Section 1 of the Act is amended 2 L’article 1 de la Loi est modifié (

a) by repealing the definition “Appeals Tribunal” and substituting the following:

Section 15 of the Act is amended 10 L’article 15 de la Loi est modifié (

a) in subsection (1) by repealing the portion pre- ceding paragraph (

a) and substituting the following:

Section 16 of the Act is amended 11 L’article 16 de la Loi est modifié (

Section 20 of the Act is repealed and the following is substituted: 14 L’article 20 de la Loi est abrogé et remplacé par ce qui suit : 20(1) There is established an appeals tribunal called the Workers’ Compensation Appeals Tribunal. 20(1) Est constitué le Tribunal d’appel des accidents au travail. 20(2) The Appeals Tribunal shall consist of 20(2) Le Tribunal d’appel se compose : (

a) a Chairperson who serves as a full-time member, and

Remuneration and expenses Rémunération et remboursement des frais 20.3(1) The members of the Appeals Tribunal are enti- tled to be paid the remuneration fixed by the Lieutenant- Governor in Council. 20.3(1) Les membres du Tribunal d’appel ont le droit de recevoir la rémunération que fixe le lieutenant-gouverneur en conseil. 20.3(2) A member is entitled to be reimbursed for ac- commodation, meal and travel expenses reasonably in- curred in connection with his or her duties on the Appeals Tribunal in accordance with the Board of Management travel policy guidelines, as amended. 20.3(2) Les membres du Tribunal d’appel ont droit au remboursement des dépenses d’hébergement, de repas et de déplacement qu’ils engagent raisonnablement dans le cadre de leurs fonctions en conformité avec la directive sur les déplacements qu’établit le Conseil de gestion, en- semble ses modifications.

Continuation in office Continuation du mandat 20.4(1) Despite subsections 20.1(4) and (5) and subject to

section 20.5, a member of the Appeals Tribunal shall remain in office after the expiry of the member’s term until he or she resigns or is reappointed or replaced. 20.4(1) Par dérogation aux paragraphes 20.1(4) et (5) et sous réserve de l’article 20.5, les membres du Tribunal d’appel demeurent en fonction à l’expiration de leur man- dat jusqu’à leur démission, leur remplacement ou la re- conduction de leur mandat. 20.4(2) If a Vice-Chairperson of the Appeals Tribunal resigns or is replaced, the Chairperson of the Appeals Tri- bunal may authorize that person to carry out and complete the duties and exercise any powers that the person would have had, if the person had not ceased to be a member, in connection with any matter in respect of which there was a hearing in which the person participated as a member. 20.4(2) Le président du Tribunal d’appel peut autoriser le vice-président qui démissionne ou qui est remplacé à demeurer en poste pour accomplir et mener à leur terme les obligations et exercer les pouvoirs dont il aurait pu jouir s’il n’avait pas cessé d’être membre du Tribunal d’appel relativement à toute affaire liée à une audience à laquelle il a participé à ce titre. 20.4(3) An authorization under subsection (2) continues until a final decision in respect of the matter is made. 20.4(3) L’autorisation prévue au paragraphe (2) est pro- rogée tant que n’a pas été rendue une décision définitive en l’espèce. 20.4(4) If a person performs duties or exercises powers under subsection (2),

Removal from office Destitution 20.5 The appointment of the Chairperson or a Vice- Chairperson of the Appeals Tribunal may be revoked by the Lieutenant-Governor in Council for cause. 20.5 Le lieutenant-gouverneur en conseil peut révoquer pour motif valable la nomination du président du Tribunal d’appel ou de l’un quelconque des vice-présidents.

Vacancy or temporary absence Vacance ou absence temporaire 20.6(1) A vacancy on the Appeals Tribunal does not impair the capacity of the Appeals Tribunal to act. 20.6(1) Une vacance au sein du Tribunal d’appel ne porte pas atteinte à sa capacité d’agir. 20.6(2) If a vacancy occurs on the Appeals Tribunal, the Lieutenant-Governor in Council may appoint a person to fill the vacancy for the balance of the term of the Chair- person or Vice-Chairperson replaced. 20.6(2)

Powers of the Appeals Tribunal Pouvoirs du Tribunal d’appel 20.7(1) Subject to this Act and the regulations, the Ap- peals Tribunal, with respect to its objects, has the capacity, rights, powers and privileges of a natural person, including the power to 20.7(1)

b) acquire and hold assets and property, both real and personal, by way of purchase, lease, grant, hire, ex- change or otherwise and to dispose of such property by any means,

d) establish forms, practices and procedures for the efficient conduct of appeals to the Appeals Tribunal and for the effective operation of the Appeals Tribunal, and

e) do such things as are incidental or necessary to the exercise of the powers referred to in paragraphs (
