WHEREAS the Association des ostéopathes du Nouveau-Brunswick / Association of Osteopaths of New Brunswick Inc. prays that it be enacted as hereinafter set forth; que l’Association des ostéopathes du Nouveau- Brunswick / Association of Osteopaths of New Brunswick Inc. sollicite l’édiction des dispositions qui suivent; AND

WHEREAS it is desirable, in the interests of the public and the registrants of the Association des ostéo ‐ pathes du Nouveau-Brunswick / Association of Osteo ‐ paths of New Brunswick In c., to continue the Associa ‐ tion des ostéopathes du Nouveau-Brunswick / Association of Osteopaths of New Brunswick Inc. as a body corporate and politic without share capital under the name “College of Osteopaths of New Brunswick” for the purpose of advancing and maintaining the standard of osteopathy services in the Province, for governing and regulating osteopathy services provided to the public and for providing for the welfare of members of the public; qu’il est dans l’intérêt du public et des personnes imma ‐ triculées auprès de l’Association des ostéopathes du Nouveau-Brunswick / Association of Osteopaths of New Brunswick Inc. que cette association soit prorogée comme personne morale sans capital social sous le nom d’« Ordre des ostéopathes du Nouveau-Brunswick » dans le but de rehausser et de maintenir la qualité des services d’ostéopathie dans la province, d’encadrer et de réglementer les services d’ostéopathie fournis au public et de pourvoir au bien-être de la population, THEREFORE, His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’As ‐ semblée législative du Nouveau-Brunswick, édicte :

PART 1

INTERPRETATION

PARTIE 1 INTERPRÉTATION 1(1) The following

definitions apply in this Act, unless the context otherwise requires. 1(1) Les définitions qui suivent s’appliquent à la pré ‐ sente loi, à moins que le contexte n’exige un sens diffé ‐ rent. 1

“by-law” means any by-law made under this Act. (rè‐ glement administratif) “College” means the College of Osteopaths of New Brunswick continued under

section 2. (Ordre) “Council” means the Council of the College consti ‐ tuted under

section 3. (Conseil) “Court” means The Court of King’s Bench of New Brunswick. (Cour) “Executive Director” means the person holding the office of Executive Director under subsection 8(1). (di‐ recteur général) “health professional” means a person who provides a service related to (

a) the preservation or improvement of the health of individuals, or (

b) the diagnosis, treatment or care of individuals who are injured, sick, disabled or infirm, and who is regulated under

an Act of the Legislature with respect to the provision of the service and includes a social worker registered under the New Brunswick As ‐ sociation of Social Workers Act . ( professionnel de la santé) “incapacity” means a physical or mental condition, addiction or disorder suffered by a registrant of such na ‐ ture and extent that it is desirable in the interests of the public, the College or the registrant that the registrant no longer be permitted to carry on the practice of osteop ‐ athy or that the registrant’s practice be suspended or sub‐ jected to conditions, limitations or restrictions. (incapa‐ cité) “incompetence” means acts or omissions on the part of a registrant in the registrant’s professional practice that demonstrate a lack of knowledge, skill or judgment, or disregard for the interests of a patient of such a nature and to such an extent as to render the registrant unfit to carry on the practice of osteopathy without conditions, limitations or restrictions. (incompétence) “licence” means a licence to practise osteopathy under this Act. (licence) “Minister” means the Minister of Health. (ministre) « Conseil »

(incapacity) « incompétence »

Actes ou omissions d’une personne immatriculée dans l’exercice de sa profession, qui dé ‐ montrent un manque de connaissances, d’aptitudes ou de jugement, ou une insouciance à l’égard des intérêts d’un patient, dont la nature et l’importance sont telles qu’ils l’ont rendue inapte à continuer d’exercer l’ostéopathie sans conditions, limitations ou restrictions. (incompeten‐ ce) « inconduite professionnelle »

S’entend des écarts graves par rapport aux normes professionnelles ou aux règles de pratique – établies ou reconnues – de l’Ordre ou de la profession ostéopathique, et vise notamment les cas suivants relativement à une personne immatriculée :

a) elle reconnaît sa culpabilité pour une infraction qui, de l’avis du Comité d’audience, a rapport à son aptitude à exercer, ou elle est déclarée coupable de pareille infraction;

b) un organe directeur d’une profession de la santé de l’extérieur du Nouveau-Brunswick l’a déclarée coupable d’un acte d’inconduite professionnelle qui, de l’avis du Comité d’audience, constituerait une in ‐ conduite professionnelle au regard de la présente loi ou des règlements administratifs; Projet de loi 36

“osteopath” means a person whose name is entered in the registers kept under paragraph 10(1)(a), (b), or (d). (ostéopathe) “osteopathy” or “practice of osteopathy” means a sys‐ tem of evaluation and assessment, treatment and health- care management based on the principle that the struc ‐ ture and function of the body are closely integrated and that a person’s well-being is dependent upon the health of the body’s various systems, including, but not limited to, the musculoskeletal, neurological, cranial and vis ‐ ceral structures working in balance together. or (ostéopa‐ thie ) or (exercice de l’ostéopathie) “patient” or “client” means a recipient of the services of an osteopath. (patient) or (client) “prescribed” means prescribed by by-laws or rules made under this Act. (réglementaire) “professional corporation” means a corporation the name of which is entered in the professional corpora ‐ tions register. (corporation professionelles) “professional corporations register” means the register kept under paragraph 10(1)(c). (registre des corpora ‐ tions professionnelles) “professional misconduct” means a serious digression from established or recognized professional standards or rules of practice of the College or the profession of oste ‐ opathy, including, but not limited to the following: (

a) the registrant has pleaded guilty to or been found guilty of an offence that, in the opinion of the Hearing Committee, is relevant to the registrant’s suitability to practise; (

b) the governing body of a health profession in a jurisdiction other than New Brunswick has found that the registrant committed

an act of professional mis ‐ conduct that would, in the opinion of the Hearing Committee, constitute professional misconduct under this Act or the by-laws; (

c) the registrant has digressed from established or recognized professional standards or rules of practice of the profession; (

d) the registrant has committed

an act of professio ‐ nal misconduct as defined in the by-laws;

h) elle a abusé sexuellement d’un patient au sens de l’article 44;

i) elle a omis de faire un signalement conformément à l’article 45. (professional misconduct) « licence » Licence autorisant l’exercice de l’ostéopa ‐ thie sous le régime de la présente loi. (licence) « ministre » Le ministre de la Santé. (Minister) « Ordre » L’Ordre des ostéopathes du Nouveau- Brunswick que proroge l’article 2. e) the registrant has violated or failed to comply with this Act or the by-laws; (

f) the registrant has violated or failed to comply with a term, condition, limitation or restriction im ‐ posed on the registrant’s licence or registration; (

g) the registrant has failed to submit to an examina ‐ tion ordered by the Hearing Committee under subsec ‐ tion 39(7); (

h) the registrant has sexually abused a patient as defined under

section 44; or (

i) the registrant has failed to file a report pursuant to

section 45. (inconduite professionnelle) “register” means the register kept under paragraph 10(1)(a). (registre) “registrant” means an osteopath whose name is en ‐ tered in the register, temporary register or specialist reg ‐ ister established and maintained under this Act, the by- laws or rules and, where required, for the purposes of applying the provisions of this Act, includes a professio ‐ nal corporation. (personne immatriculée) “Registrar” means the person holding the office of Registrar under subsection 8(2). (registraire) “registration” means the entry of the name of a person in a register under this Act. (immatriculation) “roster” means any roster kept under paragraph 10(1)(e). (tableau) “specialist” means an osteopath whose name is en ‐ tered in the specialists register kept under paragraph 10(1)(

d) and who is the holder of a specialist licence is ‐ sued under this Act, the by-laws or the rules. (spécial‐ iste) “specialists register” means the register kept under paragraph 10(1)(d). tioner”, “osteopathic practitioner”, “master of osteop ‐ athy” or any like words, initials or expressions used alone or in combination with other words or expressions connoting a person recognized by law as an osteopath or a person entitled to carry on the practice of osteopathy or connoting a registrant of the College, when used in any provision of

an Act of the Legislature or any regulation, rule, order or by-law made under

PART 2 THE COLLEGE

PARTIE 2 L’ORDRE 2 The Association des ostéopathes du Nouveau- Brunswick / Association of Osteopaths of New Bruns ‐ wick Inc. incorporated by letters patent dated January 28, 2005, is hereby continued as a body corporate and politic without share capital under the name “College of Osteopaths of New Brunswick” and, subject to this Act, has the capacity, rights, powers and privileges of a natu ‐ ral person. 2 L’Association des ostéopathes du Nouveau- Brunswick / Association of Osteopaths of New Brunswick Inc. constituée par lettres patentes délivrées le 28 janvier 2005 est prorogée en personne morale sans capital social sous le nom d’« Ordre des ostéopathes du Nouveau-Brunswick » et, sous réserve des autres dispo ‐ sitions de la présente loi, jouit des capacités, droits, pou ‐ voirs et privilèges d’une personne physique.

Council of the College Conseil de l’Ordre 3(1) A Council of the College consisting of not fewer than five and not more than ten councillors shall be re ‐ sponsible for the administration of this Act and shall control, govern and manage, or supervise the control, government and management of, the business and affairs of the College and all aspects of the practice of osteop ‐ athy. 3(1) Le Conseil de l’Ordre, qui compte un minimum de cinq et un maximum de dix conseillers, est chargé de l’application de la présente loi; il dirige et administre les activités et les affaires internes de l’Ordre ainsi que l’exercice de l’ostéopathie sous toutes ses formes, ou en surveille la direction et l’administration. 3(2) The number of councillors, their respective terms of office, the manner of their appointment or election and their qualifications shall be established and gov ‐ erned by the by-laws of the College, and such by-laws may provide for alternate councillors, for the filling of vacancies and for the appointment of additional council ‐ lors. 3(2) Le nombre de conseillers, la durée de leur mandat respectif, le mode de leur nomination ou de leur élection, et les conditions de qualification sont établis et régis par les règlements administratifs de l’Ordre, lesquels peuvent aussi prévoir la désignation de suppléants, la manière de pourvoir aux vacances et la nomination de conseillers additionnels. 3(3) One councillor, when the total number of council ‐ lors does not exceed eight, or two councillors, when the total number of councillors exceeds eight, shall be ap ‐ pointed by the Minister from a list of persons nominated by Council to represent the public, and no such council ‐ lor may be a registrant of the College. 3(3) Pour représenter le public, le ministre nomme, à partir d’une liste proposée par le Conseil, un conseiller, lorsque le Conseil compte huit membres ou moins, ou deux conseillers, lorsqu’il en compte plus de huit, qui ne sont pas des personnes immatriculées auprès de l’Ordre. 3(4) The powers, duties and operations of the Council are not affected in any way by 3(4) Les pouvoirs, fonctions et actes du Conseil ne sont nullement touchés par : Osteopathy Act Bill 36 5

a) the fact that an appointment has not been made under subsection (3),

By-laws Règlements administratifs 4(1) Unless this Act or the by-laws otherwise provide, the Council may by resolution make, amend or repeal by-laws, not inconsistent with the provisions of this Act, regulating the business or affairs of the College, the practice of osteopathy and the practice of osteopaths and, without restricting the generality of the foregoing, 4(1) Sauf disposition contraire de la présente loi ou des règlements administratifs, le Conseil peut, par réso ‐ lution, établir, modifier ou abroger des règlements admi ‐ nistratifs non incompatibles avec les dispositions de la présente loi, qui sont destinés à réglementer les activités ou les affaires internes de l’Ordre, l’exercice de l’ostéo ‐ pathie ainsi que l’activité professionnelle des ostéopa ‐ thes, et qui, notamment : (

d) creating and organizing local regions, academ ‐ ies, chapters or other subsections of the College and governing the management of such subsections,

e) determining the method of setting fees payable to the College annually or otherwise, including with ‐ out limiting the foregoing, fees for admission, regis ‐ tration, insurance and testing or examinations and providing for the collection thereof,

g) creating and governing committees for the car ‐ rying out of the business and affairs of the Council and the College and for regulating and governing the practice of osteopathy,

h) delegating to councillors, officers, officials, em ‐ ployees or committees any of the duties, powers and privileges of the Council and the College, except the power to make, amend or repeal by-laws, rules, a code of ethics or standards of practice,

i) fixing and regulating the quorum, time, place, calling, conduct and business of annual, special and general meetings of the College, the Council and committees of the College or the Council, establishing the method of voting by any means and establishing the qualifications of persons entitled to vote at the meetings,

j) developing, establishing, maintaining and admin ‐ istering

i) standards for education programs leading to registration and for continuing education, profes ‐ sional development and the participation therein of osteopaths, (

PART 3 REGISTRATION

(iii) to enter into partnership, consolidate or merge with or purchase the assets of another corpo‐ ration or individual rendering the same type of pro ‐ fessional services. d) in its absolute discretion at any time after the receipt of a complaint if it considers it necessary or advisable, may without hearing order any registrant to produce records and documents of any kind, written or recorded in any format or by any means including clinical, therapeutic, administrative and financial re ‐ cords and documents in the registrant’s possession or custody or under the registrant’s control, or in the possession or custody or control of any professional corporation of which the registrant is a director, offi ‐ cer or shareholder, and if a registrant fails to produce such records and documents, the Hearing Committee may without further notice suspend the registrant’s registration or licence until the registrant does so, un ‐ less the registrant is prohibited by law from producing such records and documents, and

tice suspend the registrant’s or professional corpora ‐ tion’s registration or licence until the registrant or professional corporation does so. 39(8) Any person who conducts an examination under this

section shall prepare and sign an examination report containing the findings of the examination and the facts on which they are based and shall deliver the report to the Hearing Committee, a copy of which shall be forth ‐ with delivered to the registrant who is the subject of the complaint, and such report is admissible as evidence at a hearing without proof of its making or of the person’s signature if the person introducing the report gives the registrant a copy of the report at least ten days before the hearing. 39(8) Toute personne qui effectue un examen régi par le présent
