An Act to Amend the Coroners Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1 The Coroners Act,

chapter C-23 of the Revised Stat- utes, 1973, is amended by adding after

section the fol- lowing: 7.1(1) Where an individual dies as a direct result of an accident or other incident which occurred in the course of his or her employment or occupation, the employer and the physician who signs the deceased’s death certificate shall, severally, immediately notify a coroner. 7.1(2) Upon receiving notification under subsection (1) the coroner shall hold an inquest. 7.1(3) Where the coroner becomes aware of a death which was, in the coroner’s opinion, likely a direct result of an accident or other incident which occurred in the course of the deceased’s employment or occupation, but the coroner has not received notice from the employer or attending physician, the coroner shall investigate the death to determine whether it falls within the scope of sub- section (1), and (

a) if the coroner finds that the death occurred as a di- rect result of an accident or other incident in the course of the deceased’s employment or occupation, the coro- ner shall hold an inquest; or PROJET DE LOI Loi modifiant la

chapitre C-23 des Lois révi- sées de 1973, est modifiée par l’adjonction, après l’arti- cle 7, de ce qui suit : 7.1(1) Lorsqu’une personne décède en raison d’un acci- dent ou d’un autre incident qui est survenu lors de son em- ploi ou de son occupation, l’employeur et le médecin qui signe le certificat de décès devront, et de façon indépen- dante, en aviser le coroner immédiatement. 7.1(2) Lorsqu’il reçoit un avis en vertu du paragraphe (1), le coroner doit tenir une enquête judiciaire. 7.1(3) Lorsque le coroner apprend qu’une mort est pro- bablement, selon le coroner, survenue en raison d’un acci- dent ou d’un autre incident qui est survenu de l’emploi ou de l’occupation de la personne décédée mais n’a reçu aucun avis de l’employeur, le coroner doit faire enquête sur le décès afin de déterminer s’il correspond aux cir- constances prévues au paragraphe (1) et

a) si le coroner conclut que la mort est un résultat di- rect d’un accident ou d’un incident qui a eu lieu dans le cours de l’emploi ou de l’occupation de la personne dé- cédée, le coroner doit tenir une enquête judiciaire; ou Projet de loi Loi modifiant la

b) if the coroner does not find that the death oc- curred as a direct result of an accident or other incident in the course of the deceased’s employment or occupa- tion, the coroner shall conduct himself or herself in a manner consistent with this Act.
