An Act to Amend the Family Services Act Loi modifiant la

Section 1 of the Family Services Act,

chapter F- 2.2 of the Acts of New Brunswick, 1980, is amended 1 L’article 1 de la

a) by adding the following definition in alphabeti- cal order:

Section 48 of the Act is amended 4 L’article 48 de la Loi est modifié (

a) in subsection (1) by striking out “unless the child has been placed for adoption or”;

Section 70 of the Act is amended 6 L’article 70 de la Loi est modifié (

a) by repealing paragraph (b );

Section 73 of the Act is repealed and the following is substituted: 9 L’article 73 de la Loi est abrogé et remplacé par ce qui suit : 73(1) Subject to subsections (2) and (4), no person shall place a child for the purposes of adoption with someone other than a member of the child’s immediate family un- less the person notifies the Minister by registered mail at least sixty days before the placement, stating the child’s name and birth date, the name and address of the prospec- tive adopting parent and the address where the child re- sides. 73(1)

Sous réserve des paragraphes (2) et (4), nul ne peut placer un enfant en vue de l’adoption auprès d’une per- sonne qui n’appartient pas à la proche famille de l’enfant à moins d’avoir donné au Ministre, par courrier recom- mandé et au moins soixante jours avant le placement, un avis indiquant le nom et la date de naissance de l’enfant, le nom et l’adresse de l’adoptant possible ainsi que l’adresse où réside l’enfant. 73(2) Subject to subsection (4), in the case of a child who is not yet born, if a person intends to place the child after his or her birth with someone other than a member of the child’s immediate family, the person shall notify the Min- ister by registered mail at least sixty days before the placement, stating the name and address of the child’s mother, the expected birth date of the child and the name and address of the prospective adopting parent. 73(2)

Section 74 of the Act is repealed and the following is substituted: 10 L’article 74 de la Loi est abrogé et remplacé par ce qui suit : 74(1) On receiving a notification referred to in

section 73, unless an adoption assessment report of the adopting parent, dated less than one year earlier, is on file, the Min- ister shall conduct an assessment of the adoption place- ment and may contract with a community social service agency approved under paragraph 3(1)(b.1) to conduct the assessment and provide an adoption assessment report. 74(1)

section 73 and the residential address of the prospective adopting parent is outside the Province but in Canada, the Minister shall notify the adoption authority in the juris- diction of the prospective adopting parent and shall rec- ommend that a risk assessment of the adoption placement be conducted, if no assessment has yet been conducted. 74.1 Lorsque le Ministre reçoit l’avis prévu à l’article 73 et que l’adresse de résidence de l’adoptant possible se situe à l’extérieur de la province mais à l’intérieur du Canada, le Ministre en informe l’autorité compétente du ressort d’où l’adoptant possible est ressortissant et recom- mande que soit effectuée une évaluation des risques du

Section 75 of the Act is amended 12 L’article 75 de la Loi est modifié (

a) by repealing subsection (2) and substituting the following:

a) par l’abrogation du paragraphe (2) et son rem- placement par ce qui suit : 75(2) Where a child has been placed for adoption by the Minister, the Minister may apply to the court for an adop- tion order effecting the adoption of the child by the adopt- ing parent with whom the child was placed, unless the court has granted a right of access to the child to a person. 75(2) Lorsque le Ministre a placé un enfant en vue de l’adoption, le Ministre peut demander à la cour de rendre une ordonnance d’adoption prononçant l’adoption de l’en- fant par l’adoptant auprès duquel l’enfant a été placé, sauf si la cour a accordé à une personne un droit de visite de l’enfant. Section 76 of the Act is amended 13 L’article 76 de la Loi est modifié (

a) by repealing subsection (2) and substituting the following:

a) par l’abrogation du paragraphe (2) et son rem- placement par ce qui suit : 76(2) Where the child to be adopted is a ward of, in the custody of, or in the guardianship of a representative of the government of any other jurisdiction or any other agency or person having authority to consent to the adoption of the child, the consent of the representative, person or agency is required before an adoption order is made and, despite subsection (1), the consent of the parent is not re- quired if the consent would not have been required if the child were to be adopted in that jurisdiction. 76(2) Lorsque l’enfant à adopter est le pupille d’un re- présentant du gouvernement de tout autre ressort ou de tout autre organisme ou de toute autre personne ayant l’autorité pour consentir à l’adoption de l’enfant, ou est sous leur garde ou tutelle, le consentement du représentant, de l’or- ganisme ou de la personne en cause est requis avant qu’une ordonnance d’adoption ne soit rendue.

a) the minimum fine that may be imposed is the minimum fine set by the Provincial Offences Procedure Act multiplied by the number of days during which the offence continues, and

v) by striking out “and a delay in securing a home for the child would be det- rimental to the best interests of the child, or” and substituting a comma;
