FISHERIES (MINISTERIAL) AMENDMENT REGULATION

Made by the Minister of Environment (M.O. 50/99) pursuant to

section 44 of

the Fisheries (Alberta) Act.

1 The Fisheries (Ministerial) Regulation (AR 220/97) is amended by this

Regulation.

Provincial Offences Procedure Act

PROCEDURES AMENDMENT REGULATION

Filed: November 3, 1999

Made by the Lieutenant Governor in Council (O.C. 425/99) pursuant to

section 41 of the Provincial Offences Procedure Act.

1 The Procedures Regulation (AR 233/89) is amended by this Regulation.

Section 13 is repealed and the following is substituted:

Violation ticket

13(1) A violation ticket under

Part 2 of the Act must contain at

least the following elements:

(

a) the following heading:

Province of Alberta

(

b) a reasonably clear description of the defendant to

facilitate identification,

(

c) the offence with which the defendant is charged,

(

d) the date on which the offence is alleged to have

occurred,

(

e) the place at or near which the offence is alleged

to have occurred,

(

f) the manner in which the defendant may respond to

the summons, and

(

g) the consequences to the defendant if the summons is

not responded to by the date indicated.

(2) A violation ticket under

Part 3 of the Act must contain at least

the following elements:

(

a) the following heading:

Province of Alberta

(

b) a reasonably clear description of the defendant to

facilitate identification,

(

c) the offence with which the defendant is charged,

(

d) the date on which the offence is alleged to have

occurred,

(

e) the place at or near which the offence is alleged

to have occurred,

(

the offence notice, and

(

g) the consequences to the defendant if the offence

notice is not responded to by the date indicated.

Schedule 1 is repealed.

Alberta Regulation 228/99

Health Disciplines Act

COMBINED LABORATORY X-RAY TECHNICIAN

AMENDMENT REGULATION

Filed: November 3, 1999

Approved by the Lieutenant Governor in Council (O.C. 428/99) pursuant to

section 27 of the Health Disciplines Act.

1 The Combined Laboratory X-ray Technician Regulation (AR 391/88) is

amended by this Regulation.

Section 1(1) is amended

(

a) by adding the following after clause (a):

(a.1) "College" means the Alberta College of Combined

Laboratory and X-ray Technicians named in an order under

section 7.9(2)(

a) of the Act as the health discipline association to govern combined

laboratory x-ray technicians;

(

b) in clause (

b) by striking out "Act" and substituting

"Regulation";

(

c) by repealing clause (c);

(

d) by adding the following after clause (f):

(f.1) "Registrar" means the Registrar appointed by the

College under

section 7.4 of the Act;

Section 2 is amended

(

a) in the words preceding clause (

a) by striking out "member of

the designated health discipline of";

(

b) by repealing clause (

d) and substituting the following:

(

d) has paid the fees prescribed by the College's

by-laws, and

Section 4(1)(

a) is amended by striking out "registered members" and

substituting "combined laboratory x-ray technicians".

Section 5 is amended

(

a) in subsection (1)

(

i) in the words preceding clause (

a) by striking out

"section 16" and substituting "section 10.1";

(ii) by repealing clause (

b) and substituting the

following:

b) paid the fees prescribed by the

College's by-laws, and

(iii) by repealing clause (c)(iv) and substituting the

following:

(iv) successfully completed any additional

training and examinations required by the Registration Committee under

section 10.1(7)(

a) of the Act within the time specified by the Registration

Committee.

b) in subsection (2)

(

i) by striking out "committee may order an applicant

for renewal to take or pass pursuant to

section 16(4)" and substituting

"Registration Committee may require an applicant for renewal to take or

pass under

section 10.1(7)(a)";

(ii) in clause (

c) by adding "Registration" before

"Committee".

(

c) in subsection (3)

(

i) by striking out "section 16" and substituting

"section 10.1";

(ii) by striking out "January 1" and substituting "March

31".

Section 14 is repealed and the following is substituted:

Governing body

14 For the purposes of

section 7.3(1)(

a) of the Act, the governing

body of the College shall consist of not fewer than 5 combined laboratory

x-ray technicians, together with the members of the public appointed to the

governing body under

section 7.3(1)(

b) of the Act.

Registration Committee

15 The College shall establish a Registration Committee consisting

of the number of combined laboratory x-ray technicians specified by

section

7.5 of the Act.

Conduct and Competency Committee

16 The College shall establish a Conduct and Competency Committee

consisting of the persons specified by

section 7.6(1) of the Act.

Annual report

17 The date on or before which the College is to submit the report

under

section 7.8 of the Act is May 31 of each year.

DESIGNATION AND TRANSFER OF RESPONSIBILITY

AMENDMENT REGULATION

Made by the Lieutenant Governor in Council (O.C. 429/99) pursuant to

section 16 of the Government Organization Act.

1 The Designation and Transfer of Responsibility Regulation (AR 127/99) is

amended by this Regulation.

Section 11 is amended by adding the following after subsection (1.2):

(1.3) The Minister of Infrastructure is designated as the Minister

responsible for the Traffic Safety Act.

Section 16(1)(

c) is repealed.

Marketing of Agricultural Products Act

ALBERTA CHICKEN PRODUCERS FEDERAL AUTHORIZATION ORDER

Filed: November 3, 1999

Approved by the Lieutenant Governor in Council (O.C. 430/99) pursuant to

section 50 of the Marketing of Agricultural Products Act.

Definitions

1 In this Order,

(a) "Commodity Board" means the board known as the Alberta Chicken

Producers;

(b) "Federal Act" means the Agricultural Products Marketing Act

(Canada);

(c) "Federal Order" means the Alberta Chicken Order made under the

Federal Act;

(d) "Marketing Council" means the Alberta Agricultural Products

Marketing Council.

Authorization

2 The Marketing Council hereby authorizes the Commodity Board to perform

all functions and duties and exercise all powers imposed or conferred on

the Commodity Board under the Federal Act and the Federal Order.

Expiry

3 For the purpose of ensuring that this Order is reviewed for ongoing

relevancy and necessity, with the option that it may be repassed in its

present or an amended form following a review, this Order expires on

November 1, 2004.

1 The Forms Regulation (AR 480/81) is amended by this Regulation.

2 Effective July 1, 2000, Form 1 is repealed.

Establishment

1 A regional services commission known as the Lamont County Regional

Solid Waste Commission is established.

Members

2 The following municipalities are members of the Commission:

(

a) County of Lamont;

(

b) Town of Lamont;

(

c) Town of Bruderheim;

(

d) Town of Mundare;

(

e) Village of Andrew;

(

f) Village of Chipman.

Services

3 The Commission is authorized to provide solid waste management

services.

Operating deficits

4 The Commission may not assume operating deficits that are shown on the

books of any of the member municipalities.

Property

5(1) The member municipalities shall execute all documents and do all

things necessary to transfer to the Commission all property listed in the

Schedule to this Regulation.

(2) The Commission may not, without the approval of the Minister, sell any

of its land, buildings or personal property, the purchase of which has been

funded wholly or partly by grants from the Government of Alberta.

(3) The Minister may not approve a sale under subsection (1) unless the

Minister is satisfied

(

a) as to the repayment of grants from the Government of Alberta

and outstanding debt associated with that portion of the land, buildings

and personal property to be sold,

(

b) that the sale would not have a significant adverse effect on

the services the Commission provides, and

(

c) that the sale will be properly reflected in the rates

subsequently charged to the customers of the Commission.

Profit and surpluses

6(1) Unless otherwise approved by the Minister, the Commission must not

(

a) operate for the purposes of making a profit, or

(

b) distribute any of its surpluses to its member municipalities.

(2) The Minister's approval may contain any terms or conditions that the

Minister considers appropriate.
