On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective May 1, 2026, the Provincial Court Family Rules, B.C. Reg. 120/2020, is amended as set out in the attached Schedule.

Schedule
1 Rule 2 (1) of the Provincial Court Family Rules, B.C. Reg. 120/2020, is amended
(
a) by repealing the definition of "family justice registry" , and
(
b) in the definition of "needs assessor" by striking out " or 93 [participating in needs assessment in family justice registries] ".
2 Rule 6 is amended
(
a) by repealing paragraph (
a) and substituting the following:
(
a) a registry listed in Appendix 1 is an early resolution registry for the purposes of
Part 2 [Early Resolution Registries] , ,
(
b) by repealing paragraph (b), and
(
c) in paragraph (
c) by striking out " and family justice registries ".
3 Rule 9 is repealed and the following substituted:
Early resolution registry
9 The rules set out in this Part apply in early resolution registries.
4 Rule 37 is amended by striking out " Subject to rules 39 [requirements to be met before scheduling family management conference in family justice registry] and 40 " and substituting " Subject to rule 40 ".
5 Rule 38 is amended by striking out " Subject to rules 39 [requirements to be met before scheduling family management conference in family justice registry] and 40 " and substituting " Subject to rule 40 ".
6 Rules 39, 49 (b), 66 (
b) and 75 (
b) are repealed.
Part 6 is repealed.
8 Rule 97 is repealed and the following substituted:

Part
97 The rules set out in this Part apply to all registries other than early resolution registries.
9 The following heading is added to
Part 13 before rule 195:
Division 1 – Former Rules .
10 Rule 195 is amended by striking out " In this Part " and substituting " In this Division ".
11 The following Division is added to
Part 13:
Division 2 – Former Family Justice Registries
Definitions
199 In this Division:
"effective date of this Division" means May 1, 2026;
"family justice rules" means rule 39 and every rule in
Part 6, as those rules read immediately before the effective date of this Division;
"former family justice registry" means
(
a) effective November 1, 2025, the Vancouver (Robson Square) registry,
(
b) effective May 1, 2026, the Kelowna registry, and
(
c) effective May 1, 2026, the Nanaimo registry.
Continued application of rules respecting family justice registries
(1) The family justice rules continue to apply in relation to a family law matter started in a former family justice registry.
(2) Form 21, as it read immediately before the effective date of this Division, may continue to be used in relation to a family management conference for a case in a former family justice registry on the effective date of this Division.
12 The Appendix is renumbered as Appendix 2.
