting order” means an order made under subsec- tion 52(2). (ordonnance parentale) “parenting time” means the time that a child spends in the care of a parent or a person who stands in the place of a parent or who intends to stand in the place of a pa- rent, whether or not the child is physically with that per- son during that entire time. (temps parental) “spouse” means either of two persons who (

a) are married to each other, (

b) are married to each other by a marriage that is voidable and has not been voided by a declaration of nullity, or (

c) have gone through a form of marriage with each other in good faith that is void. (conjoint) “support order” means a child support order made un- der subsection 11(1) or a support order for a dependant who is not a child under subsection 17(1). S’entend de toute conduite, constituant une infraction criminelle ou non, d’un mem- bre de la famille envers un autre membre de la famille, qui est violente ou menaçante, qui dénote un comporte- ment systématiquement coercitif et dominant ou qui porte cet autre membre de la famille à craindre pour sa sécurité ou celle d’une autre personne – et du fait, pour un enfant, d’être exposé, même indirectement, à une telle conduite –, y compris :

a) la violence physique, notamment l’isolement for- cé, à l’exclusion de l’usage d’une force raisonnable pour se protéger ou protéger quelqu’un d’autre;

b) l’abus sexuel;

c) la menace de tuer quelqu’un ou de lui causer des lésions corporelles;

d) le harcèlement, y compris la traque;

e) le défaut de subvenir aux nécessités de la vie;

f) la violence psychologique;

g) l’exploitation financière;

h) la menace de tuer ou de blesser un animal ou d’endommager un bien;

i) le fait de tuer un animal, de lui causer des bles- sures ou d’endommager un bien. (family violence) Projet de loi 6

PARTIE 2 INSTANCES JUDICIAIRES Role of Minister of Social Development Rôle du ministre du Développement social 2 In any proceeding concerning the exercise of parent- ing time, decision-making responsibility or contact in re- spect of a child under this Act, the Court shall, if the Minister of Social Development is not a party to the pro- ceeding, advise the Minister of Social Development of the proceeding, in which case the Minister of Social De- velopment may intervene in the proceeding and may take whatever steps the Minister of Social Development considers necessary to ensure that the interests and con- cerns of the child are properly represented separate from those of any other person, including the appointment of a lawyer or a responsible spokesperson to assist in the rep- resentation of the interests and concerns of the child. 2 Dans toute instance relative à l’exercice du temps parental, des responsabilités décisionnelles ou des con- tacts à l’égard d’un enfant en application de la présente loi, si le ministre du Développement social n’est pas par- tie à l’instance, la Cour l’informe de celle-ci; il peut alors intervenir et prendre toute mesure qu’il estime né- cessaire pour que les intérêts et préoccupations de l’en- fant soient exposés convenablement et séparément de ceux de toute autre personne, y compris la nomination à cette fin d’un avocat ou d’un porte-parole responsable.

Admissibility of evidence taken at a previous proceeding Admissibilité de preuve recueillie dans une instance antérieure 3 In considering any application brought under this Act, on notice to the parties, the Court may allow to be read into the record as evidence, or, on notice of the na- ture of the evidence, may take into consideration without reading into the record, any evidence taken at any previ- ous proceeding, if 3 En considérant toute requête faite en application de la présente loi, la Cour, après en avoir avisé les parties, peut autoriser la lecture de toute preuve à verser au dos- sier recueillie dans une instance antérieure ou, après les avoir avisées de sa nature, peut la prendre en considéra- tion sans lecture si, à la fois, cette preuve : (

a) the evidence is informative in any way as to the psychological, social or physical development of the child, the child’s parent or any other person living with the child or in a close relationship with the child as to be in a position to influence the nature of the care and supervision exercised with respect to the child, and

a) an interim order made under this Act or under the Divorce Act (Canada), (

b) an order varying an order made under this Act or the Divorce Act (Canada), (

c) an agreement filed with the Court in accordance with

section 79, and (

d) an order made under an enactment of another province or territory of Canada respecting family law if the order has been registered under

section 18 of the « enfant » S’entend :

a) a person who has parenting time, decision- making responsibility or a pending application for a parenting order in respect of the child, or (

b) a person who has contact with the child under a contact order. j) any family violence and its impact on, among other things,
