a) acquire land or an interest in land that is adjacent to the municipality and use the land for the purposes stated,

b) enter into an agreement with one or more munic- ipalities or rural communities or with any person, in- cluding the Crown, where the costs of construction and operation of a generation facility may be shared by the parties to the agreement, and

b) conclure une entente avec une ou plusieurs muni- cipalités ou communautés rurales ou avec toute autre personne, y compris la Couronne, par laquelle les coûts de construction et d’exploitation sont partagés entre les parties à l’entente; (

c) enter into an agreement with one or more munic- ipalities or rural communities or with any person, in- cluding the Crown, to provide for the joint acquisition, ownership, development, extension, management or operation of a generation facility.

c) conclure avec une ou plusieurs municipalités ou communautés rurales ou avec toute autre personne, y compris la Couronne, une entente ayant pour objet la coacquisition, la propriété, l’aménagement, l’agrandis- sement, la gestion ou l’exploitation d’une installation de production. 111.3 A municipality that constructs, owns or operates a generation facility shall establish a generation facility fund. 111.3 La municipalité qui construit une installation de production, ou qui en est le propriétaire ou l’exploitant, doit établir un fonds pour la production d’électricité. 111.4(1) A municipality that operates a generation fa- cility shall annually, on or before the date fixed pursuant to subsection 87(2), submit to the Minister the budget with respect to its operation of the facility for that year. 111.4(1) La municipalité qui exploite une installation de production, doit soumettre au ministre, au plus tard à la date fixée conformément au paragraphe 87(2), un budget annuel relatif à cette activité. 111.4(2) When operating a generation facility, a munic- ipality shall produce, with respect to such operation, 111.4(2) La municipalité qui exploite une installation de production doit, quant à cette exploitation, préparer l’un ou l’autre des budgets suivants : (

a) an annually balanced budget, or

a) un budget annuel équilibré; (

b) a quadrennially balanced budget.

a) it shall cause such deficit to be debited against the budget for that activity for the second next ensuing year, or

b) it shall spread the deficit over a four year period commencing with the second next ensuing year.

a) it shall cause such surplus to be credited to the budget for that activity for the second next ensuing year, or

a) establish, manage and contribute to an operating reserve fund, and

(k.2) respecting agreements under subsection 111.2(3), including the sharing of the cost and other matters related to the construction, ownership or oper- ation of a generation facility and the use or sale of the electricity generated; k.2) concernant les ententes prévues au paragra- phe 111.2(3), notamment le partage des coûts et autres aspects liés à la construction, à la propriété ou à l’ex- ploitation d’une installation de production et à l’utili- sation de l’électricité produite ou la vente de celle-ci; (k.3) respecting the establishment and management of and contributions to an operating reserve fund and a capital reserve fund under

section 11 1.5 and the amounts of each fund; k.3) concernant l’établissement et la gestion des fonds de réserve de fonctionnement et des fonds de ré- serve d’immobilisation prévus à l’article 11 1.5 et les contributions à de tels fonds ainsi que la détermination du montant de ces contributions; 3 This Act comes into force on a day to be fixed by proclamation. 3 La présente loi entre en vigueur au jour fixé par pro- clamation.
