An Act to Amend the Motor Vehicle Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

Section 17.1 of the Motor Vehicle Act,

chapter M-17 of the Revised Statutes, 1973, is amended by adding before subsection (4) the following: 17.1(3.2) A peace officer may seize a motor vehi- cle and cause the motor vehicle to be impounded if (

a) the driver of the motor vehicle is unable to present and deliver to the peace officer a motor vehicle liability insurance card under paragraph 28(2)(b), and (

b) the registered owner has been convicted of an offence under subsection (2) within the previ- ous twenty-four months. 2 This Act comes into force on a day to be fixed by proclamation. PROJET DE LOI Loi modifiant la

chapitre M-17 des Lois révisées de 1973, est modifié par l’adjonction, avant le paragraphe (4), de ce qui suit : 17.1(3.2) Un agent de la paix peut saisir et faire mettre en fourrière un véhicule à moteur lorsque les conditions suivantes sont réunies :

a) le conducteur du véhicule à moteur est inca- pable de présenter et de remettre à un agent de la paix une carte d’assurance-responsabilité de vé- hicule à moteur dans le cas prévu à l’alinéa 28(2)b);

b) le propriétaire du véhicule à moteur a été dé- claré coupable d’une infraction au paragraphe (2) au cours des vingt-quatre derniers mois. 2 La présente loi entre en vigueur à la date fixée par proclamation. 3
