Order in Council 583/2024
On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:
Whereas the Ministry of Labour, Immigration, Training and Skills Development established a process for persons to apply for licences to operate as a temporary help agency and licenses to act as a recruiter under sections 74.1 and 74.1.3 of the Employment Standards Act, 2000 and through this process, certain applications for licences were received;
And
whereas during the period commencing July 5, 2023 and ending December 8, 2023, in accordance with
section 3 of Ontario Regulation 99/23, persons who submitted applications for both a licence to operate as a temporary help agency and a licence to act as a recruiter were required to pay the prescribed fee of $750 for each application submitted;
And
whereas Ontario Regulation 99/23 was amended so that persons who submit applications for both a licence to operate as a temporary help agency and a licence to act as a recruiter will be required to pay the prescribed fee of $750 for the first application but will be exempt from paying the prescribed fee of $750 for the second application;
And
whereas the President of the Treasury Board recommends, and the Lieutenant Governor in Council concurs, that it is in the public interest to remit one of the $750 fees paid by each person who, during the period commencing July 5, 2023 and ending December 8, 2023, was required to pay a prescribed fee for each licence application submitted and a decision is pending about both applications, such remission of fees not to exceed $60,000;
Therefore , pursuant to
section 5.1 of the Financial Administration Act , the remission of fees in the amount of $750 is granted to each person who meets all of the following conditions:
during the period commencing July 5, 2023 and ending December 8, 2023, the person applied for both a licence to operate as a temporary help agency and a licence to act as a recruiter, and was required to pay a prescribed fee of $750 for each application submitted; and
a decision is pending about both applications on the date this Order in Council is approved and ordered.
