On the recommendation of the undersigned, the Administrator, by and with the advice and consent of the Executive Council, orders that the Employment Standards Regulation, B.C. Reg. 396/95, is amended as set out in the attached Schedule.

Schedule

Section 45.25 of the Employment Standards Regulation, B.C. Reg. 396/95, is amended

(

a) in subsection (1) by adding the following

definitions:

"actor or performer" means a person who is employed

(

a) in the live entertainment industry as a performer, background performer or extra, or

(

b) in the recorded entertainment industry as an actor, background performer or extra;

"live entertainment industry" has the same meaning as in

section 45.15 (1) of this regulation;

"recorded entertainment industry" has the same meaning as in

section 45.5 (1) of this regulation; , and

(

b) in subsection (2) (

d) by striking out " work that is done " and substituting " work, other than work as an actor or performer, that is done ".
