Section 49 of the Freedom of Information and Protection of Privacy Act The Governor in Council on the report and recommendation of the Minister of Justice dated March 7, 2002, and pursuant to

Section 49 of

Chapter 5 of the Acts of 1993, the Freedom of Information and Protection of Privacy Act, is pleased to amend the Freedom of Information and Protection of Privacy Regulations made by the Governor in Council by Order in Council 94-537, dated June 28, 1994, in the manner set forth in

Schedule "A" attached to and forming part of the report and recommendation, effective on and after April 4, 2002.

Schedule "A" Amendments to the Freedom of Information and Protection of Privacy Regulations made by the Governor in Council pursuant to

Section 49 of

Chapter 5 of the Acts of 1993, the Freedom of Information and Protection of Privacy Act

Section 6 of the Freedom of Information and Protection of Privacy Regulations made by the Governor in Council by Order in Council 94-537, dated June 28, 1994, is amended by (

a) striking out “five dollars” in subsection (1) substituting “$25.00”; (

b) striking out “ten dollars” wherever it appears in clauses 6(3)(a), (

b) and (

d) and substituting “$15.00”.

Chapter 17 of the Acts of 1995-96, the Revenue Act, is pleased to amend the Revenue Act Regulations made by the Governor in Council by Order in Council 96-230 dated March 29, 1996, in the manner set forth in

Schedule “A” attached to and forming part of the report and recommendation, effective on and after April 5, 2002.

Schedule "A" Amendment to the Revenue Act Regulations made by the Governor in Council pursuant to

Section 12 of

Chapter 17 of the Acts of 1995-96, the Revenue Act Subsection 6(1) of the Revenue Act Regulations made by the Governor in Council by Order in Council 96-230 dated March 29, 1996, is amended by striking out “13 5/10 cents per litre” and substituting “15 5/10 cents per litre”. Section 7 of the Gypsum Mining Income Tax Act The Governor in Council on the report and recommendation of the Minister of Natural Resources dated March 7, 2002, and pursuant to

Section 7 of

Chapter 190 of the Revised Statutes of Nova Scotia, 1989, the Gypsum Mining Income Tax Act, is pleased to (

a) repeal Order in Council 75-530 dated May 20, 1975; and (

b) determine that for the purpose of a statement permitted by

Section 7 of the Act to be submitted in lieu of a detailed statement, the aggregate amount of income derived from gypsum mining operations shall be calculated at the rate of $0.48 per ton of the gypsum so mined, effective on and from April 5, 2002.

Part II Regulations N.S. Reg. 55/2002 Made: April 5, 2002 Filed: April 9, 2002 Insured Dental Services Tariff Regulations Order in Council 2002-168 made April 5, 2002 Amendment to regulations made by the Minister of Health and the Governor in Council pursuant to

Section 13 and subsection 17(2) of the Health Services and Insurance Act The Governor in Council on the report and recommendation of the Minister of Health dated March 25, 2002, and pursuant to subsection 17(2) of

Chapter 197 of the Revised Statutes of Nova Scotia, 1989, the Health Services and Insurance Act, is pleased to (

a) amend Order in Council 2001-327 dated July 5, 2001, by (

i) striking out “Section 13” a nd substituting “subsection 17(2)” in subsection (a), and (ii) adding “make new regulations re specting insured dental services and” before “approve of the new tariff” in subclause (a)(ii); and (

b) amend the Insured Dental Services Tariff Regulations made by the Minister of Health and the Governor in Council by Order in Council 2001-327 dated July 5, 2001, in the manner set forth in

Schedule “A” attached to and forming part of the report and recommendation, effective on and after May 1, 2002. In the matter of the Insured Dental Services Tariff Regulations made pursuant to Sections 13 and 17 of the Health Services Insurance Act - and - In the matter of a tariff of fees established by the Minister of Health pursuant to clause 13(1)(

c) of the Health Services and Insurance Act with respect to insured dental services ORDER I, Jamie Muir, Minister of Health for the Province of Nova Scotia, pursuant to clause 13(1)(

c) of

Chapter 197 of the Revised Statutes of Nova Scotia, 1989, the Health Services and Insurance Act, do hereby establish that the tariff to be paid in respect of insured dental services referred to in the amendments to the Insured Dental Services Tariff Regulations set forth in

Schedule “A”, shall be the amount as set forth in

Schedule “A”. This Order shall be effective on and after the making by the Governor in Council of the amendments to the Insured Dental Tariff Regulations set out in

Schedule “A” Amendments to the Insured Dental Tariff Regulations made by the Minister of Health and the Governor in Council pursuant to

Section 13 and subsection 17(2) of

Chapter 197 of the Revised Statutes of Nova Scotia, 1989, the Health Services and Insurance Act The Insured Dental Services Tariff Regulations made by the Minister of Health and the Governor in Council by Order in Council 2001-327 dated July 5, 2001, are amended by adding the following

Section immediately after

Section 3: Children’s Oral Health Program - limited coverage 4( 1 ) Effective May 1, 2002, no amount shall be paid for services rendered to a resident in accordance with

Schedule “B” to whom or for whom a benefit, whether full or partial, in respect of those services has been paid or would be payable if claimed under any contract or plan of insurance that applies to that resident.

(2) For further clarification, where a partial benefit for services rendered to a resident in accordance with

Schedule “B” has been paid or would be payable if claimed under any contract or plan of insurance that applies to that resident, any outstanding costs will not be paid for by the Province.

Section 146 of the Education Act The Governor in Council on the report and recommendation of the Minister of Education dated March 25, 2002, and pursuant to

Section 146 of

Chapter 1 of the Acts of 1995-96, the Education Act, is pleased to amend the Governor in Council Education Act Regulations made by the Governor in Council by Order in Council 97-405 dated June 24, 1997, in the manner set forth in

Schedule "A" attached to and forming part of the report and recommendation, effective on and after April 5, 2002.

Schedule "A" Amendments to the Governor in Council Education Act Regulations made by the Governor in Council pursuant to

Section 146 of

Chapter 1 of the Acts of 1995-96, the Education Act The Governor in Council Education Act Regulations made by the Governor in Council by Order in Council 97-405 dated June 24, 1997, are amended by adding the following

Section immediately after

Section 60: Establishment of Strait Regional School Board Pilot 61

(1) The school region administered by the Strait Regional School Board and the Strait Regional School Board are designated as a school region and a regional school board for the purpose of

Section 10J of the Act, and, for greater certainty, these designations are effective on and after the coming into force of this Section.

(2) It is determined that Sections 10A to 10I of the Act apply to the school region and regional school board referred to in subsection (1) to the extent and on the terms and conditions provided in this Section.

(3) Clauses 10A(1)(

a) to (

c) of the Act do not apply and the following clauses apply to the school region and the regional school board referred to in subsection (1): (

a) the school region administered by the Strait Regional School Board is composed of one school district comprising the same area as the school region; (

b) the Strait District School Board is established to administer the public schools in the school district described in clause (a); (

(4) Subsection 10D(4) of the Act does not apply to the Strait District School Board, and a director of education of the Strait District School Board holds office for a term commencing on the date of appointment and ending on the election of school boards in 2004 or such earlier time as may be prescribed by amendment to these regulations.

(5) Clause 10E(2)(

m) of the Act applies mutatis mutandis to the Strait District School Board with the additional provision that the director of education participate on a joint committee established by the Minister for the purpose of monitoring and facilitating the carrying out by the Chief Executive Officer and the director of education of their respective responsibilities pursuant to the Act and these regulations.

(6) Subsection 10H(2) of the Act does not apply to the Strait District School Board, and the Chief Executive Officer of the Strait District School Board holds office for a term commencing on the date of appointment and ending on the election of school boards in 2004 or such earlier time as may be prescribed by amendment to these regulations.

(7) Clause 10I(2)(

i) of the Act applies mutatis mutandis to the Strait District School Board with the additional provision that the Chief Executive Officer of the Strait District School Board participate on a joint committee established by the Minister for the purpose of monitoring and facilitating the carrying out by the Chief Executive Officer and the director of education of their respective responsibilities pursuant to the Act and these regulations.

(8) Section10K of the Act does not apply to the Strait Regional School Board or the Strait District School Board.
