The criteria that must be met before a physician may issue a community treatment order are set out in

section of the Bill (proposed subsection 33.1 (2) of the Act). Community treatment orders may only be issued for persons who, during the three-year period prior to the order, were patients in a psychiatric facility on two or more separate occasions or for a cumulative period of 30 days or more, and who, on examination, have been found to be suffering from mental disorder that if not treated would likely result in the person causing himself, herself or another person serious bodily harm or in substantial mental or physical deterioration of the person or serious physical impairment of the person.

The order must contain a community treatment plan developed by the issuing physician in consultation with others. The person is entitled to legal advice with respect to the order and no such order may be issued unless the person, or his or her substitute decision-maker, consents to the community treatment plan in the order. Once the order is issued the person subject to it is under the obligations set out in subsection 33.1 (6) respecting attendance at appointments with the issuing physician and others providing treatment under the plan and com- pliance with the terms of the order.

Subsections 33.1 (8), (9) and (10) deal with the expiry and renewal of orders. Proposed sections 33.2 , 33.3 and 33.4 deal with specific cir- cumstances in which community treatment orders may be termi- nated before they expire. This may happen pursuant to a request from the person subject to the order, because of a failure to comply with the order on the part of the person or because the person or substitute decision-maker withdraws his or her consent to the com- munity treatment plan.

The new sections 33.5 and 33.6, respec- tively, indicate the responsibilities of the physician who issues a community treatment order and of those persons who provide spe- cific aspects of treatment under the community treatment plan, and provide protection from liability in certain circumstances.

Section 33.7 sets out the minimum contents for community treatment plans.

Section of the Bill (proposed

section 35.1 of the Act) makes it clear that health practitioners and others who provide treatment to a person under a community treatment plan are per- mitted to share with each other information relating to the person for the purpose of providing the treatment.

Section 21 (proposed

section 39.1 of the Act) makes it possible for a person subject to a community treatment order to apply for a review to establish whether the criteria for such an order are met. This entitlement applies each time an order is issued or renewed and is mandatory each time a second renewal is issued. The Bill also facilitates the admission of a person to a psychia- tric facility where the person suffers from a mental disorder for which he or she has been previously treated and as a result of which the person has shown clinical improvement: new subsection 15 (1.1) of the Act.

Subsection 16 (1.1) provides that a justice of the peace may issue an order for a person’s examination by a physician if the criteria set out in the subsection are met, and NOTE EXPLICATIVE Le projet de loi propose d’apporter des modifications à la

Les ordonnances de traitement en milieu communautaire ne peuvent être prises qu’à l’égard des per- sonnes qui, au cours de la période de trois ans qui précède l’ordon- nance, étaient des malades dans un établissement psychiatrique à deux reprises au moins ou pendant une période cumulative d’au moins jours et qui, à la suite d’un examen, ont été reconnues comme étant atteintes de troubles mentaux qui, s’ils ne sont pas traités, auront probablement comme conséquence qu’elles s’infli- geront ou infligeront à d’autres personnes des lésions corporelles graves ou qu’elles subiront une détérioration mentale ou physique importante ou un affaiblissement physique grave.

L’ordonnance doit comprendre un plan de traitement en milieu communautaire élaboré par le médecin qui la prend, en consultation avec d’autres personnes. La personne a le droit d’obtenir des conseils juridiques en ce qui concerne l’ordonnance, et aucune ordonnance ne peut être prise, à moins que la personne, ou son mandataire spécial, ne consente au plan de traitement en milieu communautaire prévu par l’ordonnance.

Une fois que l’ordonnance est prise, la personne visée par celle-ci est tenue de respecter les obligations énoncées au paragraphe 33.1 (6) en ce qui concerne la présence aux rendez- vous chez le médecin qui a pris l’ordonnance et les autres person- nes qui fournissent le traitement prévu par le plan, et en ce qui concerne le respect des conditions de l’ordonnance. Les paragra- phes 33.1 (8), (9) et (10) traitent de l’expiration et du renouvelle- ment des ordonnances.

Les nouveaux articles 33.2, 33.3 et 33.4 traitent des circons- tances particulières dans lesquelles les ordonnances de traitement en milieu communautaire peuvent être révoquées avant leur expira- tion. Leur révocation peut se produire à la suite d’une demande présentée par la personne visée par l’ordonnance, parce qu’elle ne s’est pas conformée à l’ordonnance ou parce qu’elle ou son manda- taire spécial retire son consentement au plan de traitement en mi- lieu communautaire.

Les nouveaux articles 33.5 et 33.6, respective- ment, énoncent les responsabilités du médecin qui prend une ordonnance de traitement en milieu communautaire et des person- nes qui fournissent des aspects particuliers du traitement prévu par le plan de traitement en milieu communautaire, et confèrent l’im- munité dans certaines circonstances. L’article 33.7 énonce les élé- ments minimaux que les plans de traitement en milieu communau- taire doivent comprendre. L’article du projet de loi (nouvel

article 35.1 de la Loi) précise que les praticiens de la santé et les autres personnes qui fournissent à une personne le traitement prévu par un plan de traitement en milieu communautaire sont autorisés à s’échanger des renseignements sur la personne afin de fournir le traitement. L’arti- cle 21 (nouvel

article 39.1 de la Loi) permet à une personne visée par une ordonnance de traitement en milieu communautaire de demander, par voie de requête, une révision afin d’établir si les conditions relatives à une telle ordonnance sont remplies. Ce droit s’applique chaque fois qu’une ordonnance est prise ou renouvelée et est obligatoire chaque fois qu’un deuxième renouvellement est accordé.

Le projet de loi facilite également l’admission d’une personne à un établissement psychiatrique si celle-ci souffre d’un trouble mental pour lequel elle a déjà reçu un traitement par suite duquel elle a connu une amélioration sur le plan clinique de son état : nouveau paragraphe 15 (1.1) de la Loi.

Le paragraphe 16 (1.1) prévoit qu’un juge de paix peut rendre une ordonnance en vue de l’examen d’une personne par un médecin si les conditions énon- ii subsection 20 (1.1) proposes that an attending physician may admit a person as an involuntary patient if, on the basis of an examination of the person, the physician is of the opinion that the criteria stated in the subsection are met. The definition of “treatment” in the Health Care Consent Act, 1996 is expanded to include a community treatment plan.

The rules governing treatment in the Act are thus made applicable to community treatment plans under the Mental Health Act. Other amendments to the Health Care Consent Act, 1996 are related to reducing the possibility of delays that result from ap- plications for hearings before the Consent and Capacity Board and appeals to court which tend to postpone treatment.

These proceed- ings include applications by an incapable person concerning his or her capacity to consent to treatment, for the appointment of a representative to make treatment decisions on the person’s behalf, applications by a substitute decision-maker to determine whether or not the incapable person has prior capable wishes about treat- ment or for authority to depart from the incapable person’s capable wishes, and an application by a health practitioner to determine whether or not a substitute decision-maker is in compliance with the rules for making substitute decisions.

Sections and of the Bill propose that a health practitioner be permitted to make applica- tions concerning the existence of prior capable wishes or that the substitute decision-maker be provided with authority to depart from such wishes, steps which will remove delays related to the substitute decision-maker’s reluctance to bring such applications, and which will allow the health practitioner to resolve any ques- tions relating to prior capable wishes that may limit the ability to provide treatment. Similar amendments are made to parallel provi- sions in

Part III of the Act (Admission to Care Facilities) and

Part IV (Personal Assistance Services.) Furthermore, proposed sections 37.1, 54.1 and 69.1 of the Act will permit the Board to consider the issue of the person’s capacity to consent to treatment, admission to a care facility or a personal assistance service when an application is made concerning such issues.
