B.C. Reg. 206/2023 , deposited September 11, 2023, under the MANUFACTURED HOME PARK TENANCY ACT [section 89] and RESIDENTIAL TENANCY ACT [section 97]. Order in Council 522/2023, approved and ordered September 11, 2023.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Manufactured Home Park Tenancy Regulation, B.C. Reg. 481/2003, is amended as set out in

Schedule 1, and

(

b) the Residential Tenancy Regulation, B.C. Reg. 477/2003, is amended as set out in

Schedule 2.

Schedule 1

1 The Manufactured Home Park Tenancy Regulation, B.C. Reg. 481/2003, is amended by adding the following section:

Exemption from Act for government

2.1 The Act does not apply in relation to a tenancy agreement between the government and a tenant that arises from a lease under

section 11 (2) or 38 of the Land Act .

Schedule 2

1 The Residential Tenancy Regulation, B.C. Reg. 477/2003, is amended by adding the following section:

Exemption from Act for government

1.2 The Act does not apply in relation to a tenancy agreement between the government and a tenant that arises from

(

a) a lease or a licence of occupation under

section 11 (2) of the Land Act ,

(

b) a lease under

section 38 of the Land Act , or

(

c) a licence of occupation under

section 39 of the Land Act .
