EXPLANATORY NOTE NOTE EXPLICATIVE On December 18, 2018, The Highway Traffic Act will be amended by The Impaired Driving Offences Act (Various Acts Amended) to reflect changes to the driving-related provisions of the Criminal Code . This Bill corrects a legislative gap created by those amendments. Le 18 décembre 2018, le Code de la route sera modifié par la Loi modifiant diverses lois en matière de conduite avec facultés affaiblies afin qu'y soient reflétés les changements apportés aux dispositions du Code criminel liées à la conduite. Le présent projet de loi comble un vide législatif créé par cette modification.

BILL 36 PROJET DE LOI 36 THE HIGHWAY TRAFFIC AMENDMENT ACT (IMPAIRED DRIVING OFFENCES) LOI MODIFIANT LE CODE DE LA ROUTE (CONDUITE AVEC FACULTÉS AFFAIBLIES) (Assented to ) (Date de sanction : ) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows: SA MAJESTÉ, sur l'avis et avec le consentement de l'Assemblée législative du Manitoba, édicte : C.C.S.M. c. H60 amended 1 The Highway Traffic Act is amended by this Act. Modification du c. H60 de la C.P.L.M. 1 La présente loi modifie le Code de la route . 2 Clause 242.1(1.1)(

a) is amended by striking out " subsection 259(4) (operation while disqualified) " and substituting " subsection 320.18(1) (operation while prohibited) ". 2

d) is amended by striking out everything after " a demand " and substituting " made under

section 320.27 or 320.28 of the Criminal Code , or with the peace officer's instructions in respect of the demand; ". 3

4 Subsection 263.2(7) is amended (

a) in clause (b), by striking out "paragraph 253(3)(a) " and substituting "paragraph 320.14(1)(c) "; (

b) in clause (c), by striking out "paragraph 253(3)(c) " and substituting "paragraph 320.14(1)(d) "; and (

c) in clause (d), by striking out everything after "a demand " and substituting " made under

section 320.27 or 320.28 of the Criminal Code , or with the peace officer's instructions in respect of the demand; ". 4
