An Act Respecting the Saint John Firefighters’ Association WHEREAS the Saint John Firefighters’ Association, Local 771, prays that it be enacted as hereinafter set forth; AND WHEREAS it is desirable that for certain occu- pational ailments, pensions be provided to permanent members of the Saint John Fire Department; THEREFORE, Her Majesty, by and with the advice and consent of the Legislative Assembly of New Bruns- wick, enacts as follows: 1 Notwithstanding the provisions of any other Act a per- manent member of the Saint John Fire Department ren- dered unable to carry on in the Saint John Fire Department as a result of any condition of impairment of health caused by hypertension or heart disease, or disease or permanent injury to the lungs resulting in total or partial disability or death shall be presumed to have been disabled in line of duty with the Saint John Fire Department. 2 A permanent member of the Saint John Fire Depart- ment disabled as set out in

section shall be entitled to a pension provided for in the following manner: (

a) a permanent member having fifteen years or more service with The City of Saint John shall receive a pen- sion as set out in the City of Saint John Pension Act, and further if said pension is not sixty percent of the perma- PROJET DE LOI Loi concernant la Saint John Firefighters’ Association ATTENDU que la Saint John Firefighters’ Association,

Malgré les dispositions de toute autre loi, est réputé être devenu invalide dans l’exercice de ses fonctions dans le Service d’incendie de Saint John tout membre perma- nent de ce service qui n’est plus capable de poursuivre son travail dans ce service par suite d’un trouble de la santé causé par l’hypertension, une cardiopathie ou une maladie ou lésion pulmonaire permanente causant une invalidité totale ou partielle ou la mort. 2 Les membres permanents du Service d’incendie de Saint John qui souffrent d’une invalidité visée à l’article sont admissibles à une rente calculée ainsi qu’il suit :

a) le membre permanent ayant au moins quinze an- nées de service auprès de la cité appelée The City of Saint John reçoit une rente conformément à la

Loi sur le régime de retraite de la ville de Saint John, étant en- 2 Projet de loi Loi concernant la Saint John Firefighters’ Association nent member’s full wages at the time of the permanent member’s disability retirement, the balance shall be made up by The City of Saint John so that the perma- nent member shall receive sixty percent of his or her full wages at the time of the permanent member’s dis- ability retirement; (

b) a permanent member not having the required fif- teen years service with the City, shall be paid a pension by The City of Saint John in the amount of sixty percent of the permanent member’s full wages at the time of the permanent member’s disability retirement and The City of Saint John shall claim all monies from the em- ployees of The City of Saint John “Pension Plan” which the member has paid into said plan under the City of Saint John Pension Act; (

c) in the event a member dies as the result of the dis- abilities set out in

section 1, the dependents of such member shall be paid an annual pension equal to sixty percent of the annual salary such member was receiv- ing at the time or death as follows: (

i) in the case of a widow or widower with or with- out children the pension shall be paid to such widow or widower until his or her death; (ii) in the case of dependent children only, whether the spouse died before or after such employee, the pension shall be paid to such children or to the guardian of same until they have reached the age of eighteen years; (iii) in the case where the employee leaves neither widow or widower nor dependent children, the pen- sion shall be paid to the employee’s mother, father, brother or sister in the order named, provided such recipient at the time of the death of such employee is and continues to be wholly dependent on the em- ployee’s earnings or pension. 3 In the event a permanent member, a recipient of pen- sion, shall be employed while in receipt of the pension herein provided for and receives remuneration in excess of forty percent of the permanent member’s full wages at the time of the permanent member’s disability retirement, the amount of excess over forty percent shall be deducted from the amount of pension payable under this Act. 4

Loi sur le régime de retraite de la ville de Saint John;

c) si un membre décède par suite d’une invalidité vi- sée à l’article 1, les personnes à sa charge reçoivent une rente annuelle égale à soixante pour cent du salaire an- nuel qu’il touchait à ce moment ou à son décès, aux conditions suivantes : (

i) dans le cas où le membre laisse une veuve ou un veuf avec ou sans enfants, la rente est versée à la veuve ou au veuf jusqu’à son décès; (ii) dans le cas où il ne reste que des enfants à charge, la rente, que le conjoint soit décédé avant ou après l’employé, est versée à ces enfants ou à leur tuteur jusqu’à ce que les enfants atteignent l’âge de dix-huit ans; (iii) dans le cas où l’employé ne laisse ni veuve ou veuf ni enfants à charge, la rente est versée à sa mère, à son père, à son frère ou à sa sœur, dans cet ordre, pourvu que ce prestataire dépende entière- ment des revenus ou de la rente de l’employé au mo- ment du décès de l’employé et par la suite. 3 Lorsqu’un membre permanent rentier occupe un em- ploi pendant qu’il reçoit la rente ci-prévue et gagne plus de quarante pour cent du plein salaire qu’il touchait au moment de prendre sa retraite pour cause d’invalidité, le montant qui dépasse les quarante pour cent est déduit de la rente à verser en application de la présente loi. 4 La loi intitulée

chapitre des Lois du Nouveau-Brunswick de 1960, est abrogée.
