An Act to Amend the Tobacco Tax Act Loi modifiant la Loi de la taxe sur le tabac Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative du Nouveau-Brunswick, édicte : 1

Section 2 of the Tobacco Tax Act,

chapter T-7 of the Revised Statutes, 1973, is amended 1 L’article 2 de la Loi de la taxe sur le tabac, chapi- tre T-7 des Lois révisées de 1973, est modifié (

a) in subsection (4.1) by striking out “terms and conditions established in accordance with the regu- lations” and substituting “terms and conditions es- tablished in accordance with the regulations, in addi- tion to those that may be imposed under

section 2.11”;

a) au paragraphe (4.1) , par la suppression de « des modalités et conditions établies conformément aux règlements » et son remplacement par « des modali- tés et des conditions établies conformément aux règle- ments, en plus de celles dont il peut l’assortir en vertu de l’article 2.11 »; (

b) in subsection (4.2) by striking out “terms and conditions established in accordance with the regu- lations” and substituting “terms and conditions es- tablished in accordance with the regulations, in addi- tion to those that may be imposed under

a) the installation of security devices and structures to protect tobacco inventories,

an Act of the Legislature or

an Act of the Parliament of Canada in force for bankrupt or insolvent debtors or has made any proposal, assign- ment for the benefit of creditors or arrangement with its creditors. 7.2 Le vendeur en gros qui apprend qu’un vendeur au détail est devenu failli ou insolvable, qu’il a invoqué une loi de la Législature ou une loi du Parlement du Canada qui est en vigueur pour les débiteurs faillis ou insolva- bles ou encore qu’il a présenté une proposition ou opéré une cession au profit de ses créanciers ou conclu un ar- rangement avec eux en donne aussitôt avis par écrit au Ministre. 5

Section 11 of the Act is amended by adding after subsection (2) the following: 5 L’article 11 de la Loi est modifié par l’adjonction de ce qui suit après le paragraphe (2) : 11(3) A person who holds both a wholesale vendor’s licence and a retail vendor’s licence shall keep distinct and clearly separated records that allow for the identifi- cation of the licence under which each purchase and sale of tobacco is undertaken. 11(3) La personne qui est à la fois titulaire d’une li- cence de vendeur en gros et d’une licence de vendeur au détail tient des registres distincts et nettement séparés permettant de déterminer la licence en vertu de laquelle ont été réalisés chaque vente et chaque achat de tabac. 6

Section 21.9 of the Act is repealed and the follow- ing is substituted: 6 L’article 21.9 de la Loi est abrogé et remplacé par ce qui suit : 21.9(1) Subject to subsection (2), the amount of an ad- ministrative penalty for a violation of or failure to com- ply with a provision listed in Column I of

Schedule B is as follows: 21.9(1)

c) for a third or subsequent violation of or failure to comply with the same provision, a sum equal to the maximum administrative penalty listed beside it in Column II of

Schedule B.
