An Act to Amend the Education Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section of the Education Act,

chapter E-1.12 of the Acts of New Brunswick, 1997, is amended by adding the following

definitions in alphabetical order: “bullying” means systematically and chronically in- flicting physical harm or psychological distress on one or more pupils and may involve (

a) teasing, (

b) social exclusion, (

c) threats, (

d) intimidation, (

e) stalking, (

f) physical violence, (

g) theft, (

h) sexual or racial harassment, (

Loi sur l’éducation,

chapitre E-1.12 des Lois du Nouveau-Brunswick de 1997, est modifié par l’insertion des définitions suivantes en ordre alphabétique : « harcèlement » désigne toute forme de menace, d’in- sulte ou de geste avilissant, d’utilisation de données ou de logiciels, de conduite physique ou de propos, à l’oral ou à l’écrit, contre un élève ou un membre du personnel sco- laire, qui

a) suscite chez l’élève ou le membre du personnel scolaire une crainte raisonnable de représailles sur sa personne ou de dommages à ses biens,

b) a pour effet de diminuer sensiblement le rende- ment scolaire, les possibilités ou les avantages de l’élève,

c) perturbe le fonctionnement ordonné de l’école; « intimidation » désigne le fait d’infliger systématique- ment et continuellement des torts physiques ou psycholo- giques à un élève ou plus et peut comprendre

j) destruction of property; “harassment” means any threatening, insulting, or de- humanizing gesture, use of data or computer software, or written, verbal, or physical conduct directed against a pu- pil or school personnel that (

a) places a pupil or school personnel in reasonable fear of harm to his or her person or damage to his or her property, (

b) has the effect of substantially interfering with a pupil's educational performance, opportunities, or ben- efits, or (

c) has the effect of substantially disrupting the or- derly operation of a school; 2 The Act is amended by adding after

section the following: 24.1(1) Bullying and harassment as defined in this Act provide cause for suspension. 24.1(2) Where a pupil is suspended under subsection (1), all reporting and other requirements under

section must be adhered to. 24.1(3) A principal shall in addition to a suspension un- der subsection (1) require one, some or all of the parties involved to participate in educational programs highlight- ing the negative consequences associated with bullying and harassment. 3 This Act comes into force on a day to be fixed by proclamation.

j) a destruction de biens; 2 La Loi est modifiée par l’adjonction de ce qui suit après l’article 24 : 24.1(1) L’intimidation et le harcèlement, tels qu’ils sont définis dans la présente loi, emportent suspension. 24.1(2) Lorsqu’un élève est suspendu conformément au paragraphe (1), tous les rapports et autres exigences pré- vus à l’article de la présente loi doivent être pris en compte. 24.1(3)

Le directeur de l’école exige, en plus de la sus- pension prévue au paragraphe (1), que certaines ou l’en- semble des parties en cause participent à des programmes de sensibilisation aux conséquences néfastes de l’intimi- dation et du harcèlement. 3 La présente loi entre en vigueur à la date fixée par proclamation.
