The board of the Oil and Gas Commission orders that, effective April 1, 2019, the

Fee, Levy and Security Regulation, B.C. Reg. 8/2014, is amended as set out in the

attached Schedule.

1 The heading to

Part 4 of the Fee, Levy and Security Regulation, B.C. Reg. 8/2014,

is repealed and the following substituted:

Part 4 – Expense Recovery Levies .

2 The following

Part is added:

Part 4.1 – Orphan Site Restoration Levies

Definitions

24.2 In this Part:

"designated permit" means any of the following:

(

a) a facility permit, other than

(

i) an LNG facility permit, and

(ii) a facility permit that includes permission to construct or operate a manufacturing

plant or petroleum refinery;

(

b) a well permit;

"facility permit" has the same meaning as in the Drilling and Production Regulation;

"LNG facility permit" has the same meaning as in the Liquefied Natural Gas Facility Regulation;

"orphan site restoration levy" means a levy under

section 47 of the Act;

"well permit" has the same meaning as in the Drilling and Production Regulation.

Levy imposed

24.3 Permit holders described in column 1 of the table are required to pay an orphan site

restoration levy to the government, apportioned based on their situations on the date

set out in column 2 opposite that description, to raise the amount set out in column

3 opposite that description.

Payment of levy

24.4 A permit holder who is required to pay an orphan site restoration levy must pay the

amount required under

section 47 (2) of the Act within 15 days after receiving an

invoice for that amount from the commission.
