chapter P-7.05 of the Acts of New Brunswick, 2009, is repealed and the following is substituted: 1(1) Le paragraphe 27(2.01) de la

chapter P-22.4 of the Acts of New Brunswick, 1998, is amended by adding after

Section 42.1 of the Act is repealed and the fol- lowing is substituted: 2(2) L’article 42.1 de la Loi est abrogé et remplacé par ce qui suit : 42.1(1) In order to attain proof of immunization for a disease prescribed by regulation, the superintendent of the school district, through the principal of a school, shall require from the parent or legal guardian of a child attending school in the Province for the first time the fol- lowing information: 42.1(1) En vue d’établir la preuve d’immunisation contre toute maladie prescrite par règlement, le directeur général du district scolaire, par l’entremise du directeur d’école, exige du parent ou du tuteur légal de chaque élève qui fréquente une école dans la province pour la première fois qu’il lui fournisse les renseignements ci- dessous au sujet de cet élève : (

a) the name, date of birth and the Medicare number of the child if the principal of the school reasonably believes that the information in respect of the child is included in the immunization registry established by the Minister under

section 42.3, or

b) any other proof of immunization if the principal of the school reasonably believes that the information in respect of the child is not included in the immuni- zation registry established by the Minister under sec- tion 42.3.

a) a medical exemption, on a form provided by the Minister, that is signed by a medical practitioner or nurse practitioner, or

b) a written statement, on a form provided by the Minister and signed by the parent or legal guardian, of his or her objections to the immunizations.

42.1(5) The Minister of Education and Early Child- hood Development shall forward to the Minister any in- formation received under subsection (4). 42.1(5) Le ministre de l’Éducation et du Développe- ment de la petite enfance fait parvenir au ministre tout renseignement qu’il reçoit en application du paragra- phe (4). 42.1(6) After having reviewed the information re- ceived under subsection (4) and the immunization regis- try established by the Minister, the Minister, through the chief medical officer of health or the medical officer of health, shall disclose to the principal of a school the im- munization status of each child. 42.1(6) Après avoir examiné les renseignements reçus en application du paragraphe (4) ainsi que le registre d’immunisation qu’il crée, le ministre, par l’entremise du médecin-hygiéniste en chef ou d’un médecin- hygiéniste, communique au directeur d’école l’état im- munitaire de chaque élève. 2(3) The Act is amended by adding after

section 42.1 the following: 2(3) La Loi est modifiée par l’adjonction de ce qui suit après l’article 42.1 : Notifiable disease registry Registre des maladies à déclaration obligatoire 42.2 The Minister shall establish and maintain a notifi- able disease registry that contains the information pre- scribed by regulation and any other information that the Minister considers necessary. 42.2 Le ministre crée et tient un registre des maladies à déclaration obligatoire renfermant les renseignements prescrits par règlement ainsi que tout autre renseigne- ment qu’il estime nécessaire.

Immunization registry Registre des immunisations 42.3 The Minister shall establish and maintain an im- munization registry that contains the information prescri- bed by regulation and any other information that the Minister considers necessary. 42.3 Le ministre crée et tient un registre d’immunisa- tion renfermant les renseignements prescrits par règle- ment ainsi que tout autre renseignement qu’il estime nécessaire. section 42.2 of the Act, any information received by the Minister under

section 42.01 of the Act shall be recorded in the notifiable dis- ease registry. 18.1 Sont consignés au registre des maladies à déclara- tion obligatoire que crée le ministre en vertu de l’arti- cle 42.2 de la Loi tous les renseignements qui lui sont communiqués en application de l’article 42.01 de celle- ci. Immunization registry Registre d’immunisation 18.2 For the purposes of

section 42.3 of the Act, the following shall be recorded in the immunization regis- try: 18.2 Sont consignés au registre d’immunisation que crée le ministre en vertu de l’article 42.3 de la Loi les renseignements suivants : (

a) any information received by the Minister under subsection 42.1(5) of the Act;

section 13;

c) the following information with respect to an ac- count for service submitted to the Medicare Branch in accordance with subsection 11(2) of General Regula- tion – Medical Services Payment Act for the adminis- tration of a vaccine or biological preparation for a dis- ease prescribed under subsection 12(1) of this Regulation:

Transitional provision Disposition transitoire 4 Any information that is in the care and control of the Minister of Health immediately before the coming into force of this

section that would have been recorded in the notifiable disease registry established under sec- tion 42.2 of the Public Health Act or the immunization registry established under

section 42.3 of the Public Health Act, as the case may be, after the coming into force of this

section shall be deemed to be have been recorded in the respective registry. 4 Sont réputés avoir été consignés au registre des maladies à déclaration obligatoire créé en vertu de l’ar- ticle 42.2 de la
