OIC Text: The Governor in Council on the report and recommendation of the Minister of Community Services and the Minister of Finance dated June 26, 2008, and pursuant to subsections 8(2) and (5) of

Chapter 5 of the Acts of 1990, the Children and Family Services Act, and to clause 20(b)(

i) of

Chapter 377 of the Revised Statutes of Nova Scotia, 1989, the Public Service Superannuation Act, is pleased to: (

a) approve the dissolution of the Family and Children's Services of Cumberland County and revoke Order in Council 79-204, which approves its constitution and by-laws, and Order in Council 81-112 which approves amendments thereto, effective December 31, 2008; (

b) approve the dissolution of the Family and Children's Services of Kings County, and revoke Order in Council 79-54, which approves its constitution and by-laws, effective December 31, 2008; (

c) approve the dissolution of the Family and Children's Services of Queens County, and revoke Order in Council 79-207, which approves its constitution and by-laws, effective December 31, 2008; (

d) approve the dissolution of the Family and Children's Services of Yarmouth County, and revoke Order in Council 77-617, which approves its constitution and by-laws, effective January 31, 2009; (

e) approve the transfer of the existing pension funds of employees of the Family and Children's Services of Cumberland County, the Family and Children's Services of Kings County, the Family and Children's Services of Queens County, and the Family and Children's Services of Yarmouth County, who opt to transfer these funds to the Public Service Superannuation Plan; and (

f) determine that on, from and after the commencement of employment with the Province of Nova Scotia (the "Employer") of each of the eligible employees of the Agencies (the "Eligible Employee"): (i)\x09all existing contributory service of an Eligible Employee (contributory service being a period or periods during which the Eligible Employee was employed by the Agency or another agency established or continued under the Children and Family Services Act and during which contributions were made to Association of Child Welfare Agencies of Nova Scotia Pension Plan, Policy #35664 (the "Agencies Plan") be deemed eligible service under the Public Service Superannuation Plan for the purpose of determining when that Eligible Employee is eligible to retire under the Public Service Superannuation Plan; and (ii)\x09at the option of each Eligible Employee, the contributory service of the Eligible Employee (contributory service being a period or periods during which the Eligible Employee was employed by the Agency or another agency established or continued under the Children and Family Services Act and during which contributions were made to the Agencies Plan) be deemed pensionable service under the Public Service Superannuation Plan, for the purpose of calculating the amount of a Superannuation Allowance, provided there is paid into the Public Service Superannuation Fund by or on behalf of such Eligible Employee an amount or amounts equal to the actuarial cost of such service as determined by the Minister of Finance and, to the extent the payment into the Public Service Superannuation Fund by or on behalf of an Eligible Employee is less than the actuarial cost of such service, the Eligible Employee be credited a pro-rated portion of pensionable service under the Public Service Superannuation Plan.
