B.C. Reg. 35/2026 , deposited March 16, 2026, under the PASSENGER TRANSPORTATION ACT [sections 53, 59, 59.01, 59.2, 59.3, 59.4 and 59.5]. Order in Council 82/2026, approved and ordered March 16, 2026.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Passenger Transportation Regulation, B.C. Reg. 266/2004, is amended as set out in the attached

Schedule 1,

(

b) effective September 1, 2026, the Passenger Transportation Regulation is amended as set out in the attached

Schedule 2, and

(

c) effective September 1, 2027, the Passenger Transportation Regulation is amended as set out in the attached

Schedule 3.

Schedule 1

Section 7.1 of the Passenger Transportation Regulation, B.C. Reg. 266/2004, is amended

(

a) in subsection (1) (

d) by striking out " by persons who use mobility aids ", and

(

b) in subsection (3) by adding the following paragraph:

(

d) persons who are or may be driving accessible passenger directed vehicles.

Part 6 is amended by adding the following section:

Payments from registrar

Section 24.3 is amended

(

a) in subsection (2) by striking out " the number of trips taken, during each instalment period, in motor vehicles that are not accessible passenger directed vehicles " and substituting " the number of trips taken during each instalment period ", and

(

b) by repealing subsection (4) (

a) and substituting the following:

(

a) a trip

(

i) begins when a passenger enters the vehicle,

(ii) continues for the period that the vehicle is continuously occupied or, if all passengers temporarily exit the vehicle, held for the passengers, and

(iii) ends when all passengers exit the vehicle at the final destination, and .

Schedule 2

Section 12.6 (1) of the Passenger Transportation Regulation, B.C. Reg. 266/2004, is amended

(

a) in the definition of "driving record check" by striking out "

section 12.61 (b) " and substituting "

section 12.61 (a) (ii) ", and

(

b) in the definition of "police record check" by striking out "

section 12.61 (a) " and substituting "

section 12.61 (a) (i) ".

Section 12.61 is repealed and the following substituted:

Record checks for drivers of passenger directed vehicles

12.61 A person must not drive a passenger directed vehicle under a licence unless all of the following conditions are met:

(

a) for the purposes of

section 42.2 (1) (a) [prescribed record checks required for drivers of passenger directed vehicles] of the Act, the person has obtained both of the following:

(

i) a police record check in the form of a police information check, with vulnerable sector screening, obtained in accordance with

section 12.62 (1) to (3) of this regulation;

(ii) a driving record check obtained in accordance with

section 12.62 (1), (4) and (5) of this regulation;

(

b) the person has a valid record check certificate.

Section 12.62 (5) is amended by striking out " The results of a driving record check " and substituting " A driving record check ".

Section 12.68 is amended by adding the following paragraph:

(d.1) the date on which the record check certificate was issued; .

section is added:

Issuing record check certificates

12.681

(1) A licensee must not issue a record check certificate to a person unless

(

a) the police record check and driving record check for the person were conducted no more than 3 months before the record check certificate is issued, or

(

b) the licensee is authorized to issue the record check certificate under

section 42.21 (4) [review of acquired record or results of prescribed record checks] of the Act.

(2) If a person acquires a record that includes a matter, whether or not a prescribed matter, after the prescribed record checks were conducted but before the licensee issues a record check certificate to that person,

(

a) the person must, as soon as practicable, notify the licensee of the new record, and

(

b) the licensee must not issue a record check certificate to the person unless the person provides a new police record check or driving record check, whichever applies to the matter.

Section 12.69 is repealed and the following substituted:

Expiry date of record check certificate

12.69

(1) A record check certificate expires 2 years from the anniversary of the certificate holder’s birth that occurs nearest to the date on which the record check certificate was issued.

(2) Despite

section 12.68 (d.1) and subsection (1) of this section, a record check certificate issued before the date that this subsection comes into force

(

a) is not required to set out in it the date on which the record check certificate was issued, and

(

b) expires on the date stated on the record check certificate.

Section 12.7 is amended by striking out " must notify a person, in writing, " and substituting " must notify a person, promptly and in writing, ".

Section 12.71 is repealed.

Schedule 3

Section 12.69 (2) of the Passenger Transportation Regulation, B.C. Reg. 266/2004, is repealed.
