Section 1 of the Intercountry Adoption Act,

chapter I-12.01 of the Acts of New Brunswick, 1996, is amended 1 L’article 1 de la

a) in the definition “Minister” by striking out the period at the end of the definition and substituting a semicolon;

a) the wishes of the child shall be considered in de- termining his or her interests,

d) the person may consult directly with the child in private, unless the person determines that to do so would not be in the best interests of the child, and

Division A Adoption of Child from Outside Canada

section A 14 This Division applies to the adoption or proposed adoption of a child who is habitually resident outside Can- ada by an adult who is habitually resident in the Province. 14 La présente

Procedure Procédure 17(1) The Minister shall prepare a report on an applicant under

e) the characteristics of a child for whom the appli- cant would be qualified to care, and

f) such other matters as may be prescribed by regu- lation.

Division B Intercountry Adoption of Child from New Brunswick

Adoption of child habitually resident in New Brunswick Adoption d’un enfant résidant habituellement au Nouveau-Brunswick 21 An adult habitually resident outside Canada who wishes to adopt a child who is habitually resident in the Province shall apply to the Central Authority or other adoption authority in his or her jurisdiction of habitual residence. 21 Un adulte résidant habituellement à l’extérieur du Canada qui désire adopter un enfant résidant habituelle- ment dans la province doit en faire la demande à l’Autorité centrale ou à une autre autorité compétente de son lieu de résidence habituelle.

a) has established that the child is eligible for adop- tion,

c) has ensured that, if the child is twelve years of age or older,

i) the child has been counselled and informed of the effects of the adoption and of his or her consent to the adoption, and (

d) determine, on the basis of the reports and consid- erations set out in paragraphs (

a) to (c), whether the placement is in the best interests of the child.

d) the Minister is satisfied that the prospective adop- tive parent is eligible and suited to adopt, and

e) the Minister is satisfied that the child is or will be authorized to enter and reside permanently in the re- ceiving jurisdiction.

Placement agreement Entente de placement 27(1) If the Minister places a child for purposes of adop- tion in accordance with this Division, the Minister may enter into an agreement in writing with a person to transfer all or part of the custody, care and control of the child to that person as a prospective adoptive parent, and in the agreement the Minister may transfer to the prospective adoptive parent the rights and responsibilities with respect to custody, care and control of the child that have been transferred to the Minister by a guardianship agreement, or that have been imposed on the Minister by court order, as the Minister considers to be suitable under the circum- stances. 27(1) Lorsque le Ministre place un enfant en vue de son adoption conformément à la présente section, le Ministre peut, ainsi qu’il l’estime opportun dans les circonstances, conclure par écrit une entente avec une personne pour lui transférer, à

Division C Court Process for Intercountry Adoption Finalized in New Brunswick

Section C Processus judiciaire pour la conclusion de l’adoption internationale au Nouveau-Brunswick Requirements for application for adoption order Exigences de demande d’ordonnance d’adoption 28(1) Subject to this Act, an adult may apply to the court for an adoption order effecting the adoption of a named child by that adult. 28(1)

e) if the child is habitually resident outside Canada when he or she is placed for adoption, the consent to the adoption order or agreement of the Central Authority or other adoption authority of the child’s jurisdiction of origin,

e) respecting rights of access to information, the confidentiality, security, disclosure and disposal of in- formation acquired under the Act and the duration, renewal and cancellation of determinations under sec- tions 17 and 25;
