Schedule are amended as set out in that Schedule.

Schedule

Part 1 – Attorney General Amendments

Family Law Act Regulation

Section 5 (2) (b) (

i) of the Family Law Act Regulation, B.C. Reg. 347/2012, is amended by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Section 6 is amended

(

a) by repealing subsection (1) (

a) and substituting the following:

(

a) the person is

(

i) a member in good standing of an organization referred to in subsection (1.1), or

(ii) authorized under the Health Professions and Occupations Act to practise the designated health profession of psychology, , and

(

b) by adding the following subsection:

(1.1) For the purposes of subsection (1) (a) (i), the person must be a member of one of the following:

(

a) the Law Society of British Columbia;

(

b) the British Columbia College of Social Workers;

(

c) the BC Association of Clinical Counsellors;

(

d) Family Mediation Canada;

(

e) the Mediate BC Family Roster;

(

f) the BC Parenting Coordinators Roster Society.

Government Body Designation (Public Interest Disclosure) Regulation

Section 2 of the Government Body Designation (Public Interest Disclosure) Regulation, B.C. Reg. 58/2022, is amended

(

a) in subsection (1) by adding the following definition:

"licensee" has the same meaning as in the Health Professions and Occupations Act ; ,

(

b) in subsection (1) by repealing the definition of "registrant" ,

(

c) in subsection (1) by repealing paragraph (

a) of the definition of "specified body" and substituting the following:

(

a) a regional health board designated under the Health Authorities Act ; , and

(

d) in subsection (2) (

b) by striking out " registrants " and substituting " licensees ".

Small Claims Rules

4 Rules 7 (12) and (13) and 7.5 (13.1), (13.2) and (14) (

g) of the Small Claims Rules, B.C. Reg. 261/93, are amended by striking out " Health Professions Act " wherever it appears and substituting " Health Professions and Occupations Act ".

Statutory Property Guardianship Regulation

Section 3 of the Statutory Property Guardianship Regulation, B.C. Reg. 115/2014, is repealed and the following substituted:

Health care providers

(1) A person is prescribed as a health care provider if the person is

(

a) authorized under the Health Professions and Occupations Act to practise a designated health profession, or

(

b) a registrant within the meaning of the Social Workers Act .

(2) The classes of health care providers who are prescribed as qualified health care providers are as follows:

(

a) persons who are authorized under the Health Professions and Occupations Act to practise the designated health profession of

(

i) nursing or psychiatric nursing, or

(ii) occupational therapy or psychology;

(

b) registrants within the meaning of the Social Workers Act .

(3) A person within a class referred to in subsection (2) may exercise powers and perform duties as a qualified health care provider only if both of the following conditions are met:

(

a) the responsible regulator establishes standards, limits and conditions in respect of eligibility to act as a qualified health care provider for the purposes of this regulation;

(

b) the person is eligible under, and acts in accordance with, those standards.

(4) In this section, "responsible regulator" means whichever of the following applies:

(

a) the regulator that is responsible, under the Health Professions and Occupations Act , for governing the designated health profession that the person practises;

(

b) the British Columbia College of Social Workers.

Part 2 – Children and Family Development Amendments

Adoption Regulation

Section 16 (1) (

c) and (

d) of the Adoption Regulation, B.C. Reg. 291/96, is repealed and the following substituted:

(

c) a medical practitioner who is recognized by the regulator that is responsible, under the Health Professions and Occupations Act , for governing the designated health profession of medicine as having specialist qualifications in the practice of psychiatry;

(

d) a person who is authorized under the Health Professions and Occupations Act to practise the designated health profession of psychology.

Part 3 – Citizens’ Services Amendments

Freedom of Information and Protection of Privacy Regulation

Section 1 of the Freedom of Information and Protection of Privacy Regulation, B.C. Reg. 155/2012, is amended

(

a) by repealing the definition of "health professional", and

(

b) by adding the following definition:

"regulated practitioner" means a person who is authorized under the Health Professions and Occupations Act to practise the designated health profession of medicine, nursing, psychiatric nursing or psychology.

Section 7 is amended by striking out " health professional " wherever it appears and substituting " regulated practitioner ".

Personal Information Protection Act Regulations

Section 1 of the Personal Information Protection Act Regulations, B.C. Reg. 473/2003, is amended

(

a) by repealing the definition of "health care professional" , and

(

b) by adding the following definition:

"regulated practitioner" means a person who is authorized under the Health Professions and Occupations Act to practise the designated health profession of medicine, nursing, psychiatric nursing or psychology; .

Section 5 is amended

(

a) by striking out " health care professional " wherever it appears and substituting " regulated practitioner ", and

(

b) in subsection (4) by striking out " health care professional’s " and substituting " regulated practitioner’s ".

Part 4 – Finance Amendments

Group Life Insurance Regulation (No. 1)

Section 2 (

a) and (

b) of the Group Life Insurance Regulation (No. 1), B.C. Reg. 408/97, is repealed and the following substituted:

(

a) employees appointed under the Public Service Act whose eligibility has been established by a collective agreement; .

Home Owner Grant Regulation

Section 2 (1) of the Home Owner Grant Regulation, B.C. Reg. 100/2002, is amended by repealing the definition of "health professional" and substituting the following:

"health professional" means a person who is authorized under the Health Professions and Occupations Act to practise the designated health profession of

(

a) medicine,

(

b) nursing as a nurse practitioner, or

(

c) occupational therapy or psychology; .

Insurance Premium Tax Regulation

Section 4 (

b) of the Insurance Premium Tax Regulation, B.C. Reg. 154/2016, is amended by striking out " entitled to practise a designated health profession under the Health Professions Act " and substituting " authorized under the Health Professions and Occupations Act to practise a designated health profession ".

Long Term Disability Plan Regulation

Section 2.3 of the Long Term Disability Plan Regulation, B.C. Reg. 409/97, is amended

(

a) in paragraph (

d) by striking out " legally qualified doctor of medicine " and substituting " medical practitioner ", and

(

b) in paragraph (e) (iii) and (

v) by striking out " employee’s doctor " and substituting " employee’s medical practitioner ".

Section 2.13 (

a) is amended by striking out " medical doctors " and substituting " medical practitioners ".

Section 2.14 is amended by striking out " medical doctor " and substituting " medical practitioner ".

Section 2.20 (b) (iii) is amended by striking out " physician " and substituting " medical practitioner ".

Pension Benefits Standards Regulation

Section 1 (2) of the Pension Benefits Standards Regulation, B.C. Reg. 71/2015, is amended by repealing the definition of "medical practitioner" and substituting the following:

"medical practitioner" means a person who is authorized under

(

a) the Health Professions and Occupations Act to practise the designated health profession of medicine, or

(

b) a similar law of another province to practise the health profession of medicine.

Provincial Sales Tax Exemption and Refund Regulation

Section 1 (1) of the Provincial Sales Tax Exemption and Refund Regulation, B.C. Reg. 97/2013, is amended by repealing paragraph (

b) of the definition of "prescription" and substituting the following:

(

b) despite

section 3 (2) of the

Schedule to the Regulated Health Practitioners Regulation, a contact lens record or dispensing authority, as those terms are defined in

section 3 (1) of that

Schedule to that regulation; .

Section 3 (1) (i) (

i) is amended by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Part 5 – Health Amendments

Assisted Living Regulation

Section 1 of the Assisted Living Regulation, B.C. Reg. 189/2019, is amended by repealing the definition of "dietitian" and substituting the following:

"dietitian" means a person who is authorized under the Health Professions and Occupations Act to practise the designated health profession of dietetics; .

Section 44 (3) is repealed and the following substituted:

(3) The following are health professionals for the purposes of subsection (2) (a):

(

a) a person who is authorized under the Health Professions and Occupations Act to practise the designated health profession of medicine, nursing, psychiatric nursing, occupational therapy or psychology;

(

b) a registrant within the meaning of the Social Workers Act .

Section 61 (5) is amended by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Section 64 (4) (

a) is amended by striking out " a pharmacist within the meaning of the Health Professions Act " and substituting " a person who is authorized under the Health Professions and Occupations Act to practise the designated health profession of pharmacy ".

Section 67 (1) (

b) is repealed and the following substituted:

(

b) a health professional or another person who is authorized under the Health Professions and Occupations Act to administer the medication.

Consent to Donation Regulation

Section 8 (1) (

b) of the Consent to Donation Regulation, B.C. Reg. 65/99, is repealed and the following substituted:

(

b) persons who are authorized under the Health Professions and Occupations Act to practise the designated health profession of nursing; .

Health Care Consent Regulation

Section 3 of the Health Care Consent Regulation, B.C. Reg. 20/2000, is repealed and the following substituted:

Health care providers

3 The following Acts are prescribed for the purposes of the definition of "health care provider" in

section 1 of the Act:

(

a) Health Professions and Occupations Act ;

(

b) Social Workers Act .

Section 5 (1) is amended by striking out " physician " wherever it appears and substituting " medical practitioner ".

Section 16 is amended by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Health Care Costs Recovery Regulation

Section 2 (

a) and (

b) of the Health Care Costs Recovery Regulation, B.C. Reg. 397/2008, is repealed and the following substituted:

(

a) a designated health profession that may be practised by a person who is a health care practitioner within the meaning of the Medicare Protection Act ;

(

b) the designated health profession, within the meaning of the Health Professions and Occupations Act , of occupational therapy.

Section 3 (

b) is repealed and the following substituted:

(

b) the services that are paid for by a regional health board and provided by

(

i) a licensee within the meaning of the Health Professions and Occupations Act who is authorized to practise the designated health profession of nursing, dietetics, occupational therapy, physical therapy or speech-language pathology, or

(ii) a social worker within the meaning of the Social Workers Act ; .

Hospital Act Regulation

Section 2 of the Hospital Act Regulation, B.C. Reg. 121/97, is repealed and the following substituted:

Practitioners

2 A person who is authorized under the Health Professions and Occupations Act to practise any of the following designated health professions is a practitioner for the purposes of the Act:

(

a) medicine;

(

b) midwifery or nursing as a nurse practitioner;

(

c) dentistry.

Section 7 is amended

(

a) by repealing subsections (1), (4) and (6) and substituting the following:

(1) A practitioner is not entitled to attend or treat patients in a hospital or in any way make use of a hospital’s facilities for the practitioner’s practice unless the practitioner

(

a) is authorized under the Health Professions and Occupations Act to practise the designated health profession of medicine, midwifery, nursing or dentistry, and

(

b) holds a valid permit, issued by the hospital’s board, to practise in the hospital.

(4) A hospital’s board may issue to a person a special permit authorizing the person to attend or treat patients for the purpose of providing educational services or necessary health care services if

(a) subsection (1) does not apply to the person,

(

b) the person is authorized, by an extrajurisdictional regulator within the meaning of the Health Professions and Occupations Act , to practise a health profession that is equivalent to one referred to in subsection (1), and

(

c) the person is licensed for this purpose by the applicable regulator under the Health Professions and Occupations Act .

(6) A hospital board must give notice to a permit holder’s regulator under the Health Professions and Occupations Act within 7 days of doing any of the following with respect to the person’s permit or special permit:

(

a) cancelling the permit;

(

b) suspending the permit for more than 30 days;

(

c) placing a restriction on the permit;

(

d) refusing to issue or renew the permit. , and

(

b) in subsection (7) by striking out " a person who is not a member of a college referred to in subsection (1) " and substituting " a person to whom subsection (1) does not apply ".

Section 15 is repealed and the following substituted:

Hospital records and investigation of practitioners

(1) In this section:

"investigation or disciplinary proceeding" means an investigation or disciplinary proceeding under the Health Professions and Occupations Act ;

"investigator" means an investigator or registrar within the meaning of the Health Professions and Occupations Act .

(2) If a medical practitioner, midwife, nurse practitioner or dentist is the subject of an investigation or disciplinary proceeding, an investigator may, for the purposes of the investigation or proceeding, examine the hospital’s records with respect to any health care services rendered to a patient by or under the direction of the medical practitioner, midwife, nurse practitioner or dentist.

(3) For the purposes of this section, an investigation under the Health Professions and Occupations Act is deemed to begin on the making of a regulatory complaint under that Act.

Hospital Insurance Act Regulations

Section 1.1 of the Hospital Insurance Act Regulations, B.C. Reg. 25/61, is amended by adding the following

definitions:

"midwife" means a person who is authorized under the Health Professions and Occupations Act to practise the designated health profession of midwifery;

"oral and maxillofacial surgeon" means a person who

(

a) is authorized under the Health Professions and Occupations Act to practise the designated health profession of dentistry, and

(

b) is recognized by the regulator that is responsible, under that Act, for governing the designated health profession of dentistry as having specialist qualifications in oral and maxillofacial surgery; .

Section 5.1 is amended

(

a) in paragraph (

h) by striking out " where available ", and

(

b) by repealing paragraph (

i) and substituting the following:

(

i) use of occupational therapy and physical therapy facilities.

Section 5.7 (

d) is repealed and the following substituted:

(

d) use of occupational therapy and physical therapy facilities; .

Information Management Regulation

Section 1 of the Information Management Regulation, B.C. Reg. 328/2021, is amended

(

a) by repealing the

definitions of "health services" and "title" and substituting the following:

"health services" means health services within the meaning of the Health Professions and Occupations Act that a licensee is authorized to provide under that Act;

"title" means a title that a licensee is authorized, under the Health Professions and Occupations Act , to use in the course of practising a designated health profession within the meaning of that Act; ,

(

b) by adding the following definition:

"licensee" means a licensee within the meaning of the Health Professions and Occupations Act who is authorized to use a title listed in

section 1 (1) of

Schedule 1 to this regulation; , and

(

c) by repealing the definition of "registrant" .

39 Sections 6 (b), 8 (2), 35 and

section 1 of

Schedule 1 are amended by striking out " registrant " wherever it appears and substituting " licensee ".

Section 7 (2) (b) (

i) and (ii) is repealed and the following substituted:

(

i) under the Health Professions Act , Health Professions and Occupations Act or the Pharmacy Operations and Drug Scheduling Act , or

(ii) by an extrajurisdictional regulator within the meaning of the Health Professions and Occupations Act ; .

Section 11 is amended by adding the following subsection:

(1.1) A person must not access PharmaNet in relation to the provision of health services by the person or the person’s principal if the person or principal provided, or is providing, those health services in contravention of any prohibition, limit or condition that applies to that person or principal under the Health Professions and Occupations Act .

Section 12 (2) is amended by striking out " registrants " and substituting " licensees ".

Section 23 (1) (

a) is amended by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Section 35 is amended by striking out " registrant’s " and substituting " licensee’s ".

Schedule 1 is amended by repealing

section 1 (1) (

c) and substituting the following:

(c) "medical practitioner" or "physician assistant"; .

Information Regulation

Section 3 (2) (

h) of the Information Regulation, B.C. Reg. 208/2010, is repealed and the following substituted:

(

h) a person who

(

i) is a licensee or former licensee within the meaning of the Health Professions and Occupations Act , and

(ii) is or was authorized under that Act or the Health Professions Act to practise the designated health profession of medicine, midwifery, nursing as a nurse practitioner, psychiatric nursing, pharmacy or dentistry; .

Laboratory Services Regulation

Section 3 (1), (2) and (2.1) of the Laboratory Services Regulation, B.C. Reg. 52/2015, is repealed and the following substituted:

(1) A health care practitioner is prescribed as a referring practitioner for the purposes of the Act if the health care practitioner

(

a) is enrolled as a practitioner under

section 13 of the Medicare Protection Act , and

(

b) is authorized under the Health Professions and Occupations Act to practise the designated health profession of podiatric medicine, midwifery or dentistry.

(2) A health care practitioner is prescribed as a referring practitioner for the purposes of the Act if

(

a) the health care practitioner is authorized under the Health Professions and Occupations Act to practise the designated health profession of nursing or psychiatric nursing, and

(

b) the health care practitioner

(

i) is a nurse practitioner,

(ii) is a certified registered nurse or certified registered psychiatric nurse for the purposes of

section 21, 23, 51 or 53 of the Nurses and Midwives Regulation, or

(iii) makes a request for a beneficiary to receive benefits in relation to communicable disease prevention and management.

(2.1) A health care practitioner is prescribed as a referring practitioner for the purposes of the Act if the health care practitioner

(

a) is authorized under the Health Professions and Occupations Act to practise the designated health profession of pharmacy, and

(

b) makes a request for a beneficiary to receive benefits in relation to the services described in

section 5 (1) (

b) or (

c) of the Pharmacists Regulation.

Section 5 is amended by striking out " authorized by the College of Physicians and Surgeons of British Columbia to practise in one or more of the following specialties, as recognized by the Royal College of Physicians and Surgeons of Canada " and substituting " recognized by the regulator that is responsible, under the Health Professions and Occupations Act , for governing the designated health profession of medicine as having specialist qualifications in the practise of one or more of the following ".

Medical and Health Care Services Regulation

Section 17 of the Medical and Health Care Services Regulation, B.C. Reg. 426/97, is repealed and the following substituted:

Definition of health care practitioner

17 The following designated health professions are prescribed for the purposes of paragraph (

b) of the definition of "health care practitioner" in

section 1 of the Act:

(

a) midwifery;

(

b) physical therapy;

(

c) massage therapy;

(

d) naturopathic medicine;

(

e) traditional Chinese medicine, but only as it relates to the performance of acupuncture.

Section 19 (2) (a.1) (i) (

B) is repealed and the following substituted:

(

B) is accredited by the regulator that is responsible, under the Health Professions and Occupations Act , for governing the designated health profession of medicine, and .

Section 25.1 is amended

(

a) in subsection (1) by striking out " massage, naturopathic, physical therapy or non-surgical podiatric service " and substituting " massage therapy, naturopathic medicine, physical therapy or non-surgical podiatric medicine service ", and

(

b) in subsection (2) by striking out " massage, naturopathic, physical therapy and non-surgical podiatric services " and substituting " massage therapy, naturopathic medicine, physical therapy and non-surgical podiatric medicine services ".

Section 45 (1) is amended by striking out " is a certified practice registrant within the meaning of the Nurses (Registered) and Nurse Practitioners Regulation " and substituting " is a certified registered nurse or certified registered psychiatric nurse for the purposes of

section 21, 23, 51 or 53 of the Nurses and Midwives Regulation ".

Section 46 (

a) is repealed and the following substituted:

(

a) the appropriate regulatory college; .

Mental Health Regulation

54 Sections 8 (2) (

a) and 9 (4) of the Mental Health Regulation, B.C. Reg. 233/99, is amended by striking out " practice " and substituting " practise ".

Provider Regulation

Section 1 of the Provider Regulation, B.C. Reg. 222/2014, is amended

(

a) by repealing the definition of "College of Pharmacists bylaws" ,

(

b) by adding the following definition:

"Community Pharmacy Standards of Practice" means

Schedule F of the bylaws of the regulator of pharmacists, made under the Health Professions and Occupations Act ; ,

(

c) by repealing the definition of "governing body" and substituting the following:

"governing body" means the following, as applicable:

(

a) the regulator of pharmacists;

(

b) an extrajurisdictional regulator within the meaning of the Health Professions and Occupations Act that is responsible for governing the health profession of pharmacy; ,

(

d) in paragraph (

c) of the definition of "information or billing contravention" by adding " Health Professions and Occupations Act , " after " Health Professions Act , ", and

(

e) by adding the following

definitions:

"regulator of medical practitioners" means the regulator that is responsible, under the Health Professions and Occupations Act , for governing the designated health profession of medicine;

"regulator of pharmacists" means the regulator that is responsible, under the Health Professions and Occupations Act , for governing the designated health profession of pharmacy; .

Section 3 (4) is repealed and the following substituted:

(4) An applicant is not eligible for enrolment in the opioid agonist treatment provider sub-class unless each pharmacist who will be providing drugs, devices, substances or related services through the pharmacy is certified, within the meaning of the Regulated Health Practitioners Regulation, by the regulator of pharmacists to provide restricted activities in relation to opioid agonist treatment services.

Section 12 (

a) is amended by striking out "

Part 1 of

Schedule F to the College of Pharmacists bylaws " and substituting "

Part 1 of the Community Pharmacy Standards of Practice ".

Section 13 is amended

(

a) in subsection (1) (

a) and (

b) by striking out "

Part 3 of

Part 3 of the Community Pharmacy Standards of Practice ", and

(

b) in subsection (2) (

a) by striking out " College of Physicians and Surgeons of British Columbia " wherever it appears and substituting " regulator of medical practitioners ".

Section 18 (1) (

a) is amended by striking out " College of Physicians and Surgeons of British Columbia " and substituting " regulator of medical practitioners ".

Residential Care Regulation

Section 1 of the Residential Care Regulation, B.C. Reg. 96/2009, is amended

(

a) in the

definitions of "authorized health professional" and "dietitian" by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ", and

(

b) by repealing the definition of "nurse practitioner" .

Section 54 (4) is repealed and the following substituted:

(4) For the purposes of subsection (3), "dental health care professional" means a person who is authorized under the Health Professions and Occupations Act to practise the designated health profession of dentistry, dental hygiene or denturism.

Vaccination Status Reporting Regulation

Section 1 of the Vaccination Status Reporting Regulation, B.C. Reg. 146/2019, is amended in the definition of "health authority nurse" by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Part 6 – Housing and Municipal Affairs Amendments

Residential Tenancy Regulation

Section 39 (

f) to (

j) of the Residential Tenancy Regulation, B.C. Reg. 477/2003, is repealed and the following substituted:

(

f) a person who is authorized under the Health Professions and Occupations Act to practise the designated health profession of

(

i) medicine,

(ii) nursing or psychiatric nursing, or

(iii) psychology; .

Section 40 (

c) is amended

(

a) by repealing subparagraph (

i) and substituting the following:

(

i) referred to in

section 39 (f) (ii) or (iii) or (l), or , and

(

b) in subparagraph (ii) by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Part 7 – Labour Amendments

Employment Standards Regulation

Section 31 of the Employment Standards Regulation, B.C. Reg. 396/95, is amended

(

a) by renumbering the

section as

section 31 (1),

(

b) by repealing subsection (1) (d), (e), (i), (

j) and (k), and

(

c) by adding the following subsection:

(2) The Act does not apply to an employee who is authorized under the Health Professions and Occupations Act to practise, and is carrying on the practice of, any of the following designated health professions:

(

a) medicine, if the employee is authorized to use the title "medical practitioner";

(

b) podiatric medicine;

(

c) dentistry, if the employee is authorized to use the title "dentist";

(

d) optometry;

(

e) naturopathic medicine or chiropractic.

Section 33 is amended

(

a) by renumbering the

section as

section 33 (1),

(

b) by repealing subsection (1) (

a) and (

b) and substituting the following:

(

a) a student who is in training

(

i) in a recognized nursing program to practise the designated health profession of nursing, practical nursing or psychiatric nursing, or

(ii) at a hospital to practise the designated health profession of practical nursing; , and

(

c) by adding the following subsection:

(2) For the purposes of this section:

"designated health profession" and "eligibility standard" have the same meaning as in the Health Professions and Occupations Act ;

"hospital" has the same meaning as in

section 1 of the Hospital Act ;

"nursing regulator" means the regulator that is responsible, under the Health Professions and Occupations Act , for governing the designated health profession of nursing, practical nursing or psychiatric nursing;

"recognized nursing program" means an academic or technical program that is recognized by the nursing regulator as meeting an eligibility standard that must be met to practise the designated health profession of nursing, practical nursing or psychiatric nursing.

Mental Disorder Presumption Regulation

Section 1 of the

Schedule to the Mental Disorder Presumption Regulation, B.C. Reg. 136/2018, is amended in the definition of "nurse" by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Part 8 – Post-Secondary Education and Future Skills Amendments

Fees and Student Tuition Protection Fund Regulation

Section 1 of the Fees and Student Tuition Protection Fund Regulation, B.C. Reg. 140/2016, is amended by repealing the definition of "health regulatory body" and substituting the following:

"health regulatory body" means a regulator within the meaning of the Health Professions and Occupations Act ; .

Part 9 – Public Safety and Solicitor General Amendments

Blood Sample Certificate Regulation

69 The Blood Sample Certificate Regulation, B.C. Reg. 333/83, is repealed.

Correction Act Regulation

Section 1 of the Correction Act Regulation, B.C. Reg. 58/2005, is amended by repealing paragraph (

a) of the definition of "health care professional" and substituting the following:

(

a) a licensee within the meaning of the Health Professions and Occupations Act , or .

Crime Victim Assistance (General) Regulation

Section 2 (

g) of the Crime Victim Assistance (General) Regulation, B.C. Reg. 161/2002, is amended by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Section 8 is amended

(

a) in subsection (1) (

a) and (

b) by striking out " dentist or ", and

(

b) in subsections (3) and (4) by striking out " Association of Dental Surgeons of British Columbia " and substituting " British Columbia Dental Association ".

Schedule 2 is amended in paragraph (

a) of item 5 by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Criminal Record Check Authorizations Regulation

Section 6.1 of the Criminal Record Check Authorizations Regulation, B.C. Reg. 386/2007, is repealed and the following substituted:

Prescribed dates for dental technicians

6.1

(1) This

section applies to a dental technician who

(

a) is licensed under the Health Professions and Occupations Act , and

(

b) was registered under the Health Professions Act or licensed under the Health Professions and Occupations Act on or after October 1, 2011.

(2) Despite sections 5 and 6, the date that is the fifth anniversary of the date that a dental technician’s criminal record check authorization was provided in accordance with

section 14 (1) of the Act is the date that is prescribed for the purposes of

section 15 (1) of the Act.

Enhanced Accident Benefits Regulation

Section 1 (1) of the Enhanced Accident Benefits Regulation, B.C. Reg. 59/2021, is amended by repealing paragraph (

b) of the definition of "authorized health care provider" and substituting the following:

(

b) a person who is authorized to practise

(

i) a designated health profession within the meaning of the Health Professions and Occupations Act , other than one practised by a health care practitioner, or

(ii) a health profession in another jurisdiction that is equivalent to one described in subparagraph (i); .

Section 32 (1) (

a) is amended by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Guide Dog and Service Dog Regulation

Section 3 (5) of the Guide Dog and Service Dog Regulation, B.C. Reg. 223/2015, is repealed and the following substituted:

(5) In subsection (4) (b) (i), "medical practitioner or nurse practitioner" includes a person

(

a) who is authorized to practise the health profession of

(

i) medicine, or

(ii) nursing in a capacity that is at least equivalent to a nurse practitioner, and

(

b) whose authorization as described in paragraph (

a) is issued by an extrajurisdictional regulator within the meaning of the Health Professions and Occupations Act in a jurisdiction of Canada or the United States of America.

Insurance (Vehicle) Regulation

Section 1 (1) of the Insurance (Vehicle) Regulation, B.C. Reg. 447/83, is amended

(

a) by repealing the

definitions of "acupuncturist" , "chiropractor" , "dentist" , "massage therapist" , "occupational therapist" , "physiotherapist" and "psychologist" ,

(

b) by repealing paragraph (

c) of the definition of "counsellor" and substituting the following:

(

c) whose health care services of clinical or counselling psychology are overseen by a person who

(

i) is a licensee within the meaning of the Health Professions and Occupations Act , or

(ii) is authorized under a similar law of another jurisdiction to practise a health profession; , and

(

c) by repealing paragraph (

b) of the definition of "kinesiologist" and substituting the following:

(

b) whose health care services of kinesiology are overseen by a person who

(

i) is a licensee within the meaning of the Health Professions and Occupations Act , or

(ii) is authorized under a similar law of another jurisdiction to practise a health profession; .

Section 1 (2.1) is repealed and the following substituted:

(2.1) The following designated health professions are prescribed for the purposes of paragraph (

c) of the definition of "health care practitioner" in

section 1 (1) of the Act:

(

a) chiropractic;

(

b) dentistry;

(

c) massage therapy;

(

d) occupational therapy;

(

e) physical therapy;

(

f) psychology;

(

g) a designated health profession other than one referred to in paragraphs (

a) to (f), but only with respect to the performance, by licensees who practise the designated health profession, of acupuncture or a similar procedure that involves stimulating specific sites on the skin, mucous membranes or subcutaneous tissues by means of needles.

(2.2) The following classes of persons are prescribed for the purposes of paragraph (

d) of the definition of "health care practitioner" in

section 1 (1) of the Act:

(

a) counsellors;

(

b) kinesiologists;

(

c) persons who are authorized, by a body in a jurisdiction outside British Columbia that regulates the practice of medicine in that jurisdiction, to practise medicine.

Liquor Control and Licensing Regulation

Section 192 of the Liquor Control and Licensing Regulation, B.C. Reg. 241/2016, is amended

(

a) in subsection (1) by repealing the

definitions of "dentist" and "veterinarian" ,

(

b) in subsection (1) by repealing the definition of "pharmacist" and substituting the following:

"pharmacist" means a person who is authorized under the Health Professions and Occupations Act to practise the designated health profession of pharmacy. , and

(

c) in subsection (6) (b) (ii) by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Pill Press and Related Equipment Control Regulation

Section 2 (

a) of the Pill Press and Related Equipment Control Regulation, B.C. Reg. 278/2018, is amended by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ".

Part 10 – Social Development and Poverty Reduction Amendments

Community Living Authority Regulation

Section 1 of the Community Living Authority Regulation, B.C. Reg. 231/2005, is amended

(

a) by adding the following

definitions:

"pediatrician" means a medical practitioner who is recognized by the regulator that is responsible, under the Health Professions and Occupations Act , for governing the designated health profession of medicine as having specialist qualifications in the practice of pediatrics;

"psychiatrist" means a medical practitioner who is recognized by the regulator that is responsible, under the Health Professions and Occupations Act , for governing the designated health profession of medicine as having specialist qualifications in the practice of psychiatry;

"psychologist" means a person who is authorized under the Health Professions and Occupations Act to

(

a) practise the designated health profession of psychology, and

(

b) use the title "psychologist";

"school psychologist" means a person who is authorized under the Health Professions and Occupations Act to

(

a) practise the designated health profession of psychology, and

(

b) use the title "school psychologist"; , and

(

b) by repealing the

definitions of "qualifying practitioner" and "registered practitioner" .

Section 2 is amended in the definition of "impaired adaptive functioning" by striking out " qualifying practitioner " and substituting " psychologist or school psychologist ".

Section 2.1 is amended

(

a) in paragraph (

a) by striking out " qualifying practitioner " and substituting " psychologist or school psychologist ", and

(

b) in paragraph (

b) by striking out " registered practitioner " in both places and substituting " psychologist ".

Section 2.3 (

a) is repealed and the following substituted:

(

a) has been diagnosed with fetal alcohol spectrum disorder

(

i) in accordance with the Canadian Guidelines (2005) or the Canadian Guidelines (2016), and

(ii) by both a psychologist and a medical practitioner, .

Section 2.4 (

a) is repealed and the following substituted:

(

a) has been diagnosed with pervasive developmental disorder

(

i) in accordance with DSM-IV-TR, and

(ii) by a psychologist, pediatrician or psychiatrist, .

Section 2.41 (

a) is repealed and the following substituted:

(

a) has been diagnosed with autism spectrum disorder

(

i) in accordance with DSM-5, and

(ii) by a psychologist, pediatrician or psychiatrist, .

Section 2.5 is amended by striking out " qualifying practitioner " and substituting " psychologist or school psychologist ".

Employment and Assistance for Persons with Disabilities Regulation

Section 1 (1) of the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended

(

a) in the definition of "dietitian" by striking out " Health Professions Act " and substituting " Health Professions and Occupations Act ", and

(

b) by repealing the definition of "midwife" and substituting the following:

"midwife" means a person who is authorized under the Health Professions and Occupations Act to practise the designated health profession of midwifery; .

Section 2 (2) is repealed and the following substituted:

(2) For the purposes of the Act, "prescribed professional" means a person who is

(

a) authorized under the Health Professions and Occupations Act to practise the designated health profession of

(

i) medicine,

(ii) nursing or psychiatric nursing,

(iii) occupational therapy, physical therapy or psychology, or

(iv) chiropractic, or

(

b) a registrant within the meaning of the Social Workers Act .

Section 1 of

Schedule C is amended

(

a) by repealing the

definitions of "acupuncturist" , "audiologist" , "chiropractor" , "dental hygienist" , "dentist" , "denturist" , "hearing instrument practitioner" , "massage therapist" , "naturopath" , "occupational therapist" , "optician" , "optometrist" , "physical therapist" , "physical therapy" and "podiatrist" , and

(

b) by repealing the

definitions of "hearing instrument" , "ophthalmologist" and "specialist" and substituting the following:

"hearing instrument" has the same meaning as "wearable hearing instrument" in

section 3 (1) of the

Schedule to the Regulated Health Practitioners Regulation;

"ophthalmologist" means a specialist whose specialist qualifications are in the practice of ophthalmology;

"specialist" means a medical practitioner who is recognized by the regulator that is responsible, under the Health Professions and Occupations Act , for governing the designated health profession of medicine as having specialist qualifications in the practice of medicine.

92 The following

section is added to

Schedule C:
