On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that,

(

a) effective May 1, 2011, the Employment Standards Regulation, B.C. Reg. 396/95, is amended as set out in Appendix 1 attached,

(

b) effective November 1, 2011, the Employment Standards Regulation, B.C. Reg. 396/95, is amended as set out in Appendix 2 attached, and

(

c) effective May 1, 2012, the Employment Standards Regulation, B.C. Reg. 396/95, is amended as set out in Appendix 3 attached.

Appendix 1

Section 15 of the Employment Standards Regulation, B.C. Reg. 396/95, is repealed and the following substituted:

Minimum hourly wage

15 Subject to sections 16 to 18.1, the minimum wage is $8.75 an hour.

Section 16 is amended

(

a) in subsection (1) by striking out " $80.00 " and substituting " $87.50 ", and

(

b) in subsection (2) by striking out " $64 "and substituting " $70 ".

Section 17 is amended

(

6 The following

section is added to

Part 4:

Minimum wage - liquor servers

18.1

(1) In this section, "liquor server" means an employee

(

a) whose primary duties are as a server of food or drink or both, and

(

b) who, as a regular part of his or her employment, serves liquor directly to customers, guests, members or patrons in premises for which a licence to sell liquor has been issued under the Liquor Control and Licensing Act .

(2) The minimum wage for a liquor server is $8.50 an hour.

Appendix 2

Section 15 of the Employment Standards Regulation, B.C. Reg. 396/95, is amended by striking out " $8.75 "and substituting " $9.50 ".

Section 16 is amended

(

a) in subsection (1) by striking out " $87.50 "and substituting " $95.00 ", and

(

b) in subsection (2) by striking out " $70 "and substituting " $76 ".

Section 17 is amended

(

a) in paragraph (

a) by striking out " $525.00 "and substituting " $570.00 "and by striking out " $21.05 "and substituting " $22.85 ", and

(

b) in paragraph (

b) by striking out " $1 788.28 "and substituting " $1 941.56 ".

Section 18.1 is amended by striking out " $8.50 "and substituting " $8.75 ".

Appendix 3

Section 15 of the Employment Standards Regulation, B.C. Reg. 396/95 is amended by striking out " $9.50 "and substituting " $10.25 ".

Section 16 is amended

Section 17 is amended

(
