Noonan’s Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 22nd day of September, A.D., 1976, pursuant to

Section 5(1) of

Chapter 6 of

the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act , is pleased to

designate as a beach an area of land lying landward from the mean high watermark of Noonan’s

Beach at Eastern Passage, in the County of Halifax, Province of Nova Scotia, as shown outlined

in red on the copy of Crown Land Records Office Plan No. E-7-71, marked

Schedule “B” and

described in

Schedule “A”, both attached to and forming part of the report and

recommendation.

Schedule “A”

All that certain area of land lying landward from the mean high watermark of Noonan’s Beach

at Eastern Passage, in the County of Halifax, Province of Nova Scotia as shown outlined in red

on the copy of Crown Land Records Office Plan No. E-7-71, attached hereto and being more

particularly described as follows:

Beginning at a drill hole in a rock situate at the mean high watermark of Eastern Passage;

From thence (by magnetic bearings of the year 1960) north sixty degrees thirty-five minutes

east along a fence marking the northern boundary of land now or formerly owned by Chester

Tupper, 274 feet to the western boundary of the old highway;

Thence northerly and northwesterly following the western boundary of the old and new

highway to a concrete monument situate where the mean high watermark of Eastern Passage

intersects the western boundary of the old highway;

Thence south sixty degrees thirty-five minutes west, six hundred ninety-five feet to a point

situate in the waters of Eastern Passage;

Thence south twenty-nine degrees twenty-five minutes east, three thousand feet to a point

situate in the waters of Eastern Passage;

Thence north sixty degrees thirty-five minutes east, nine hundred feet to the place of beginning.

Excepting and reserving from the above described area of land all the portion thereof lying

seaward from the mean high watermark.
