WHEREAS the New Brunswick Association of Occupa ‐ tional Therapists prays that it be enacted as hereinafter set forth; que l’Association des ergothérapeutes du Nouveau- Brunswick a demandé l’adoption des dispositions ci- dessous; AND

WHEREAS it is desirable, in the interest of the public and the registrants of the New Brunswick Associ ‐ ation of Occupational Therapists, to continue the New Brunswick Association of Occupational Therapists as a body corporate for the purpose of advancing and main ‐ taining the standard of occupational therapy in the Prov ‐ ince, for governing and regulating occupational therapy practice and services provided to the public and for pro ‐ viding for the welfare of the public and registrants of the New Brunswick Association of Occupational Therapists; qu’il est souhaitable, et dans l’intérêt du public ainsi que des personnes inscrites à l’Association des ergothérapeu‐ tes du Nouveau-Brunswick, de proroger cette dernière en tant que personne morale en vue de promouvoir et de maintenir la qualité des services d’ergothérapie dans la province, de régir et de réglementer l’exercice de la pro ‐ fession et les services offerts au public dans ce domaine, et de veiller au bien-être du public et des personnes ins ‐ crites à l’Association des ergothérapeutes du Nouveau- Brunswick, THEREFORE, His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’As ‐ semblée législative du Nouveau-Brunswick, édicte : 1 This Act may be cited as the Occupational Thera ‐ pists Act, 2025. 1 La présente loi peut être citée sous le

PART 1

INTERPRETATION

PARTIE 1 INTERPRÉTATION 2 The following

definitions apply in this Act, unless the context otherwise requires. 2 Les définitions suivantes s’appliquent à la présente loi, sauf si le contexte exige une interprétation différente. 1

“Admissions Committee” means the Admissions Committee appointed under this Act. (Comité des admis‐ sions) “Association” means the New Brunswick Association of Occupational Therapists. (Association) “client” means a recipient of occupational therapy ser‐ vices and includes an individual, group or organization and includes a substitute decision-maker for the recipient or intended recipient of occupational therapy services. (client) “competence” means the ability to integrate and apply competencies in a designated role and practice setting. (compétence) “competencies” means the knowledge, skills and judgement required to practise safely and ethically. (champ de compétence) “complaint” means any allegation made, issue raised or information provided by any body corporate, any as ‐ sociation, the Registrar, the Council, the Executive Com‐ mittee or any other person regarding the conduct, ac ‐ tions, competence, character, fitness, health or ability of a present or former registrant or professional corpora ‐ tion, or of present or former employees of a registrant or professional corporation. (plainte) “conduct unbecoming the profession” means conduct in a registrant’s personal or private capacity that tends to bring discredit upon registrants or the occupational ther ‐ apy profession. (conduite indigne de la profession) “conflict of interest” means a conflict of interest re ‐ sulting from: (

a) the registrant being a member of a committee or other body of the Association, a health care facility or government agency having decision-making authority or acting in an advisory capacity with respect to mat ‐ ters that may benefit the registrant, directly or indi ‐ rectly, in the practice of occupational therapy of the registrant; (

b) the registrant receiving a financial or other bene‐ fit from the registrant’s direct or indirect ownership of an interest in a commercial enterprise that provides a product or service that may be prescribed or recom ‐ mended by the registrant for a client or in the regis ‐ trant’s practice of occupational therapy; « année de délivrance de permis » Période de 12 mois établie par le Conseil pour la durée d’un permis. partie du champ de pra ‐ tique de la profession d’ergothérapeute, et dont l’exercice a été approuvé par le Conseil pour les per ‐ sonnes inscrites ayant effectué des études approuvées à cette fin par le Conseil. (expanded scope of practice) « champ de pratique individuel » Services pour les ‐ quels la personne inscrite a été formée et autorisée et qu’elle est apte à fournir. (individual scope of practice) « client »

Toute personne qui reçoit des services d’er ‐ gothérapie, notamment un particulier, un groupe ou une organisation, y compris tout mandataire spécial du desti ‐ nataire ou du destinataire prévu de services d’ergothéra ‐ pie. (client) « Comité des admissions » Le Comité des admissions nommé en vertu de la présente loi. (Admissions Commit‐ tee) « Comité de déontologie » Le Comité de déontologie nommé en vertu de la présente loi. (Professional Con ‐ duct Committee) « comité statutaire »

c) the registrant receiving financial or other bene ‐ fit, directly or indirectly, in circumstances that may conflict with the registrant’s professional responsibili ‐ ties as a registrant or in the practice of occupational therapy of the registrant; or (

d) any other situation where an individual’s per ‐ sonal, professional or financial interest could compro ‐ mise decision-making in the public interest. ( conflit d’intérêt) “continuing-competence program” means a program approved by the Council that focuses on promoting and enhancing the competence of registrants throughout their careers. (programme de maintien de la compétence) “costs” includes (

a) expenses incurred by the Association for investi‐ gating and deciding a matter, (

b) costs of competence assessments, other assess ‐ ments, audits and examinations conducted by the As ‐ sociation in the course of addressing a matter, (

c) the Association’s solicitor and client costs, in ‐ cluding disbursements and goods and services tax, in ‐ cluding those of Association counsel and counsel for a committee, (

d) fees for retaining a court reporter and preparing transcripts, (

e) travel costs and reasonable expenses of a wit ‐ ness, including an expert witness, (

f) honoraria for committee members and travel costs and reasonable expenses of committee members, and (

g) such other costs as may be prescribed by the regulations or by-laws or as prescribed by Council from time to time. (frais) “Council” means the Council of the Association con ‐ stituted under

section 8. (Conseil) “Court” means The Court of King’s Bench of New Brunswick. (Cour) “electronic means” means the use of telephone, fac ‐ simile, television, video conferencing, cable, internet, in ‐ « conduite indigne de la profession » Toute conduite personnelle ou privée d’une personne inscrite qui tend à discréditer les personnes inscrites ou la profession d’er ‐ gothérapeute. (conduct unbecoming the profession) « conflit d’intérêt » Tout conflit d’intérêt qui découle, selon le cas :

titre consultatif à l’égard des questions dont la personne inscrite pourrait bénéficier, même indirec‐ tement, dans l’exercice des services d’ergothérapie de la personne inscrite;

b) d’une personne inscrite recevant un avantage fi ‐ nancier ou autre tiré des intérêts qu’elle possède, même indirectement, dans une entreprise commer ‐ ciale offrant un produit ou service pouvant être pres ‐ crit ou recommandé par lui à un client ou en sa qualité de personne inscrite autorisée à exercer l’ergothéra ‐ pie;

c) d’une personne inscrite recevant un avantage fi ‐ nancier ou autre, même indirectement, dans des cir ‐ constances pouvant entrer en conflit avec sa responsabilité professionnelle à

titre de personne ins ‐ crite ou en sa qualité de personne inscrite autorisée à exercer l’ergothérapie;

d) toute autre situation où les intérêts personnels, professionnels ou financiers pourraient compromettre la prise de décisions dans l’intérêt du public. ( conflict of interest) « conjoint » S’entend, selon le cas :

a) d’une personne qui est mariée à la personne ins ‐ crite selon la définition que donne de ce terme la

Loi sur le droit de la famille;

b) une personne qui vit avec la personne inscrite dans une union conjugale hors mariage de façon con ‐ tinue depuis au moins un an. (spouse) « Conseil » Le conseil de l’Association constitué en application de l’article 8. (Council) « Cour » La Cour du Banc du Roi du Nouveau- Brunswick. (Court)

tranet or other form of electronic or computerized com ‐ munication. (moyen électronique) “expanded scope of practice” means those services not presently in the scope of practice of a particular des ‐ ignation, but within the scope of practice of the occupa ‐ tional therapy profession, approved by the Council for practice by registrants who have completed education approved for that purpose by the Council. (champ de pratique élargi) “hearing” means a process before a Statutory Com ‐ mittee, other than the Complaints Committee, Admis ‐ sions Committee, or the Professional Conduct Commit ‐ tee, in which the parties may lead evidence, but does not include the consideration by the Professional Conduct Committee of a settlement agreement or an application for consent revocation. (audience) “incapacity” means the status whereby a registrant has or had a physical or mental condition or disorder that renders or rendered the registrant unable to practise with competence or that endangers or may have endangered the health or safety of clients, making it desirable in the interests of the public that the registrant no longer be permitted to practise or that their practise be restricted. (incapacité) “incompetence” means, in relation to a registrant, a lack of competence demonstrated in the registrant’s care of a client or delivery of occupational therapy services that, having regard to all the circumstances, rendered the registrant unsafe to practise at the time of such care of the client or delivery of occupational therapy services or that renders the registrant unsafe to continue in practice without remedial assistance. (incompétence) “individual scope of practice” means the services for which a registrant is educated, authorized and competent to perform. (champ de pratique individuel) “licence” means a licence issued under this Act to a registrant authorizing the registrant to engage in practice in accordance with the terms of the licence and includes a conditional licence and such other category of licence as may be set out in the regulations and by-laws. (per‐ mis) “licensing” means the process by which a person who has qualified for registration is assessed to determine whether the person meets the criteria for a licence under this Act, the regulations and the by-laws. (occupational therapist) « ergothérapie » Application des connaissances, des aptitudes et du jugement liés à l’ergothérapie afin d’opti ‐ miser le rendement occupationnel dans les domaines des soins personnels, de la productivité et des loisirs, ce qui peut comprendre, entre autres :

a) l’application et l’interprétation de procédures destinées à l’évaluation du fonctionnement occupa ‐ tionnel;

b) la planification, l’administration et l’évaluation de programmes de développement, de rétablissement, de maintien, de prévention et d’éducation;

c) le travail en éducation, en promotion de la santé, en consultation, en gestion et en recherche, ainsi que d’autres services d’ergothérapie. ( occupational thera‐ py) « faute professionnelle » Toute conduite ou tout acte ayant trait à l’exercice de l’ergothérapie qui, en fonction de l’ensemble des circonstances, serait raisonnablement jugé disgracieux, déshonorant ou non professionnel, no ‐ tamment :

a) le non-respect des normes de pratique;

b) l’omission de se conformer à la présente loi, aux règlements ou aux règlements administratifs;

c) l’omission d’adhérer aux codes de déontologie ou aux normes de pratique adoptés par l’Association;

d) une personne inscrite qui plaide coupable ou a été déclarée coupable d’une infraction qui affecte son aptitude à exercer la profession; Projet de loi 19 Loi relative à l’Association des ergothérapeutes du Nouveau-Brunswick 4

“licensing sanction” means: (

a) the imposition of conditions or restrictions on a licence by the Complaints Committee or the Profes ‐ sional Conduct Committee or an equivalent body from another jurisdiction but does not include condi ‐ tions or restrictions imposed through the interim proc ‐ ess set out in subsections 33(1) to (7) or through an informal resolution process under this Act; (

b) a consent reprimand ordered by the Complaints Committee or an equivalent body from another juris ‐ diction; (

c) a reprimand issued by the Professional Conduct Committee or an equivalent body from another juris ‐ diction; (

d) a fine ordered by the Professional Conduct Committee; (

e) a suspension of a licence by the Professional Conduct Committee or an equivalent body from an ‐ other jurisdiction; or (

f) a revocation of registration or licence by the Pro‐ fessional Conduct Committee or an equivalent body from another jurisdiction but does not include a cau ‐ tion. (sanction visant le permis) “licensing year” means the 12-month period estab ‐ lished by the Council for the term of a licence. (année de délivrance de permis) “Minister” means the Minister of Health. (Ministre) “occupational therapist” means a person who is duly authorized to practise occupational therapy under this Act and includes a professional corporation. (ergothéra‐ peute) “occupational therapy” means the application of occu‐ pational therapy knowledge, skills and judgment to opti ‐ mize occupational performance in the areas of self care, productivity and leisure and may include, but is not lim ‐ ited to: (

a) the application and

interpretation of procedures designed to evaluate occupational function; (

b) the planning, administration and evaluation of developmental, rehabilitative, maintenance, preventa ‐ tive and educational programs; and

e) une conclusion par l’organisme directeur d’une profession de la santé à l’extérieur du Nouveau- Brunswick que la personne inscrite a commis, selon le Comité des plaintes ou le Comité de déontologie, une faute professionnelle selon la définition que donne de ce terme la présente loi, les règlements et les règle ‐ ments administratifs;

f) l’omission d’une personne inscrite de se confor ‐ mer aux modalités, conditions ou limites relatives au droit d’exercer en vertu de la présente loi, des règle ‐ ments ou des règlements administratifs;

g) le refus de prendre un engagement, la violation d’un engagement ou l’omission de se conformer à un engagement donné en vertu de la présente loi, des rè ‐ glements ou des règlements administratifs;

h) la maltraitance verbale, physique, psychologique ou sexuelle d’une personne;

i) le défaut de signaler un cas de mauvais traitement sexuel en vertu du paragraphe 50(1);

j) le détournement de biens personnels, de médica ‐ ments ou d’autres biens appartenant à un client ou à un employeur;

k) l’influence exercée de manière inappropriée pour amener un client à produire ou à modifier un docu ‐ ment juridique;

l) l’abandon d’un client;

m) l’omission de prodiguer des soins à un client;

n) l’omission de faire preuve d’une discrétion ap ‐ propriée à l’égard de la divulgation de renseignements confidentiels;

o) la falsification de dossiers;

p) l’utilisation du statut de titulaire de permis à des fins personnelles;

q) la promotion, à des fins personnelles, de médica ‐ ments, d’appareils, d’interventions, de produits ou de services qui sont inutiles, inefficaces ou dangereux;

r) la publication, même indirectement, de toute pu ‐ blicité qui est fausse, frauduleuse, mensongère ou trompeuse;

c) work in education, health promotion, consulta ‐ tion, management, research and other occupational therapy services. (ergothérapie) “prior Act” means the Occupational Therapy Act ,

chapter 76 of the Acts of New Brunswick, 1988. (loi an‐ térieure) “Professional Conduct Committee” means the Profes ‐ sional Conduct Committee appointed under this Act. (Comité de déontologie) “professional conduct procedure” means the profes ‐ sional conduct procedure set out in this Act, the regula ‐ tions and the by-laws. (procédure de déontologie) “professional misconduct” includes such conduct or acts relevant to the practice of occupational therapy that, having regard to all the circumstances, would reasonably be regarded as disgraceful, dishonourable or unprofes ‐ sional, including: (

a) failing to maintain the standards of practice; (

b) failure to comply with this Act, the regulations or the by-laws; (

c) failing to adhere to any codes of ethics or stand ‐ ards of practice adopted by the Association; (

d) a registrant having pleaded guilty to or having been found guilty of an offence that is relevant to the registrant’s suitability to practise; (

e) a finding by the governing body of a health pro ‐ fession in a jurisdiction other than New Brunswick that the registrant committed

an act of professional conduct that would, in the opinion of the Complaints Committee or the Professional Conduct Committee, be

an act of professional misconduct as defined in this Act, the regulations and the by-laws; (

f) failure to comply with a term, condition or limi ‐ tation on the registrant’s right to practise under this Act, the regulations or the by-laws; (

g) a refusal to give an undertaking or the violation or failure to comply with an undertaking given under this Act, the regulations or the by-laws; (

h) abusing a person verbally, physically, emotion ‐ ally or sexually;

s) la participation ou la contribution à une fraude, à une fausse déclaration, à une tromperie ou à la dissi ‐ mulation d’un fait important au moment de demander ou d’obtenir une immatriculation ou un permis d’exercice, ou de passer un examen prévu dans la pré ‐ sente loi, y compris l’utilisation d’identifiants obtenus de façon frauduleuse;

t) l’appropriation ou l’utilisation d’une désignation ou d’un dérivé ou d’une abréviation de celle-ci, ou la description des activités d’une personne en tant qu’« ergothérapie » dans une publicité ou une publi ‐ cation, y compris les cartes professionnelles, les sites Web ou les pancartes, à moins que l’activité en ques ‐ tion ne relève de l’exercice de l’ergothérapie;

u) l’omission de se soumettre à un examen en vertu des paragraphes 31(9) et (10);

v) toute forme de discrimination et toute conduite discriminatoire interdites en vertu de la

Loi sur les droits de la personne et ayant trait à la présente loi, aux règlements et aux règlements administratifs, à moins que ce ne soit à des fins réglementaires;

w) toute autre conduite ou tout autre acte prévu par les règlements ou les règlements administratifs. ( pro‐ fessional misconduct) « frais » Est compris parmi les frais ce qui suit :

a) les dépenses engagées par l’Association pour en ‐ quêter et statuer sur une affaire;

b) les frais liés aux évaluations des compétences, aux autres évaluations, aux vérifications et aux exa ‐ mens menés par l’Association lors du traitement d’une affaire;

c) les frais entre avocat et client de l’Association, notamment les débours et la taxe sur les produits et services, y compris ceux du conseiller juridique de l’Association et de celui d’un comité;

d) les frais associés aux services d’un sténographe judiciaire et à l’établissement des transcriptions;

e) les frais de déplacement et les dépenses raisonna ‐ bles d’un témoin, y compris d’un témoin expert;

i) failure to report sexual abuse under subsection 50(1); (

j) misappropriating personal property, drugs or other property belonging to a client or an employer; (

k) inappropriately influencing a client to make or change a legal document; (

l) abandoning a client; (

m) neglecting to provide care to a client; (

n) failing to exercise appropriate discretion with re ‐ spect to the disclosure of confidential information; (

o) falsifying records; (

p) inappropriately using licensing status for per ‐ sonal gain; (

q) promoting for personal gain any drug, device, treatment, procedure, product or service that is unnec ‐ essary, ineffective or unsafe; (

r) publishing, or causing to be published, any ad ‐ vertisement that is false, fraudulent, deceptive or mis ‐ leading; (

s) engaging or assisting in fraud, misrepresenta ‐ tion, deception or concealment of a material fact when applying for or securing registration or a licence to practise or taking any examination provided for in this Act, including using fraudulently procured creden ‐ tials; (

t) taking or using a designation or a derivation or abbreviation thereof, or describing the person’s activi‐ ties as “occupational therapy” in any advertisement or publication, including business cards, websites or sig ‐ nage, unless the referenced activity falls within the practice of occupational therapy; (

u) failure to submit to an examination under sub ‐ sections 31(9) and (10); (

v) discrimination and discriminatory conduct that is prohibited under the Human Rights Act and that is undertaken in connection to this Act, the regulations and the by-laws unless undertaken for a prescribed purpose; and

(incapacity) « incompétence »

En ce qui concerne une personne inscrite, tout manque de compétence dans les soins pro ‐ digués à un client ou la prestation de services d’ergothé ‐ rapie qui, compte tenu de toutes les circonstances, fait en sorte que la personne inscrite n’était pas en mesure d’as ‐ surer de façon sécuritaire les soins au client ou la presta ‐ tion de services d’ergothérapie ou de continuer d’exercer ses activités professionnelles sans assistance corrective. (incompetence) « loi antérieure » La

Loi sur l’ergothérapie , chapi ‐ tre 76 des Lois du Nouveau-Brunswick de 1988. (prior Act) « Ministre » Le ministre de la Santé. (Minister) « moyen électronique » Le recours à toute forme de communication électronique ou informatisée, notam ‐ ment par téléphone, télécopieur, télévision, vidéoconfé ‐ rence, câble, Internet ou intranet. (electronic means) « norme d’exercice » Attentes minimales d’exercice professionnel qui sont applicables à une personne ins ‐ crite titulaire d’une désignation particulière dans un ca ‐ dre ou des fonctions approuvés par le Conseil. (standard of practice) « permis »

w) other such conduct or acts as may be prescribed by regulation or by-law. (registre) “registrant” means a person whose name is entered in a register. (personne inscrite) “Registrar” means the person holding the office of the Registrar pursuant to subsection 16(2). (registraire) “registration” means the procedure by which a person who is not registered is assessed to determine whether the person meets the criteria for registration under this Act and the regulations. (immatriculation) “settlement agreement” means an agreement that re ‐ solves a complaint after a matter has been referred for hearing by the Complaints Committee. a) a person who is the registrant’s spouse as de ‐ fined in the Family Law Act, or (

b) a person who has lived with the registrant in a conjugal relationship outside of marriage continu ‐ ously for a period of not less than one year. (conjoint) “standard of practice” means the minimal professional practice expectations for a registrant of a particular des ‐ ignation in a setting or role, approved by the Council. PART 4 COUNCIL OF THE ASSOCIATION

o) prescribing all fees, assessments and fines to be paid by applicants and registrants for registration, li ‐ censing, examinations, continuing education, profes ‐ sional conduct and as may otherwise be required for the purposes of the Association, including due dates for payment of such fees, assessments and fines, pro ‐ visions for instalment payments, penalties for late payment, and the consequences on licensing for late payment or nonpayment;

PART 8 BY-LAWS

PARTIE 8 RÈGLEMENTS ADMINISTRATIFS 15 Unless this Act or the regulations otherwise pro ‐ vide, the Council may, by resolution, make any by-laws not contrary to the regulations regulating any of the as ‐ pects, subjects or matters of the business or affairs of the Association as may be governed by regulation, and any such by-law shall be binding and effective from the date of the resolution of the Council until amended or re ‐ pealed by an ordinary resolution at an annual or special meeting of the Association called for the purpose of con ‐ sidering the same. 15 Sauf disposition contraire de la présente loi ou des règlements, le Conseil peut, par résolution, adopter des règlements administratifs compatibles avec les règle ‐ ments pour la régie des affaires ou activités de l’Associa‐ tion sous tous les aspects, sous tous les sujets et en toutes matières, conformément aux règlements.

PART 9 OFFICERS OF THE COUNCIL

PART 11 REGISTRATION AND LICENSING

d) refer the application to the Admissions Commit ‐ tee if the Registrar determines that there is an issue re‐ garding whether the applicant meets the criteria for registration, licensing or renewal of licence or whether conditions or restrictions should be imposed.

Waiver of Criteria for Registration or Licensing Dérogation aux critères d’immatriculation ou de délivrance de permis 25 The Council and the Admissions Committee may waive any of the criteria for registration or renewal of a licence if it is required by law or it is consistent with the objects of the Association. 25 Le Conseil et le Comité des admissions peuvent dé‐ roger aux critères d’immatriculation ou de renouvelle ‐ ment d’un permis si la loi l’exige ou si cela est compatible avec les objets de l’Association.

PART 14 PROFESSIONAL CORPORATIONS

i) a professional corporation; (
