Loi sur les procurations durables 1(1)

Section of the Enduring Powers of Attorney Act,

chapter of the Acts of New Brunswick, 2019, is amended 1(1) L’article de la

Loi sur les procurations dura ‐ bles,

chapitre des Lois du Nouveau-Brunswick de 2019, est modifié (

a) in subsection (1),

a) au paragraphe (1), (

i) by repealing paragraph (

a) and substituting the following: (

i) par l’abrogation de l’alinéa a) et son rempla‐ cement par ce qui suit : (

a) appoints an attorney for property to act on behalf of the grantor in relation to the property and financial affairs of the grantor and specifies that

a) il nomme un fondé de pouvoir aux biens pour agir en son nom relativement à ses biens et à ses fi ‐ nances et précise ce qui suit : (

i) the attorney may act when the grantor lacks capacity, or (

i) ou bien que celui-ci peut agir lorsqu’il n’est pas apte, (ii) the attorney may act regardless of whether the grantor lacks capacity; and (ii) ou bien que celui-ci peut agir peu importe qu’il soit apte ou non; (ii) in paragraph b ) of the French version by striking out “nomme” and substituting “il nomme”; (ii) à l’alinéa b ) de la version française, par la suppression de « nomme » et son remplacement par « il nomme »; (

b) by adding after subsection (1) the following:

b) par l’adjonction de ce qui suit après le paragra ‐ phe (1) : 1 3(1.1) For greater certainty and despite paragraph (1)(a), an irrevocable power of attorney is not an endur ‐ ing power of attorney. 3(1.1) ll est entendu que, par dérogation à l’ali ‐ néa (1)a), la procuration qui est irrévocable ne constitue pas une procuration durable. 1(2)

Section 4.1 of the Act is amended 1(2) L’article 4.1 de la Loi est modifié (

a) in subsection (2) by striking out “On the com ‐ mencement of this

section until December 31, 2022, the requirement” and substituting “The require ‐ ment”;

a) au paragraphe (2), par la suppression de « À l’entrée en vigueur du présent article, et ce, jusqu’au décembre 2022, l’exigence » et son remplacement par « L’exigence »; (

b) in subsection (3) by striking out “During the period referred to in subsection (2), the require ‐ ments” and substituting “The requirements”;

b) au paragraphe (3), par la suppression de « Du ‐ rant la période visée au paragraphe (2), les exi ‐ gences » et son remplacement par « Les exigences »; (

c) in subsection (4) by striking out “During the period referred to in subsection (2), the require ‐ ment” and substituting “The requirement”.

Section 4.1 of the Wills Act,

chapter W-9 of the Re‐ vised Statutes, 1973, is amended L’article 4.1 de la

a) in subsection (2) by striking out “On the com ‐ mencement of this

section until December 31, 2022, the requirement” and substituting “The require‐ ment”;

a) au paragraphe (2), par la suppression de « À l’entrée en vigueur du présent article, et ce, jusqu’au décembre 2022, l’exigence » et son remplacement par « L’exigence »; (

b) in subsection (3) by striking out “During the period of time referred to in subsection (2), the re ‐ quirement” and substituting “The requirement”;
