An Act to Amend the Industrial Relations Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section of the Industrial Relations Act,

chapter I-4 of the Revised Statutes, 1973, is amended by adding after subsection (8.1) the following: 1(9) For the purposes of this Act, where, in the opinion of the Board, associated or related activities or businesses are carried on, whether or not simultaneously, by or through more than one corporation, individual, firm, syn- dicate or association or any combination thereof, under common control or direction, the Board may, upon the ap- plication of any person, trade union or council of trade unions concerned, treat the corporations, individuals, firms, syndicates or associations or any combination thereof as constituting one employer for the purposes of this Act and grant such relief, by way of declaration or otherwise, as it may deem appropriate. 1(10) Where, in an application made pursuant to sub- section (9), it is alleged that more than one corporation, in- dividual, firm, syndicate or association or combination thereof are or were under common control or direction, the respondents to the application shall adduce at the hear- ing all facts within their knowledge that are material to the allegation. 2 This Act comes into force on a day to be fixed by proclamation.

chapitre I-4 des Lois révisées de 1973, est modifié par l’adjonction après le paragraphe (8.1) de ce qui suit : 1(9) Pour l’application de la présente loi, lorsque, de l’avis de la Commission, des activités ou entreprises con- nexes sont menées ou exploitées, simultanément ou non, par tout regroupement homogène ou hétérogène de socié- tés, de particuliers, de firmes, de consortiums ou de grou- pements, ou par son entremise, sous un contrôle commun ou une direction commune, la Commission peut, à la de- mande d’une personne, d’un syndicat ou d’un conseil syn- dical intéressés, considérer pareil regroupement comme ne formant qu’un seul employeur pour l’application de la présente loi et accorder, par déclaration ou autre mesure, la réparation qu’elle juge appropriée. 1(10) Lorsque la demande présentée conformément au paragraphe (9) affirme qu’un regroupement homogène ou hétérogène de sociétés, de particuliers, de firmes, de con- sortiums ou de groupements est ou était sous un contrôle commun ou une direction commune, les intimés à la de- mande doivent présenter à l’audience tous les faits perti- nents connus d’eux. 2 La présente loi entre en vigueur à la date fixée par proclamation.
