Insurance Act
INSURANCE AGENTS AND ADJUSTERS
AMENDMENT REGULATION

section 498 of the Insurance Act.
1 The Insurance Agents and Adjusters Regulation
(AR 122/2001) is amended by this Regulation.
Section 1(4) is repealed and the following is substituted:
(4) Without limiting the generality of
section 5(1)(
f) or (2)(
d) and
subject to subsection (4.1), an individual is deemed to be in a
position to use coercion or undue influence in order to control, direct
or secure insurance business if the individual is an officer, employee
or independent contractor of a deposit-taking institution and has
access to the financial information of the clients of the deposit-taking
institution.
(4.1) Subsection (4) does not apply if the individual is
(
a) an officer, employee or independent contractor of a special
purpose trust company within the meaning of the Loan and
Trust Corporations Act or sales finance company, or
(
b) acting under a restricted certificate.
Section 5 is amended
(
a) in subsection (1)
(
i) in clause (
b) by striking out "mentally competent"
and substituting "of good character";
(ii) in clause (
d) by striking out "convicted" and
substituting "found guilty";
(
b) in subsection (2)
(
i) in clause (
b) by striking out "mentally competent"
and substituting "of good character";
(ii) in clause (
e) by striking out "convicted" and
substituting "found guilty";
(
c) by adding the following after subsection (2):
(3) For the purpose of determining if the requirements in
subsection (1)(
b) to (
d) or (2)(
b) and (
e) are met, the individual
must
(
a) disclose whether the individual is being or has been
investigated under the Insurance Act or any regulatory,
ethical or professional governance enactment in Alberta
or another jurisdiction,
(
b) disclose whether the individual has been subject to
disciplinary action under the Insurance Act or any
regulatory, ethical or professional governance
enactment in Alberta or another jurisdiction,
(
c) provide information respecting conduct by the
individual that a governing body of a regulated
profession or occupation in Alberta or another
jurisdiction has found to be unprofessional or unethical,
including information respecting the nature and scope of
the conduct, and
(
d) provide information respecting any condition or
limitation currently imposed on the individual's
certificate of authority in Alberta or an equivalent
instrument issued in another jurisdiction, including
information respecting the nature, scope and
requirements of any condition or limitation.
Section 6(1)(
b) and (2)(
a) are amended by striking out
"convicted" and substituting "found guilty".
5 Sections 8(1) and (3) and 9(1), (3) and (4) are amended by
striking out "apply for" and substituting "obtain".
Section 21 is amended
(
a) in subsection (1)
(
i) in clause (
b) by striking out "mentally competent"
and substituting "of good character";
(ii) in clause (
d) by striking out "convicted" and
substituting "found guilty";
(
b) in subsection (2)
(
i) in clause (
b) by striking out "mentally competent"
and substituting "of good character";
(ii) in clause (
c) by striking out "convicted" and
substituting "found guilty";
(
c) by adding the following after subsection (2):
(2.1) For the purpose of determining if the requirements in
subsection (1)(
b) to (
d) or (2)(
b) and (
c) are met, the individual
must
(
a) disclose whether the individual is being or has been
investigated under the Insurance Act or any regulatory,
ethical or professional governance enactment in Alberta
or another jurisdiction,
(
b) disclose whether the individual has been subject to

d) in subsection (3)(

substituting "found guilty".
Section 22(1), (3) and (5) are amended by striking out
"apply for" and substituting "obtain".
Section 29 is amended
(
a) by repealing subsection (1);
(
b) in subsections (2), (2.1) and (2.3) by striking out
"Accreditation Committee" and substituting "Alberta
Insurance Council".
Section 36.2 is amended
(
a) in subsection (1)(
a) by striking out "or to the
Accreditation Committee";
(
b) in subsections (2) and (3) by striking out "or the
Accreditation Committee, as the case may be,".
Section 36.3 is amended
(
a) in subsection (1) by striking out "or the Accreditation
Committee, as the case may be," wherever it occurs;
(
b) in subsection (2) by striking out "by the Minister's
department, the Alberta Insurance Council, or the
Accreditation Committee, as directed by the Minister" and
substituting ", as directed by the Minister, by the
Minister's department or the Alberta Insurance Council".
11 Sections 8, 9 and 10 come into force on December
31, 2025.

Alberta Regulation 225/2025
Insurance Act
INSURANCE COUNCILS AMENDMENT REGULATION

section 498 of the Insurance Act.
1 The Insurance Councils Regulation (AR 126/2001) is
amended by this Regulation.
2 Sections 3(c)(ii), 4(c)(ii) and 5(
b) are amended by striking
out "the 5 years before" and substituting "a cumulative total of 5
years in the 7 years immediately preceding".
Section 8 is amended
(
a) by repealing subsection (3) and substituting the
following:
(3) An individual must not be appointed or elected to a council
for a term that would result in the individual serving as a
member of the council for more than 12 consecutive years.
(
b) in subsection (4) by striking out "2 consecutive terms"
and substituting "12 consecutive years";
(
c) by adding the following after subsection (4):
(5) Breaks in service of less than 2 years are disregarded in
determining the number of consecutive years for the purposes
of subsections (3) and (4).
(6) Notwithstanding subsection (3), when a member's term
expires, the member continues to hold office until one of the
following occurs:
(
a) the member is reappointed or re-elected;
(
b) a successor is appointed or elected;
(c) 12 months have elapsed.
Section 10(3) is amended by striking out "and the
Accreditation Committee".
Section 18(2) is repealed and the following is
substituted:
(2) The Alberta Insurance Council must pay
(
a) to panel members the remuneration, fees and expenses
referred to in subsection (1), and
(
b) the administrative expenses of the Appeal Board, including
legal fees of the Appeal Board.
Section 34 is amended
(
a) in subsection (4) by striking out "the remainder of the
former member's term" and substituting "3 years
effective from the date of the declaration";
(
b) in subsection (5) by striking out "and the declaration
occurs with more than 187 days remaining in the term of the
former member, the term of the individual is the remainder of
the former member's term" and substituting ", the term of
the individual is 3 years effective from the date of the
declaration";
(
c) by repealing subsection (6);
(
d) in subsection (7) by striking out ", (5) or (6)" and
substituting "or (5)".
Section 37 is amended by striking out "April 30, 2026" and
substituting "April 30, 2031".
Section 4 comes into force on December 31, 2025.

AMENDMENT REGULATION

(AR 117/2014) is amended by this Regulation.

3 This Regulation comes into force on December 31, 2026.

AUTOMOBILE INSURANCE PREMIUMS
AMENDMENT REGULATION

1 The Automobile Insurance Premiums Regulation
(AR 117/2014) is amended by this Regulation.
Section 1 is amended
(
a) in clause (
b) by striking out "598(a)" and
substituting "549(b.1)";
(
b) by repealing clauses (
c) and (d);
(
c) in clause (
f) by striking out "insurance provided for
under sections 571 and 573" and substituting "insurance
coverage required or provided for under sections 571, 573
and 585.1";
(
d) by repealing clause (h);
(
e) by repealing clauses (
n) and (
o) and substituting
the following:
(n) "rating program" means
(
i) the rules, criteria, policies, guidelines, algorithms
and rating variables used by an insurer to
determine premiums for basic coverage or
additional coverage, and
(ii) the underwriting rules that govern the decision by
an insurer to accept or decline a risk, coverage or
endorsement.
Section 2 is amended
(
a) by adding the following after subsection (1):
(1.1) Subsection (1) does not apply to any premium charged or
collected by an insurer in respect of a fleet contract of
automobile insurance.
(
b) in subsection (2) by striking out "rating variable" and
substituting "component".
Section 9 is amended
(
a) in subsection (4) by striking out "insurers, the
consumer representative" and substituting "insurers";
(
b) in subsection (6)
(
i) in clause (
b) by striking out "the consumer
representative" and substituting "consumer
perspectives";
(ii) in clause (
c) by striking out "industry, the
consumer representative" and substituting
"industry";
(
c) by repealing subsection (7).
Section 11 is amended by adding the following after
subsection (2):
(3) An insurer that contravenes or fails to comply with subsection
(1) is guilty of an offence.

Section 17.1 is amended

a) in subsection (1) by adding the following after
clause (g):
(g.1) Health Quality Council of Alberta Act;
(
b) by adding the following after subsection (5):
(6) The responsibility for that part of the public service
associated with the parts of the appropriation transferred under
subsection (7) is transferred to the Minister of Primary and
Preventative Health Services.
(7) The responsibility for the administration of the unexpended
balance of program 11, Health Quality Council of Alberta, of the
2025-26 Government appropriation for Hospital and Surgical
Health Services is transferred to the Minister of Primary and
Preventative Health Services.

REAL PROPERTY GOVERNANCE REGULATION
