His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative du Nouveau-Brunswick, édicte :

Definitions Définitions 1 The following

definitions apply in this Act. 1 Les définitions qui suivent s’appliquent à la présente loi. “artist” means an individual who creates, interprets or performs in an artistic field. (artiste) “artist’s association” means an organization, or any branch or local of the organization, that has among its objectives the promotion or management of the profes ‐ sional, social and economic interests of artists whom are members. (association d’artistes) “artistic field” means (

a) literary arts, (

b) visual arts, (

c) crafts, (

d) music, (

e) theatre, (

f) dance, (

g) performing arts, (

h) media arts, (

i) interdisciplinary arts, or (

j) any other artistic discipline prescribed by regula ‐ tion. (domaine artistique) “engager” means one of the following entities that contracts with or retains the services of one or more pro ‐ fessional artists: (

a) a portion of the public service specified in

Part 1 or

Part 2 of the First

Schedule of the Public Service Labour Relations Act; (

b) an artistic or cultural organization that receives funding from an entity referred to in paragraph (a); or « accord-cadre » S’entend selon la définition que donne de ce terme la

b) ou bien a reçu une formation spécialisée dans sa discipline ou une formation équivalente ou bien pos ‐ sède des connaissances traditionnelles dans cette dis ‐ cipline;

c) est reconnu de ses pairs. ( professional artist) « association d’artistes » Groupement – y compris toute division ou

section locale de celui-ci – ayant parmi ses objets la promotion ou la gestion des intérêts profes ‐ sionnels, sociaux et économiques des artistes qui en sont membres. (artist’s association) « domaine artistique » S’entend de l’une quelconque des disciplines suivantes :

a) les arts littéraires;

b) les arts visuels;

c) les métiers d’art;

d) la musique;

e) le théatre;

c) any other person or organization that receives funding to be used to retain the services of a profes ‐ sional artist from an entity referred to in paragraph (a). (embaucheur) “Minister” means the Minister of Tourism, Heritage and Culture and includes a person designated by the Minister to act on the Minister’s behalf. (ministre) “New Brunswick Lead Artist’s Association” means an artist’s association prescribed by regulation. (princi‐ pales associations d’artistes du Nouveau-Brunswick) “professional artist” means an artist who, in the opin ‐ ion of one of the New Brunswick Lead Artist’s Associa ‐ tions referred to in

section 4, (

a) actively engages, for remuneration, in creation,

interpretation or performance in an artistic field, (

b) has received specialized training in the artist’s discipline or equivalent training, or has traditional knowledge in that discipline, and (

c) is recognized by the artist’s peers. ( artiste pro ‐ fessionnel) “scale agreement” means a scale agreement as defined in the Status of the Artist Act (Canada). (accord-cadre)

b) un organisme artistique ou culturel qui reçoit des fonds d’une entité visée à l’alinéa a);

c) toute autre personne ou tout autre organisme qui reçoit d’une entité visée à l’alinéa a ) des fonds devant être affectés à la rétention des services d’un artiste professionnel. (engager) « ministre » Le ministre du Tourisme, du Patrimoine et de la Culture ou toute personne qu’il désigne pour le représenter. (Minister) « principales associations d’artistes du Nouveau- Brunswick »

b) artists make an important contribution to the cultural, social, economic and educational enrichment of New Brunswick,

c) creative work is a public good contributing to the development and well-being of the community,

d) government has a role in improving the eco ‐ nomic status of professional artists, encouraging the engagement of and promoting professional artists,

e) professional artists have a right to negotiate the retention of their services and their working condi ‐ tions,

f) professional artists merit equitable treatment and have the right to receive fair remuneration for the cre ‐ ation,

interpretation, performance and use of their ar ‐ tistic works, and

g) artist’s associations have a role in the support and promotion of the arts sector.

Accreditation of professional artists Admission des artistes professionnels 4(1) An artist working in New Brunswick may apply to any New Brunswick Lead Artist’s Association for ac ‐ creditation as a professional artist. 4(1) Tout artiste œuvrant au Nouveau-Brunswick peut présenter à l’une quelconque des principales associations d’artistes du Nouveau-Brunswick une demande d’admis‐ sion à

titre d’artiste professionnel. 4(2) Any of the New Brunswick Lead Artist’s Associ ‐ ations may, subject to the regulations, accredit as a pro ‐ fessional artist any artist who satisfies the conditions for accreditation referred to in the definition “professional artist”. 4(2) Chacune des principales associations d’artistes du Nouveau-Brunswick peut, sous réserve des règlements, y admettre à

Contracts Contrats 5(1) No engager, whether operating for profit or as a non-profit, shall without having entered into a written contract retain the services of a professional artist for the following purposes: 5(1) Aucun embaucheur – œuvrant dans un but lucratif ou non – ne peut, sans contrat écrit, retenir les services d’un artiste professionnel aux fins suivantes : (

a) creation or

interpretation of an artistic work or production;

c) participation in an enterprise that circulates or disseminates artistic works to the public, including lending, leasing, exchanging, depositing, exhibiting, publishing, publicly presenting or using in any other similar manner;

d) participation in a peer jury; or

d) la participation à un jury de pairs; (

e) consulting or conference presentation in an artis‐ tic field.

a) incorporate by reference a scale agreement en ‐ tered into under the Status of the Artist Act (Canada), if any, as the Minister considers applicable in the cir ‐ cumstances, and

b) include any other provision prescribed by regu ‐ lation.

a) apply to the parties to the extent that the Minister considers reasonable, but do not apply 5(4) Les dispositions de l’accord-cadre visé à l’ali ‐ néa

a) until April 1, 2027, to a cultural or artistic or ‐ ganization referred to in paragraph (

section shall not be applied so as to deprive a professional artist of a right or benefit that is more fa ‐ vourable to the professional artist than is provided for under a scale agreement. 5(5) Le présent

Advisory committees Comités consultatifs 6 The Minister may establish one or more advisory committees to investigate any matter concerning profes ‐ sional artists that the Minister considers appropriate and to report to the Minister. 6 Le ministre peut constituer un ou plusieurs comités consultatifs chargés d’enquêter sur toute question qu’il juge indiquée intéressant les artistes professionnels ainsi que de lui en faire rapport.

Administration of the Act Application de la Loi 7 The Minister is responsible for the administration of this Act and may designate one or more persons to act on the Minister’s behalf. 7 Le ministre est chargé de l’application de la présente loi et peut désigner une ou plusieurs personnes pour le représenter. Review of the Act Examen de la Loi 8 No later than five years after the commencement of this Act, the Minister shall undertake a review of the op ‐ eration of this Act in consultation with any advisory committee established under

Regulations Règlements 9 The Lieutenant-Governor in Council may make reg ‐ ulations 9 Le lieutenant-gouverneur en conseil peut, par règle ‐ ment : (

a) prescribing artistic disciplines for the purposes of paragraph (

j) of the definition of “artistic field”;

a) prévoir les disciplines artistiques aux fins d’ap ‐ plication de l’alinéa j ) de la définition de « domaine artistique »; (

b) prescribing artist’s associations for the purposes of the definition “New Brunswick Lead Artist’s Asso ‐ ciation”;

b) prescrire les associations d’artistes aux fins d’ap ‐ plication de la définition de « principales associations d’artistes du Nouveau-Brunswick »; (

c) for the purposes of

section 4, specifying criteria to determine whether an artist satisfies the conditions of accreditation referred to in paragraphs (a), (

b) and (

c) of the definition “professional artist” or prescrib ‐ ing any other condition for accreditation;
