AMENDMENT REGULATION

1 The Critical Infrastructure Defence Regulation

(AR 169/2021) is amended by this Regulation.

Section 1 is repealed and the following is substituted:

Essential infrastructure

1 All land in Alberta within 2 km of the United States border is

prescribed as essential infrastructure for the purposes of

section 1(1)(a)(xxi) of the Act.

ATB Financial Act

ATB FINANCIAL AMENDMENT REGULATION

section 34 of the ATB Financial Act.

1 The ATB Financial Regulation (AR 187/97) is amended by

this Regulation.

Section 9 is repealed and the following is substituted:

Mortgage investments

9(1) In this section,

(a) "alternative finance mortgage lender" means a subsidiary of

ATB that is a corporation referred to in

section 19(4)(j.1) of

the Act;

(b) "mortgage" means a mortgage on improved real estate.

(2) Subject to subsections (3) and (4), ATB or an alternative finance

mortgage lender may do either of the following:

(

a) purchase a mortgage;

(

b) make a loan on the security of a mortgage.

(3) An alternative finance mortgage lender may not purchase a

mortgage or make a loan on the security of a mortgage unless the

mortgage is a residential mortgage.

(4) Where a mortgage is a residential mortgage, the amount paid for

or advanced on the mortgage, together with the amount of

indebtedness under any other mortgage on the improved real estate

that ranks equally with or prior to the mortgage, must not exceed

80% of the market value of the real estate at the time the mortgage is

purchased or granted, as the case may be, unless the excess amount

is guaranteed or insured by one of the following:

(

a) the Government of Alberta;

(

c) the government of another province;

(

d) an agency of a government referred to in clauses (

a) to (c);

(

e) an insurance policy issued by an insurance corporation

authorized to carry on business in Canada.

(5) Where the excess amount referred to in subsection (4) is

guaranteed or insured by an agency of the Government of Alberta,

the guarantee or insurance must be on the same basis and subject to

the same conditions that would apply if the excess amount were

guaranteed or insured under the National Housing Act (Canada).

(6) Subsection (4) does not apply to a loan made on the security of a

mortgage to the purchaser of improved real estate that ATB or an

alternative finance mortgage lender, as the case may be,

(

a) acquired for the purpose of protecting its investment, and

(

b) in respect of which it is disposing.

3 The following is added after

section 31:

Expiry

31.1 For the purpose of ensuring that this Regulation is reviewed

for ongoing relevancy and necessity, with the option that it may be

repassed in its present or an amended form following a review, this

Regulation expires on January 31, 2030.

Credit Union Act

CREDIT UNION (PRINCIPAL)

AMENDMENT REGULATION

section 230 of the Credit Union Act.

1 The Credit Union (Principal) Regulation (AR 249/89) is

amended by this Regulation.

Section 1 is amended

(

a) in subsection (1)

(

i) by repealing clause (

a) and substituting the

following:

(a) "alternative finance mortgage loan" means a

residential mortgage loan in respect of which the

borrower is legally liable to the lender for the

following payments:

(

i) the principal amount of the loan;

(ii) any expense charged for the making of the

loan;

(iii) an amount that is payable in a form other than

as principal, interest or an expense and that

relates to a return or profit payable on the

loan;

(ii) in clause (

l) by adding "and includes an alternative

finance mortgage loan" after "mortgage of land";

(iii) in clause (m)(ii) by striking out "the credit union"

and substituting "a credit union or lending

subsidiary, as the case may be,";

(iv) in clause (m.1) by striking out "the credit union"

and substituting "a credit union or lending

subsidiary";

(

b) in subsection (2.1) by striking out "and sections

2(1)(a)(

i) and (ii) and (c)(iv) and 3(

a) and (

b) and 4 of

Schedule 2".

Section 2(1)(

d) is amended by striking out "section 2 of

Schedule 2" and substituting "the capital requirements standard

established under

section 145.1 of the Act".

Section 13.1(2)(

c) is amended

(

a) by striking out "where a credit union is providing a loan"

and substituting "where a credit union or lending

subsidiary is providing a loan";

(

b) by striking out "information to the credit union," and

substituting "information to the credit union or lending

subsidiary, as the case may be,".

5 The following is added after

section 15:

Subsidiary as an alternative

finance mortgage lender

15.01 For the purposes of

section 46(5)(

b) of the Act, a subsidiary

is entitled to make or acquire an alternative finance mortgage loan in

accordance with

section

Section 22(

k) is amended by adding "or the employees of its

subsidiaries" after "employees".

Section 25 is amended by striking out "section 2(1) of

Schedule 2" and substituting "the capital requirements standard

established under

section 145.1 of the Act,".

Section 41.3 is repealed.

Section 51 is amended by adding the following after

subsection (2):

(3) A lending subsidiary shall not make an alternative finance

mortgage loan, or acquire the rights of a lender under an alternative

finance mortgage loan, unless the loan is a quality mortgage loan.

(4) Notwithstanding subsection (3), a lending subsidiary may make

an alternative finance mortgage loan that is not a quality mortgage

loan as part of the sale of foreclosed land to a purchaser if the prior

approval of a special loans committee has been received for the

making of the loan.

Section 54.1 is amended

(

a) in clause (

a) by striking out "where a small credit union

is" and substituting "in the case of a small credit union or

its lending subsidiary";

(

b) in clause (b)

(

i) by adding "of a credit union or its lending subsidiary

making a loan or placing a deposit with another credit

union" after "in any other case";

(ii) by striking out "lender";

(iii) by adding "or its lending subsidiary" after "of its".

Section 74(

b) is repealed and the following is

substituted:

b) payment under the loan agreement of any of the applicable

payments referred to in

section 1(1)(hh) of the Act is not in

arrears,

Schedule 2 is repealed.

13 This Regulation comes into force on the coming into

force of

section 5 of the Financial Statutes Amendment Act,

2024 (No. 2).

5.1 An operator may not deny a child or student access to an early

childhood services program if the child or student does not wear a

face mask or other face covering for the primary purpose of

preventing or limiting the spread of any communicable disease as

defined in the Public Health Act.

3 This Regulation comes into force on March 1, 2025.

section 22.2 of the Fuel Tax Act.

registration fee".

BALLOT FOR A VOTE ON A BYLAW OR QUESTION

The wording on a ballot for a vote on a bylaw or question must be determined

by a resolution of the Francophone regional authority. The form of the ballot

may be determined by a resolution of the Francophone regional authority;

however, if no resolution is passed, the Returning Officer must determine the

form in accordance with

section 44 of the Local Authorities Election Act.

ARRANGING THE NAMES ON THE BALLOTS

The names of the candidates on each ballot must be arranged

alphabetically in order of the surnames and, if 2 or more candidates have

the same surname, the names of those candidates must be arranged

alphabetically in order of their given names.

If a Francophone regional authority passes a bylaw 2 months before an

election that provides that ballots be printed in as many lots as there are

candidates for the office,

PIPELINE RULES AMENDMENT REGULATION

1 The Pipeline Rules (AR 125/2023) are amended by this

Regulation.

Section 1(1) is amended by adding the following after

clause (h):

(h.1) "Directive 001" means Directive 001: Requirements for

Site-Specific Liability Assessments;

(h.2) "Directive 011" means Directive 011: Estimated Liability;

Section 4(1) is amended by renumbering clause (

a) as

clause (a.2) and by adding the following before clause (a.2):

(

a) Directive 001,

(a.1) Directive 011,

Section 16 is amended

(

a) in subsection (1)(

b) by striking out "and" and

substituting "or";

(

b) in subsection (2) by striking out "Any" and

substituting "Subject to subsections (3) and (4), any";

(

c) by adding the following after subsection (2):

(3) The Regulator may make the results of any licensee

assessment conducted by the Regulator under Directive 088

available to the public.

(4) If requested by an applicant for a transfer of a licence, the

Regulator shall make available to the applicant the estimated

liability of that licence as determined by the Regulator under

Directive 011.

5 The following is added after

section 16:

Site-specific liability assessment

16.1(1) Subject to subsection (2), a site-specific liability assessment

conducted and submitted by a licensee under Directive 001 must be

kept confidential by the Regulator.

(2) The Regulator may make the magnitude of estimated liability of

a licensee available to the public.

OIL AND GAS CONSERVATION RULES

AMENDMENT REGULATION

1 The Oil and Gas Conservation Rules (AR 151/71) are

amended by this Regulation.

Section 1.020(2) is amended

(

a) in definition 5.11 by striking out "in Support of the

ERCB's Liability Management Programs";

(

b) by repealing definition 5.12;

(

c) by repealing definition 5.14 and substituting the

following:

5.14. "Directive 011" means Directive 011: Estimated

Liability;

(

d) by repealing definition 5.141;

(

e) in definition 5.21 by striking out "ERCB";

(

f) by repealing definition 5.4;

(

g) in definition 12.1 by striking out "Department of

Environment and Parks" and substituting "Department of
