AMENDMENT REGULATION

section 17 of the Victims of Crime Act.

1 The Victims of Crime Regulation (AR 63/2004) is

amended by this Regulation.

Section 21 is amended by striking out "June 1, 2018" and

substituting "June 1, 2020".

1(1) The forms in the

Schedule to this Regulation are prescribed for

the purposes of the sections of the Election Act indicated on the forms.

(2) The forms required to be prescribed under the Election Act that are

not set out in the

Schedule are to be prescribed by the Chief Electoral

Officer.

2 The Election Act Forms Regulation (AR 141/2011) is repealed.

e) and substituting the

following:

(e) "crane and hoisting equipment" means a mobile crane, a

tower crane, a boom truck or a wellhead boom truck,

but does not include

(

i) an overhead bridge-type crane;

(ii) a crane that meets the requirements of and is

operated in accordance with the Canada Labour

Code and the regulations under that Code;

(iii) a crane that is used exclusively for raising,

lowering and towing motor vehicles;

(iv) a crane that is mounted on a motor vehicle that is

used exclusively for fire fighting;

(

v) a machine, commonly known as a side-boom or

pipe layer that is used for pipeline work to lower

pipes into a trench;

(vi) an aerial device that is commonly known as a

personnel lift or personnel hoist;

(vii) a mobile lifting device designed exclusively for

use in power line and electric utility services such

as digger derricks and radial boom derricks used to

auger holes and to set utility poles and place

associated equipment;

(viii) equipment designed exclusively to move earth;

(ix) a crane that

(

A) is operated at a mine site,

(

B) is used with a special attachment to move

earth or material, and

(

C) meets the requirements of and is operated in

accordance with the Occupational Health and

Safety Act and the regulations under that Act;

(

x) an aerial material handling device with or without

live lines;

(xi) equipment designed exclusively for drilling or

driving piles and casings;

(

c) by repealing clause (g.1) and substituting the

following:

(g.1) "lattice boom mobile crane" means a lattice boom

mobile crane as defined in

Part 2;

(g.2) "lifting capacity" means the highest capacity at the

shortest lifting radius, as defined by the load chart

installed on the mobile crane, tower crane, boom truck

or wellhead boom truck;

(

d) by adding the following after clause (i):

(i.1) "routine maintenance" means the maintenance tasks and

activities recommended by the manufacturer for the

crane or hoisting equipment in question;

(

e) by adding the following after clause (j):

(j.1) "testing" means a procedure used in the course of

normal operation only, to determine that the crane or

hoisting equipment in question is functioning, and does

not include routine maintenance or repair activities;

(

f) in clause (

m) by striking out "Part 4" and

substituting "Part 4.1".

Section 2(2) is repealed and the following is substituted:

4(1) Where, in respect of a branch in the trade, a person is a

certified journeyperson and is to provide supervision to an

apprentice, that journeyperson is eligible to supervise that apprentice

only

(

a) in respect of the undertakings that constitute that branch, and

(

b) in respect of tasks, activities and functions that come within

that branch,

for which that person is a certified journeyperson.

(2) Where a person is an apprentice in an apprenticeship program in

a branch in the trade and is employed in respect of another branch in

the trade, that apprentice is eligible to carry out work only

(

a) in respect of the undertakings that constitute that branch, and

(

b) in respect of tasks, activities and functions that come within

that branch,

for which that person is an apprentice.

section 5 is repealed and the

Mobile Crane Operator Branch of the Trade

Section 5 is amended

(

a) by repealing clause (a);

(b) "hydraulic mobile crane" means any device or structure

that

(

i) incorporates a hydraulic driven drum and cable or

rope used for raising, lowering or moving material,

(ii) is equipped with a telescoping boom capable of

moving in the vertical plane,

(iii) is mounted on a pedestal, base or chassis, either

crawler, trailer or wheel mounted, to provide

mobility,

(iv) has a lifting capacity of 15 tons (13.6 tonnes) or

greater, and

(

v) may incorporate a ring assembly or a strand

jacking system for hoisting;

(

c) by repealing clause (

c) and substituting the

following:

(c) "lattice boom mobile crane" means any device or

structure that

(

i) incorporates a friction or hydraulic driven drum

and cable or rope used for raising, lowering or

moving material,

(ii) is equipped with a lattice boom capable of moving

in the vertical plane,

(iii) is mounted on a pedestal, base or chassis, either

crawler, trailer or wheel mounted, to provide

mobility, and

(iv) has a lifting capacity of 15 tons (13.6 tonnes) or

greater.

d) by adding the following after clause (c):

i) a hydraulic mobile crane or a lattice boom mobile

crane, and

(ii) a boom truck or a wellhead boom truck that has a

lifting capacity greater than 65 tons (59 tonnes).

(

j) disassembling mobile cranes for transport;

Term of the apprenticeship program - mobile crane operators

8(1) Subject to credit for previous training or experience being

granted pursuant to an order of the Board, the term of an

apprenticeship program for the mobile crane operator branch of the

trade is 3 periods of not less than 12 months each.

(2) In the first period of the apprenticeship program an apprentice

must acquire not less than 1620 hours of on the job training and

successfully complete the technical training that is required or

approved by the Board.

(3) In the 2nd period of the apprenticeship program an apprentice

must acquire not less than 1800 hours of on the job training.

(4) In the 3rd period of the apprenticeship program an apprentice

must acquire not less than 1620 hours of on the job training and

successfully complete the technical training that is required or

approved by the Board.

Section 9 is amended

(

a) in subsection (1) by striking out "mobile crane branch

of the trade" and substituting "mobile crane operator

branch of the trade";

(

b) in subsection (2) by striking out "mobile crane branch

of the trade" and substituting "mobile crane operator

that branch may employ 2 apprentices in that branch and 2 additional

apprentices for each additional certified journeyperson that is

employed by that person.

(3) For the purposes of subsection (2), a person who is a certified

journeyperson in the boom truck operator branch of the trade or

employs a certified journeyperson in that branch, instead of

employing an apprentice in an apprenticeship program in the boom

truck operator branch of the trade, may employ the following:

(

a) an apprentice in an apprenticeship program in the mobile

crane operator branch of the trade to carry out any of the

undertakings that constitute the boom truck operator branch

of the trade;

(

b) an apprentice in an apprenticeship program in the wellhead

boom truck operator branch of the trade to carry out any of

the undertakings that constitute the wellhead boom truck

operator branch of the trade.

Section 24 is repealed.

Section 25 is amended

(

a) in subsection (1) by striking out "boom truck craft of

the boom truck branch of the trade" and substituting

"boom truck operator branch of the trade";

(

b) in subsection (2) by striking out "boom truck craft of

b) wireline operations;

c) perforating operations;

d) coiled tubing operations;

(

e) snubbing operations;

(

f) the rig up and rig out of slant service rigs.

Apprenticeship

Term of the apprenticeship program -

wellhead boom truck operators

25.4(1) Subject to credit for previous training or experience being

granted pursuant to an order of the Board, the term of an

apprenticeship program for the wellhead boom truck operator branch

of the trade is one period of not less than 12 months.

(2) In the period of the apprenticeship program the apprentice must

acquire not less than 100 hours of on the job training and

successfully complete the technical training that is required or

approved by the Board.

Employment of apprentices re wellhead

boom truck operator branch

25.5(1) Where, with respect to the employment of apprentices in

the wellhead boom truck operator branch of the trade, a person

employs an apprentice, that employment must be carried out in

accordance with this section.

(2) A person who is a certified journeyperson in the wellhead boom

truck operator branch of the trade or employs a certified

journeyperson in that branch may employ 2 apprentices in that

branch and 2 additional apprentices for each additional certified

journeyperson that is employed by that person.

(3) For the purposes of subsection (2), a person who is a certified

journeyperson in the wellhead boom truck operator branch of the

trade or employs a certified journeyperson in that branch, instead of

employing an apprentice in an apprenticeship program in the

wellhead boom truck operator branch of the trade, may employ an

apprentice in an apprenticeship program in the mobile crane operator

branch of the trade or the boom truck operator branch of the trade to

carry out any of the undertakings that constitute the wellhead boom

truck operator branch of the trade.

Wages

25.6(1) With respect to the payment of wages to an apprentice in an

apprenticeship program in the wellhead boom truck operator branch

of the trade, a person shall not, subject to the Apprenticeship

Program Regulation, pay wages to an apprentice that are less than

those provided for under subsection (2).

(2) Subject to the Employment Standards Code, a person employing

an apprentice referred to in subsection (1) must pay wages to the

apprentice during the period that constitutes the apprenticeship

program that are at least equal to 70% of the wages paid to

employees who are certified journeypersons in wellhead boom truck

operator branch of the trade.

28 The following is added before

section 27:

Identification card remains valid

26.1 A person who on September 1, 2018 held an identification

card in respect of an approved training program under the Boom

Truck Operator Exception Regulation (AR 87/2002) may continue to

work in that trade subject to the original conditions set out in the

identification card.

Conventional mobile crane trade certificate

26.2 A person who on September 1, 2018 held a conventional

mobile crane trade certificate under this regulation may continue to

work in the mobile crane branch of the trade.

Trade certificate re wellhead boom truck craft

26.3 A person who on September 1, 2018 held a trade certificate

under this regulation for wellhead boom truck craft may continue to

work in the wellhead boom truck operator branch of the trade.

Section 32 is repealed.

30 The Boom Truck Operator Exception Regulation

(AR 87/2002) is repealed.

31 This Regulation comes into force on September 1, 2018.

TICKET SALES REGULATION

Interpretation

1(1) In this Regulation,

(a) "Act" means the Consumer Protection Act;

(b) "non-profit organization" means an incorporated or

unincorporated organization that is formed exclusively for a

non-profit purpose;

(c) "non-profit purpose" means a charitable, benevolent,

philanthropic, religious, provident, humane, health, scientific,

cultural, artistic, literary, social, educational, agricultural,

recreational, sporting or other purpose except profit.

(2) For the purposes of

section 57.2(

a) of the Act and this Regulation,

"cancelled", in relation to an event, includes an event that is

rescheduled to another date.

(3) For the purposes of

section 57.2 of the Act and this Regulation,

"full refund" means a refund of the ticket price and of any fees, taxes,

charges and costs paid by the ticket purchaser to the ticketing business

at the time of the ticket purchase or paid in relation to the ticket

purchase including, without limitation, service fees, processing fees

and delivery fees.

Exemptions

2(1) An operator of a secondary ticketing platform is exempt from the

application of

section 57.2 of the Act if the operator is a non-profit

organization.

(2) A secondary seller is exempt from the application of

section 57.2

of the Act if the secondary seller is a non-profit organization.

(3) A secondary seller or an operator of a secondary ticketing platform

is exempt from the application of

section 57.2(

a) in respect of a

specific ticket sale if

(

a) the cancelled event for which the secondary seller or the

operator of a secondary ticketing platform sold the specific

tickets has been rescheduled,

(

b) after the event has been rescheduled, the secondary seller or

operator of the secondary ticketing platform has prominently

and in writing offered the ticket purchaser the choice of

(

i) a full refund, or

(ii) tickets for the event on the rescheduled date,

and

(

c) the ticket purchaser has expressly accepted the tickets offered

under clause (b)(ii).

(4) An operator of a secondary ticketing platform is exempt from the

application of

section 57.2 of the Act where the platform only

advertises the sale of tickets and does not perform any other action or

function in the sale of the tickets.

Prescribed control, measure, system

3 A control, measure or system that is used to limit the number of

tickets a person may purchase is prescribed as a control, measure or

system for the purposes of

section 57.3(1)(

e) of the Act.

Expiry

4 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be

repassed in its present or amended form following a review, this

Regulation expires on April 30, 2021.

Coming into force

5 This Regulation comes into force on the coming into force of

section 1(10) of A Better Deal for Consumers and Businesses Act.

AMENDMENT REGULATION

Section 9(4) is amended by striking out "and" at the end

of clause (a), adding "and" at the end of clause (

b) and

adding the following after clause (b):

(

c) in the case of live chickens being transferred from one

location to another, prepare a report of the number of

chickens transferred along with the legal land description of

the locations from and to which the chickens are transferred,

and submit the report to the Board office within 48 hours of

the chickens being transferred.

Section 13 is repealed and the following is substituted:

Base quota increases or decreases

13 When the Board considers that general marketing conditions

warrant a permanent increase or decrease in base quota, that increase

or decrease must be allocated by the Board according to Council and

Board policy.

Section 18(6) is amended by striking out "of $200" and

substituting "established by the Board".

a) in subsection (3)(

31.1(1) An authorized producer is required to hold a minimum of

100 units of authorized quota.

(2) For the purpose of subsection (1), the amount of authorized

quota must be determined as follows:

a) the holding of authorized quota for an individual is the sum

(

i) the authorized quota that is held by that individual,

(ii) the proportionate share of any authorized quota in

which that individual has an ownership interest through

a corporation or partnership or an unincorporated

organization referred to in

section 1(p)(ii) or group of

individuals referred to in

section 1(p)(iii), and

(iii) any authorized quota in which the individual has an

ownership interest as a lessee of quota;

b) the holdings of authorized quota of a corporation or

i) the authorized quota held by that corporation,

partnership, unincorporated organization or group of

individuals,

(ii) the proportionate share of any authorized quota that the

corporation, partnership, unincorporated organization or

group of individuals holds through an ownership

interest in another corporation, partnership,

unincorporated organization or group of individuals,

and

(iii) any authorized quota in which the corporation,

partnership, unincorporated organization or group of

individuals has an ownership interest as a lessee of

quota.

(3) The Board shall not allocate, reallocate or approve the lease of

any authorized quota if as a result of that allocation, reallocation or

lease any person would hold less quota than that required under

subsection (1).

(4) The restriction set forth in subsection (3) does not apply to the

reallocation of quota to a person under a will or under the Wills and

Succession Act.

(5) If authorized quota is reallocated under subsection (4), any

subsequent allocation or reallocation, except a further reallocation

under subsection (4), is subject to subsection (1).

Section 33 is amended

(

a) by repealing subsection (7) and substituting the

following:

(7) If a lease is terminated and any reductions in the marketing

of chicken imposed under

section 23(2) are not completed, the

remaining reductions in the marketing of chicken are the joint

responsibility of the authorized producer who leased out the

quota and the lessee of that quota.

(

b) in subsection (9) by striking out "a licensed producer"

and substituting "an authorized producer".

Section 41.3(1)(

b) is amended by striking out "units".

Section 45 is amended by striking out "May 31, 2018"

and substituting "May 31, 2023".

Section 9 comes into force 180 days after the day this

Regulation is filed under the Regulations Act.

PROFESSIONAL PLANNER AMENDMENT REGULATION

1 The Professional Planner Regulation (AR 115/2010) is

amended by this Regulation.

Section 22 is repealed and the following is substituted:

Service of notices

22 A notice to be served on the Institute Registrar, the Council, the

Registration Committee, the Practice Review Committee or the

Discipline Committee, or any member of those committees or the

Council, is sufficiently served

(

a) if it is personally served at, or sent by registered or certified

mail to, the office of the Institute, or

(

b) if it is transmitted and acknowledged in accordance with

Institute policy

(

i) by facsimile machine to the Institute's facsimile

number,

(ii) by e-mail to the Institute's e-mail address, or

(iii) by other electronic means.

Section 24 is amended by striking out "Code of Professional

Conduct" and substituting "Professional Code of Practice".

Section 27 is repealed.

5 The

Schedule is repealed and the following is

substituted:

Professional Code of Practice

1 A regulated member must practise in an ethical and responsible

manner and their efforts must address the public interest.

2 A regulated member must provide professional services

(

a) with integrity, objectivity and independence,

(

b) in a manner that respects the diversity, needs, values and

aspirations of the public and encourages discussion on these

matters,

(

c) in a manner that acknowledges the inter-related nature of

planning decisions and their consequences for individuals,

the natural and built environments and the broader public

interest, and

(

d) with consideration to the cumulative and long-term

implications of the member's services.

3 The regulated member must take all reasonable steps to maintain

their professional competence, knowledge and skills and must fully

comply with the continuous professional learning requirements of the

Institute.

4 A regulated member must hold in confidence all client information

unless the member is permitted by the client o
